The year started with a look at why Martin Morton had called on Cllr Pat Williams, Cllr Moira McLaughlin and Cllr Denise Roberts to resign. I also published the accounts for Birkenhead Market Limited (who lease Birkenhead Market from Wirral Council) and a letter gagging Councillor Gilchrist.

After the Merseytram matter hit the buffers, Merseytravel was left with property that it didn’t want or need. The first story is about what happened when they tried to sell it off. The second story is the first about Lyndale School and how when the first Cabinet decision got called in, the call in committee had to ask Council to add extra people to it who’d been left off in a “constitutional oversight”. The third story was about the court battle between Wirral Council and Upton Park Pony Association. Upton Park Pony Association were given a year to leave Fernbank Farm (which is owned by Wirral Council).

It may seem strange now, but in March the government were consulting on changes to the filming public meetings law. Some changes were made to the draft regulations and a right to live commentary during meetings was removed. Some new criminal offences were also added to the same legislation (but not to the section about filming). The “open and transparent” story was about the Chief Executive, in a 4 page letter, upholding an earlier decision at internal review to refuse a Freedom of Information Act request for the minutes of the Standards Working Group of the 17th December 2013. The last story was about the Wirral Street Pastors organisation and what Mark Latham had to say at a public meeting about Birkenhead’s night life.

113 candidates stood in the Wirral Council elections and only 23 of these were later elected. However if you’re interested who they were then there’s a list of names. The Liverpool City Region Combined Authority met for the first time on April 1st and chose Cllr Phil Davies as Chair. The third story is my rebuttal of a (mainly) false complaint made about me by a Lib Dem.

May had two elections in it. The first was where one councillor to Wirral Council was elected for each ward (except one that elected two due to a recent resignation in Greasby, Frankby and Irby). The second election was for 8 Members of the European Parliament for the North West region. The Lib Dems lost their only MEP in the region Chris Davies and ended up with no Members of the European Parliament in North-West England. Brian Kenny (Labour) lost his council seat in Birkenhead and Tranmere to Pat Cleary (Green Party). Ian Lewis (Conservative) lost his council seat to Treena Johnson (Labour) in Leasowe and Moreton East. Labour also gained in Pensby and Thingwall (the seat was held by an independent formerly a Lib Dem who wasn’t standing).

So the net result was that Labour increased its number of councillors from 37 to 38 (a majority of seats on Wirral Council is one party having 34 or more councillors). The Conservatives decreased their number of councillors from 22 to 21. The Lib Dems stayed on six and the Greens increased from no councillors to one.

In June I started publishing some of the court papers to do with the Fernbank Farm case including Wirral Council’s particulars of claim. During filming a public meeting of the Licensing Act 2003 Committee Cllr Steve Niblock insisted on me stopping so I moaned to Surjit Tour about it. The last story was warning about the effects on the health of the children at Lyndale School if the Lyndale School were to be closed.

July was all about golf because of the Open Golf Championship. First the email of Graham Burgess was claimed to be “fraudulent” by Surjit Tour (who referred to it as the “Open Gold Championship”). Then five minutes later Surjit Tour tried to recall the email. Then BBC Radio Merseyside had a caller asking about the story. Wirral Council’s press office then managed to tell BBC Radio Merseyside two contradictory versions of events over a short period of time. However don’t worry Cllr Walter Smith came on the radio and told everybody how in his day job as a tailor he had enjoyed “lavish hospitality” at the golf!

Phil Ward came in for criticism for the way he’d chaired the Lyndale School consultation meetings. As part of the 2013/14 audit I made public the £1,872 Wirral Council had spent on Robin Hopkins of 11KBW to make sure that they didn’t have to give out information to a Freedom of Information Act requester in response to ICO decision notice FS50474741.

The mileage claim forms for councillors threw up some interesting visits, including one by Cllr Tony Smith to Lyndale School back in February 2013. Once again the Cabinet decided to go ahead to the next stage of consultation on closure of Lyndale School, Surjit Tour got sent another of my letters pointing out the flaws in the decision-making process. The decision was called in.

Marvin the Martian returned to discuss Lyndale and cuts to the SEN budget. The special Audit and Risk Management Committee meeting (twice adjourned from July 2014) finally met on 8th October 2014 to discuss the BIG/ISUS issues and hear from Nigel Hobro. Graham Burgess also gave in his three-month notice and announced his retirement from 31st December 2014.

A Merseytravel public meeting to discuss whistleblowing led to an interesting turn of phrase. The trade unions marched on Wallasey Town Hall, to have to first sit through a Cabinet meeting discussing how wonderful the Open Golf Championship had been. A consultation on a possible new fire station in Greasby village led to a packed public meeting in Greasby, with Dan Stephens (Chief Fire Officer) doing his best to answer questions from the public about Wirral Council’s involvement.

