The legal right to do this is outlined in s.15 Audit Commission Act. Each invoice is connected to a payment made by Merseytravel (or to give it its formal name the Merseyside Passenger Transport Executive).

    Just a question with the bank account details, are you not breaking the law by showing these ? Data Proction act thingy!

    1. Thank you for your question.

      Section 34(c) of the Data Protection Act 1998 applies.

      Therefore although bank account details would normally be subject to the non-disclosure provisions it’s not subject to the non-disclosure provisions in this case. This is because the data controller (Merseytravel) was obliged to disclose it to me (or as the Act states “make available to the public”) by making it available for inspection under an enactment.

      The specific enactment is s.15(1)(a) of the Audit Commission Act 1998.

      Merseytravel (the data controller) didn’t have the legal power to remove the class of information you refer to (such as bank account details).

      It’s not from my reading even within the power given to their external auditor to approve either.

      However thanks for your question!

    I’ll clarify in relation to the political hot potato comments, there were attempts to delay scrutiny over that matter into the far, far future.

    In fact that’s still the case when it comes to some elements of it.

    Obviously someone’s worried they’ll be blamed for what happened and/or they don’t have a good enough set of reasons to give as to what happened.

    John, how can they justify AdderleyDadderleyDooLally and his dog’s body from “The Chamber Pot” lying to me about no Big recipient going bankrupt.

    Paying Grant (I’ll keep my gob shut at Gra Gra’s meeting) Thornton £50,000.00 plus for a very very limited report and hiding it. Not allowing them to question staff. ha ha ha

    Getting “The Pretend Friend” Kitchen Cabinet Member for all things vile to get “The Shyster” “Phil the Very Very Deluded Dill” and “Ankles” all on side.

    Getting the other party leaders to roll over and stay schtum (Obviously misspelt and the spell check says scrotum).

    Getting the numpty and gang at The Fudge It and Risk It Mis-Management Committee to ignore the issues. Apart from Ned Kelly obviously so they got rid of him.

    Hiding the chief internal auditors report on asset stripping etc.

    Hiding the Grant (The investigator encouraged whistle blower to continue after he was leaving for whatever reason) Thornton Report.

    Paying off Dave Garry about £40,000.00 and who encouraged him to do a croc of shit report to replace Beverley’s.

    Spending a fortune on and taking the piss out of the Information Commissioner with dodgy reasons for not being open, honest and transparent.

    Still employing AdderleyDadderleyDooLally, setting up “The Chamber Pot” for “The Chamber Potty” and her family.

    Letting AdderleyDadderleyDooLally retire with a massive payout and new custom built job.

    Got to go now John but will continue laughing at them till they do the right thing.

      I’m not sure which timeframe you are referring to.

      At the special meeting of the Audit & Risk Management Committee that we were both at there was an acknowledgement that some payments of grant had been made to companies that had later gone into liquidation.

      However as you remember the former Chief Executive Graham Burgess of Wirral Council stated that he saw this as a feature of the wider economic situation on the Wirral, rather than due to any flaws in the due diligence (or lack of it) done on grant applications. That of course is one opinion.

      As to the Grant Thornton report.

      Personally I feel it was a conflict of interest to commission their external auditors to write such a report. It should’ve been done by an organisation independent of Wirral Council. I understand the statements/justification that Grant Thornton made that there were “Chinese walls” between its forensic accountancy work in this matter and their role as external auditors.

      If you remember the Grant Thornton report (this bit was written by Grant Thornton) told Wirral Council not to release their report in response to a FOI request.

      You are right that former Cllr Stuart Kelly was not reelected and was beaten by a Labour opponent in Oxton ward. However I will point out that on the same day there was a General Election and Cllr Stuart Kelly’s party (Lib Dems) were being punished nationally by the voters based on the record of the last 5 years of the Lib Dem in government.

      Essentially as there are larger expense limits in a General Election he would have lost votes because of Labour literature put out to the voters to re-elect the Rt Hon Frank Field MP in Birkenhead.

      This expenditure on the Rt Hon Frank Field MP’s general election campaign doesn’t count towards the expenditure limit of the Labour candidate in Oxton ward (unless there was joint leaflets/joint expenditure).

      As to the Chief Internal Auditor’s report, well he got early retirement before the public saw that didn’t he?

      As to dodgy reasons for refusing FOI requests, if I was you I’d put a ~4 year timescale for getting some information out of Wirral Council rather than the 20 days under FOI.

    1. Strangely enough only 5 hours after you wrote that I got a response to this FOI request.

      Basically the response is a three page letter from Surjit Tour stating that they have the information requested, but no.

      I point to this Values and Culture presentation at Wirral Council (also initially refused on s.36 grounds) which states:

      Integrity

      We are accountable and take responsibility for our actions & decisions.

      We communicate & are open and honest in what we do.

      But then you see obviously Surjit Tour is applying the slide on efficiency here.

      Efficiency

      We seek innovative and creative solutions.

      In other words it’s more “efficient” to send me a three page letter saying no, as Mr. Tour knows as well as I do that an internal review to Eric Robinson will just agree with him and an appeal to ICO might just side with them too!
