To very little fanfare, Wirral Council have published the 12 page peer review conducted by the Local Government Association last year. This was accompanied by a press release which glosses over some of the criticism in the peer review.

Here are some quotes from the peer review (followed by my comments in italics):

Financial Strategies

In past years the council has been overspending in some directorate revenue budgets and using its reserves to balance the revenue budget. This issue was reflected in the previous peer challenge in 2012 and the council needs to develop the 2016/17 budget and not divert from it. It is currently anticipating a £9.2m slippage on this year’s savings target of £38m.

Political leadership

The Leader’s role as Chair of the Merseyside City Region is seen as recognition of the important role that the Wirral is playing in the development of the city region.”

 

Well shortly after this peer review, Cllr Phil Davies resigned as Chair and Mayor Anderson is now Chair of the Liverpool City Region Combined Authority.

“However, the Senior Leadership Team is not currently giving adequate corporate leadership and this needs to be much stronger if the Plan is to be delivered effectively. More connected leadership is needed from the top to the bottom of the organisation. The council must have the senior officer leadership resource to create capacity to deliver change. The peer team also had a concern at the current high use of consultants and interims who are providing temporary specialist support. This is not a concern about consultants/interims per se, but an observation about their number and duration. The council should continue to ‘invest to save’ – efficiently and effectively – using the right external help for specific time-limited purposes, but look to reduce the overall number of longer-term interims in key roles. The council needs to move quickly to a new organisational shape to support the Chief Executive, including providing the right kind of strategic level capacity.”
 

If I hadn’t written Why has Wirral Council spent £6,003,273.07 on temporary staff over the past 10 months? around a year ago, would this have even been mentioned in the peer review?

Relationship with residents

The council and its partner agencies recognise that they want to form a different relationship with residents in the future. There is general recognition that relationships with local communities has been negatively impacted by the past challenges the council has had to deal with. The new relationship will be based on a clearer Wirral narrative, a greater ability to listen to resident’s issues, making better use of the data and intelligence the council gathers across the Wirral and greater use of channels use as digital and social media.”

 

Ahh, listening to residents’ issues such as over 6,000 signing a petition against closure of Girtrell Court but you go ahead and decide to delegate closure to the Cabinet Member anyway? Or is this all part of listening to residents then doing the opposite of what they want?

The Council’s approach to partnership working

There is evidence of community involvement in the council’s budget processes, although more limited evidence that this has influenced decision-making.”

 

So, this seems to imply that when Wirral Council have a budget consultation, the consultation has a limited effect on the decision after the consultation?

“There is also an opportunity for a more coordinated and cost-effective approach to community engagement amongst the Wirral Partnership members. This might extend to a more joined up approach to communications and campaign activities.”
 

Despite reading this a few times, I’m a little unsure what this means? Anyone care to hazard a guess? I thought the constituency committees were supposed to do community engagement?

New Models for Service Delivery

Delivering significant change must take account of some instances of low staff morale generated by the perception of indiscriminate universal cuts in service provision in recent years.”

In other words Labour councillors constantly going on about government cuts nearly every public meeting is damaging staff morale at Wirral Council.

“The move to new ways of working will need to be driven by a much more powerful Senior Leadership Team to collectively own and drive transformation.”
 

In other words, there’s going to be a senior management restructure and some managers are going to be leaving.

A fortnight ago, required to do so by ICO decision notice FS50596346 Wirral Council finally provided some more information in response to my FOI request first made on the 29th March 2013.

I will point out (in case you’re wondering why it has taken nearly three years to get to that point) that this request has also been the subject of two other ICO decision notices FS50509081 and FS50569254.

So far Wirral Council has stated that the information requested would cost too much (section 12), that to give me the information would be prejudicial to the effective conduct of public affairs (section 36), that they class that doing an internal review of that decision as vexatious (section 14) and now finally when all of those prior decisions have been proven to be flawed, they withheld some of the information requested claiming it’s personal information (section 40).

My feeling about this is that Wirral Council, who refer to their approach in public as open and transparent have tried to engage in attrition warfare with myself and the regulator ICO over this request.

Mind you this is Wirral Council. Wirral Council is where responses to FOI requests from the press get delayed because they have to be "signed off" by the former head of their press office Emma Degg and their Monitoring Officer Surjit Tour?

So what did I request that was released a fortnight ago? One document was minutes of the Members’ (Members’ means Councillors’) Equipment Steering Group meeting held on the 7th February 2013. The other document was minutes of the Members’ Training Steering Group held on the 19th March 2013.

Quite what is in these two documents that requires a nearly three year cover up about their contents, I’m not sure. The scanned pages Wirral Council have supplied for the meeting of the Members’ Equipment Steering Group and the Members’ Training Steering Group are unfortunately scanned at a low resolution which can make them hard to read. So I will reproduce them both below starting with the Members’ Equipment Steering Group. As that mentions audio recording and webcasting of committee meetings I will declare an interest.

The part of this request that relates to the minutes of a meeting of the Headteachers and Teachers Joint Consultative Committee I have appealed to the First Tier Tribunal (Information Rights) and am at the stage of awaiting ICO’s response to my appeal.

XXXXX explained that the Pre course briefing would cover an introduction to the programme followed by the completion of the Myers Briggs Type Indicator questionnaire as this would form the basis for the content on Module one, feedback would then be provided either face to face, which preferable or over the phone, prior to the programme commencing on the 8th May.

    It was noted that participants are required to attend both modules to benefit from the programme.

    Agreed to escalate the request to include members training from the skills for Wirral programme into the committee calendar.

Yesterday’s Cabinet meeting agreed changes to which area each councillor on the Cabinet covers and some minor changes to how each Cabinet portfolio’s description.