December’s stories start with the sad news that just before Christmas the Cabinet decided to close Lyndale School (from 31st August 2016). A member of the Wirral Schools Forum expressed concern at the scale of cuts to special educational needs and Wirral Council councillors decided on a long list for a Head of Specialist Services (the outgoing Head of Specialist Services leaves on 31st December 2014).

Now we turn to the expenses claims of one of my very own Labour councillors for Bidston & St. James ward Councillor Ann McLachlan. Cllr McLachlan is Deputy Leader of the Council and Cabinet Member for Governance, Commissioning and Improvement. As you can imagine from such a senior councillor, her expenses claims are quite long.

Her expenses claims refer to trips to the local Gautby Road Play and Community Centre Joint Management Committee in (you’ve probably guessed already) Gautby Road, on which she represents Wirral Council’s interest. In fact I think she’s Chair of that. Yes that’s the committee that is in charge of the play area next to the community centre which is kept padlocked because the last thing we want is children using a play area!, Improvement Board meetings (which ceased in November 2013), Chrysalis (what’s that?), a trip down to London for a pensions conference, Cabinet meetings, a “transformation event” at the Floral Pavilion, Wirral Metropolitan College governors meeting, interviewing job applicants for the Director of Resources post, trade union meeting about redeployment, more job interviews and shortlisting, work on the Member’s (Members refers to councillors) Training Steering Group, the Chrysalis Board (again), a LGA Conference in Manchester, a “Strategic Communications” workshop at the Floral Pavilion, another redeployment meeting, “Visioning Training” at the Floral Pavilion, a meeting of the Democracy Working Party, the LGA Leadership Academy in Coventry (module 3) please, please no jokes in the comments about her being sent to Coventry where she spent £35 on taxis, another Leadership Academy in Coventry (module 2) when her taxi claim was £41.80 (maybe module 2 teaches you leadership skills such as how to get cheaper taxis to the same place), the Beechwood and Ballantyne Housing Association Board, interviews for a Strategic Director, shortlisting for the Director of Children and Young Peoples Department, more leadership training in Coventry where the taxi was only £10.40, the local Area Forum, a meeting to do with the Hoylake Golf Resort launch, full Council meetings, Youth Parliament, well you can see for yourself below how busy she’s been!

Above you can watch what happened at the Planning Committee meeting to decide on the planning applications about Tranmere Rovers training ground.

Wirral Council’s Planning Committee yesterday voted eight votes to five on two linked planning applications to do with Tranmere Rovers Football Club. The first vote was on the application for a training ground at the Solar Campus, 235 Leasowe Road, Leasowe and the second was on a linked application for up to ninety houses on the Ingleborough Road site in Tranmere.

There were petitioners that spoke for and against the proposals. In addition to the petitioners, Jeremy Butler (Tranmere Rovers Chief Executive) made the last representation for Tranmere Rovers in support of the application. Finally ward councillors Cllr Ron Abbey (for Leasowe and Moreton East) and Cllr Paul Doughty (for Prenton) also spoke to the Planning Committee.

These representations were followed by a discussion about the linked applications by the councillors on the Planning Committee. If the applications were approved Mr Parry Davies told councillors that the plan was to move the existing plaque to the Birkenhead Old Boys who died in World War I to Hamilton Square.

David Ball referred to a letter from the Birkenhead Institute Old Boys to the Chief Executive Graham Burgess that he had received and assured councillors that they would work constructively if the applications were approved to remove the plaque to a suitable place in Hamilton Square to the men who gave their lives to the country. He also said that they would work constructively over the tree issues which were there in memory of the people who had died.

He explained that the previous approved application for Woodchurch hadn’t been able to be progressed so alternative sites had to be looked at. If approved he would make sure that the conditions were “rigorously enforced”. In discussions with Tranmere Rovers Football Club they had made a commitment to work with Wirral Council on those matters such as the men who fell in World War I.

In response to Cllr Phillip Brightmore he said that he would be sending written confirmation of this to Birkenhead Institute Old Boys that they would deal sensitively and appropriately and take all steps to make sure what he’d outlined would happen. His assurance was that the mater would be dealt with sensitively. He said he was happy to lead on it along with David Armstrong to make sure it was being dealt with at a senior level. Mr. Ball gave his assurance to councillors on these two matters.

Cllr David Elderton asked a question about heights and whether they could condition the housing planning application to reduce heights to not exceed more than two stories? Matthew Parry Davies replied that these would be considered at the reserved matters stage of any application. Cllr Denise Realey said that she lived near to Tranmere Rovers Football Club’s football ground (Prenton Park), she had heard councillors on the radio talking about it and what would be done with the money from the sale. She pointed out the five-mile distance from Birkenhead to Leasowe and didn’t think the benefits outweighed the problems.

