Wirral Council asks judiciary to intervene to keep 94 page report on Hoylake Golf Resort secret!

This is an update to a previous story I published on this blog headlined ICO require Wirral Council to release 94 page draft agreement with Nicklaus Joint Venture Group Limited about Hoylake Golf Resort.

I received a 2 page letter yesterday (4th September 2017) sent by Second Class post dated 1st September 2017 from ICO (the regulator).

In summary the letter states that the Information Commissioner’s solicitors are now dealing with the matter as Wirral Metropolitan Borough Council have appealed decision notice FER0672223 to the First-tier Tribunal (Information Rights).

As Wirral Council are the Appellant, the Information Commissioner will be First Respondent.

ICO’s letter also states that due to this the Commissioner won’t be keeping me informed about further developments on the appeal.

Although I’m the person who made the original information request, as I’m not appealing the decision notice, I’m not at the point of writing this blog post a party to the matter.

From past experience it could take ~7 months before a decision is reached.

This is a new situation I find myself in as it’s the first time a public authority has appealed to the First-tier Tribunal a decision notice relating to an information request I’ve made!

  1. It looks like Surjit Tour’s departure may be signposting a departure from the council’s customary approach to cover-up.

    Maybe they are now even more determined to slam the shutters down. That or they haven’t got a clue WTF they are doing.

    I’d suggest the latter.

    1. Philip McCourt only became Interim Assistant Director (Law and Governance) as of yesterday (4th September 2017).

      That was 3 days after ICO wrote their letter to me telling me it had been appealed to the First-tier Tribunal.

      As as far as I remember Wirral Council’s constitution requires the agreement of the Assistant Director (Law and Governance) for Wirral Council to appeal a decision notice to the First-tier Tribunal, so I would guess the decision to do this was made when Surjit Tour was still the Assistant Director (Law and Governance).

      Or if the end of his time at Wirral Council meant he was technically the post holder but using up accrued leave, whoever is his deputy in his absence.

      The decision notice explains why the information should be released.

  2. Still going on about this bloody golf course, they haven’t got the money to fix faulty street lights or fill pot holes in, but i bet they find the money for this!

    1. From memory, the Hoylake Golf Resort project is at least two golf courses, a hotel, bars, restaurants, shops, some “luxury housing” and car parking.

      Wirral Council have managed to find the money for the Hoylake Golf Resort, in December 2016 they had committed to spend £832,969 on it (at the time about £237,000 had already been spent).

    Looks like “Philly Liar’s” Uncle Joe has got the billions of Commonwealth Gold.

    Mr Call Centre MBE might have to stay on Kev and Stella’s Stinking Stagnant wirral Waters and ship over workers from Everpool on a new purpose built boat at Cammell Turds called “Boatie McPhilTwoFace”.