Matthew Parry Davies replied that the National Planning Policy Framework didn’t require replacement facilities to be in the same ward or locality but just within the Borough. The section 106 agreement would make sure money from the sale of the land would be placed into an account solely for the provision of a new training ground. He then answered a question about the Leasowe site and its public transport links.

Cllr Stuart Kelly stated that it was a departure to the development plan and ought to be refused unless the circumstances outweighed the loss. He referred to the loss off the recreation ground and the heritage issues. Cllr Kelly referred to the intentions of those that built the pavilion to provide sporting facilities for young people in Birkenhead. He didn’t think that having a training ground in Leasowe was a suitable replacement. Cllr Kelly wanted a replacement in Birkenhead and referred the loss of open recreation land in Leasowe and traffic issues.

Cllr Christine Spriggs talked about the passions and emotions about these applications. She suggested that Tranmere Rovers Football Club had a real and meaningful dialogue with Birkenhead Institute Old Boys. Cllr Spriggs went on to refer to the housing built on the former site of the Birkenhead Institute School.

The Chair asked a question about the fencing, to which the reply was that the five metre fence was to prevent balls leaving the training ground. Cllr Kelly also referred to the fence and asked if they could demonstrate special circumstances for the development? Cllr Daniel referred to the issue of social housing and was told that the viability assessment for social housing had been revised but that social housing wasn’t viable at the moment. The section 106 agreement would include a contribution to affordable housing if land values changed.

Cllr Brightmore asked if it was permitted development in the greenbelt? An officer replied that as it was for recreation or sport that this was an acceptable and appropriate use of the greenbelt.

The first vote was on agenda item 5 (the Solar Campus, Leasowe application). Cllr Kelly asked why they were having that vote first? Rosemary Lyons, legal adviser to the Planning Committee stated that they were dealing with item 5 first to enable them to make a reasoned decision on item 4 as the two were linked.

Cllr Kathryn Hodson proposed approval of item 5, seconded by Cllr Matt Daniel. Eight councillors voted for, five against so the application was approved.

Cllr Stuart Kelly moved refusal of item four because it was contrary to the Unitary Development Plan and under policy RE6 failed to demonstrate an adequate replacement provision regarding the location. Cllr Denise Realey seconded this.

More councillors voted against refusal then for approval (Cllr Christine Spriggs abstained).

Cllr Kathy Hodson moved approval, seconded by Cllr David Elderton. As before eight councillors voted for and five against. So both linked planning applications were approved by an 8:5 vote.

Today was the second meeting of the Liverpool City Region Combined Authority. The agenda and reports can be read on Knowsley Council’s website. Item 19 was “Liverpool City Region Strategic Local Investment Plan (2014-17) Housing Sites” and had in its appendices a list of housing sites that are currently in the pre planning stage.

This particular entry in appendix 3 (which can be found on page 124 of the reports pack) caught my eye and is below.

Moreton (Wirral) Approximately 100 dwellings Cabinet resolution on 7 November 2013 to defer decision for disposal until the outcomes of legal proceedings for the relocation of the existing tenant are known. A court order dated 13 February 2014 granted a Possession Order to the Council which provided tenant with six months to relocate. The Council has since offered to extend this period to 12 months from the date of the court order. No current resolution, however, to dispose of site.

The Cabinet resolution of 7th November 2013 in relation to Fernbank Farm was (3) the decision on land at Manor Drive be deferred and reconsidered at the next scheduled meeting of the Cabinet when the outcome of legal proceedings will be known. The legal proceedings didn’t deal with relocation of the existing tenants but merely Wirral Council’s claim for a possession order.

The court order dated 13th February 2014 gave twelve months, not six as stated in the report before the possession order had effect. The Council hasn’t “offered to extend this period to 12 months” as that’s the date in the court order!

The Planning Committee meeting started as usual with her usual spiel about who were sitting around the tables (which considering that everyone had name plates seems a little unnecessary). She said that to her left was the solicitor (Rosemary Lyons) to “make sure everything is done legally” and that the officers (of which there were four) to her left where there to “guide us through our decisions and make sure everything is done appropriately with planning legislation”.

If the Chair thinks the role of the officers to her left is to make sure that decisions about planning applications are made according to planning legislation, then what’s the purpose of having a solicitor too? When every other committee at Wirral Council manages to cope with one legal adviser why does the Planning Committee need five to advise it on such matters?

She then went on to recap the rules on speaking for petitioners and applicants. The only change to usual is that she said, “A ward councillor can come forward and talk upon any item in their ward and they can speak for longer than five minutes but everybody only gets a chance to address the Planning Committee once.”

Until recently ward councillors were under the impression they could address the Planning Committee at any time when a planning application concerning their ward was being discussed. The Code of conduct for Planning Committee meetings and Wirral Council’s constitution have nothing in them about ward councillors talking at Planning Committee meetings. Certainly in the recent past at least one councillor thought they could speak at any time but the Chair told them they couldn’t. The only reference in the constitution to councillors and Planning Committees is that ward councillors can decide that they want a planning application to be decided by the Planning Committee rather than by officers.

The constitution states that any councillor can decide that a planning application is decided by the Planning Committee. The fact this isn’t limited to councillors in the ward the planning application relates to has been misused in the past. With fictional names I’ll give an example.

Mrs Smith is standing as the Labour candidate in Puddleton (a made up ward that doesn’t exist on the Wirral). Unfortunately for Mrs Smith Puddleton has three councillors from a different political party who know she is the Labour candidate in Puddleton. Mrs Smith spots a planning application that she thinks she can get a large petition of residents against it and gain votes of local residents affected by it. As the lead petitioner she will also get to speak against it for five minutes, if a councillor takes it out of officer’s hands and makes sure it is decided by the Planning Committee.

Unfortunately for Mrs Smith it’s over a minor matter and wouldn’t usually be decided by the Planning Committee. The planning officer wants to approve the planning application. Mrs Smith asks a Labour councillor (who doesn’t represent Puddleton) to make sure that it will be decided by the Planning Committee, therefore ensuring it is decided nearer the election and that there will be more media coverage of Mrs Smith’s campaign. The Labour councillor makes sure that this happens, thus making the residents think that Mrs Smith is influential and when the application is turned down a better choice than the existing councillor (also a candidate) which didn’t want it to be decided by the Planning Committee as he/she knew it was part of a party political ploy by Mrs. Smith to gain votes from local residents.

However, going back to the Planning Committee. The minutes of the meeting held on the 20th March 2014 were agreed. Nobody declared any interests and no requests for site visits were made.

The first planning application to be decided was OUT/14/00094: 38 Thurstaston Road, Irby, CH61 0HF: Outline planning application to create 2 No. new residential properties. A Wirral Council officer said that there had been seven letters of objection detailing various issues which she listed. Despite the objections officers felt it was compliant with national and local planning policies and recommended it for approval subject to conditions.

Councillor Wendy Clements said that had Tony Cox not resigned as a councillor that he would’ve attended the Planning Committee meeting and detailed the concerns of local residents. She talked about trees, British standards and asked planning officers about a tree survey.

Matthew Davies replied that there had been a tree survey with the application and it had also been assessed by the Council’s arboricultural officer. He pointed out that some of the trees mentioned by Cllr Wendy Clements were not part of the planning application and that they couldn’t impose conditions on trees outside of the boundary. He said that if trees were damaged outside of the boundary it was a civil matter.

Councillor Wendy Clements said that that was difficult to understand as the existing standard referred to trees on or adjacent to the site. She referred to appearance and amenity issues but accepted that whether it was unacceptable harm was a matter of opinion, but she felt that the way officers had written the report it implied that some harm would result. Cllr Clements passed around photos to show the effect on light on neighbouring properties. She referred to policy HS4 and how the scale of what was proposed fitted into the surrounding area.

Councillor Elderton asked to see the plan, but he pointed out that as it was an outline planning application that the position of the houses was only indicative at this stage. He thought different positions of the houses would be more suitable but stated that it couldn’t be turned down based on the indicative positions as they were only indicative. He asked officers for advice as he was not happy with the proposed development.

Matthew Davies said that as it was an outline planning application that all matters would be reserved and that the plan was only for indicative purposes. He said that if the application was approved then Wirral Council would have significant control over the scale, site, appearance and where the properties were sited.

Councillor Wendy Clements moved refusal on the basis that it would result in a development that was cramped, overdeveloped and that the two dwelling would cause a detrimental change to the area contrary to the guidance in the National Planning Policy Framework and policy HS4 of the Unitary Development Plan.

Councillor Steve Foulkes said that he felt three was feasible on the plot, he asked what the average plot size was for surrounding properties? Matthew Davies replied that the officers felt it was possible to have three dwellings on the plot. Although plot sizes were similar on one site of the application site, they were different to what was proposed on another. Therefore in his opinion it was up to councillors to make a judgement as to whether three could be accommodated taking into account the detail that would be decided at the reserved matters stage.

Councillor Geoffrey Watt seconded Councillor Wendy Clements motion for refusal.

The motion for refusal was 6 votes to 6. The Chair didn’t say how she used her casting vote. However she deemed the motion for refusal to be lost.

There was then a vote on the officer’s recommendation for approval. This was proposed by Cllr Denise Realey and seconded by Councillor Steve Foulkes.

The motion for approval was won by 7 votes to 5 so the application was approved.