Instead of two Deputy Leaders at Wirral Council (Cllr George Davies and Cllr Ann McLachlan) there will now be only one Deputy Leader (Cllr Ann McLachlan).

You can read a list of the revised roles for each Cabinet portfolio holder on Wirral Council’s website.

I thought it would be useful to explicitly state each Cabinet’s former title and its new title (along with the councillor that now holds that role). Old titles are in italics. New titles are in bold. None of the councillors on the Cabinet have changed.

Also decided were a number of Pledge Champions. The role of each Pledge Champion will be to make sure there is action on a specific pledge in the Wirral Council Plan: a 2020 Vision (formerly called the Corporate Plan).

Twenty councillors (all from the ruling Labour Group) were appointed as Pledge Champions (a role that Cllr Phil Davies pointed out at the Cabinet meeting doesn’t mean these councillors receive increased allowances). A list of who the Pledge Champions are (along with which pledge they are the champion for) was handed out at the Cabinet meeting and is below (but without the bullet points next to each pledge which was on the original). The pledges are in three broad themes of people, business and the environment.

Below is a copy of my statutory objection to the approval of the accounts of the Merseyside Pension Fund (a £6.9 billion pension fund that form part of Wirral Council’s accounts) which go to Wirral Council and its auditors Grant Thornton.

It’s rather dull and technical, but in the interests of openness and transparency I am publishing it below. It relates to yesterday’s meeting of the Pensions Committee that can be viewed below. I was so cheesed off I made two spelling mistakes in the email (a corrected version is below).

Dear all,

I am a local government elector in the Wirral Metropolitan Borough Council area and make this statutory objection to the Pensions Committee approval of the the Merseyside Pension Fund Accounts for 2014/15 (see Audit Commission Act 1998, s.16).

For the purposes of clarity to the auditor this is a statutory objection to a matter not in relation to a matter covered by Audit Commission Act 1998, s.17-18 but Audit Commission Act 1998, s.8.

As required I am sending a copy of this objection to the auditor, those I have contact details for on Wirral Council’s Pensions Committee (I do not have an email address for Cllr Treena Johnson), Wirral Council’s Audit and Risk Management Committee and those tasked with corporate governance at Wirral Council such as the Monitoring Officer Mr. Tour, the Head of Pensions Peter Wallach, the Strategic Director for Transformation and Resources Joe Blott and Tom Sault the Acting 151 Officer as well as other relevant people.

I do not have contact details for some on the Pensions Committee. I am sending this to the officer who took the minutes of the Pensions Committee meeting on the 14th September 2015 in the hope that it can be forwarded to those I do not have contact details for (the non-councillor members and Cllr Treena Johnson).

As this is a rather technical objection, I provide below a summary of the key points.

However I first need to declare an interest. I have a close family relative who is currently paid a pension by Merseyside Pension Fund, therefore a close interest in the corporate governance of the Fund being done properly.

On the 14th September 2015, I and three other members of the public (two of whom were employed by Grant Thornton and are Wirral Council’s auditors) attended a public meeting of Wirral Council’s Pensions Committee.

One of the functions of the Pensions Committee as detailed in Wirral Council’s constitution is to approve the statement of accounts and financial statements of the Merseyside Pension Fund and recommend these to the Audit and Risk Management Committee.

This is because the Merseyside Pension Fund forms part of Wirral Council’s accounts. There is a statutory deadline to approve the statement of accounts for the 2014/15 financial year by the 30th September 2015.

As mentioned at the Pensions Committee itself by one of the councillors this Fund is valued at ~£6.9 billion.

Item 4 and 5 on the agenda of that meeting were the pension fund accounts 2014/15 and draft annual report.

As the Pensions Committee is a public meeting of a local authority, legislation that governs public meetings applies to it. The statement of accounts formed part of a document known as the “Report & Accounts 2014/15” which was given to those on the Pensions Committee present on the afternoon of the meeting itself.

Please note the reference below to principal council, by virtue of Local Government Act 1972, s.100E also apply to committees and sub-committees of a principal council. The Pensions Committee is a committee of a principal council.

Local Government Act 1972, s.100B(4), is quite clear on the procedure that should be followed in the case of agenda items that are not open to inspection by members of the public five clear days before the meeting.

(4) An item of business may not be considered at a meeting of a principal council unless either—

(a) a copy of the agenda including the item (or a copy of the item) is open to inspection by members of the public in pursuance of subsection (1) above for at least [five clear days] before the meeting or, where the meeting is convened at shorter notice, from the time the meeting is convened; or

(b) by reason of special circumstances, which shall be specified in the minutes, the chairman of the meeting is of the opinion that the item should be considered at the meeting as a matter of urgency.

It is clear that the Report & Accounts 2014/15 for the Merseyside Pension Fund did not fall under the description in s. 100B (4)(a) and therefore the procedure in 100B(4)(b) applies. The Chairman of the Pensions Committee Cllr Paul Doughty did not specify at the meeting itself his opinion that the item should be considered as a matter of urgency, nor would the reasons for this be specified in the minutes.

This is an important corporate governance safeguard written into legislation.

Firstly, if the documents are not made available to the public five clear days before the meeting, the public and press cannot scrutinise them. Secondly (as was mentioned at the meeting itself) at least one councillor expressed the view that half an hour was insufficient to scrutinise a highly technical 46 page document.

This is not a one off occurrence. Officers in previous years have frankly played these games of brinkmanship with accounts routinely handed to those tasked with corporate governance to approve on the evening of the meeting itself. The safeguard above in s.100(4)(b) above, details a procedure to be followed if the matter is urgent.

Therefore my objection is that because of what I have detailed above, the Pensions Committee did not approve the statement of accounts for the Merseyside Pension Fund because:

(a) the report was late and
(b) it is clear from the legislation that a procedural step was missed making the decision ultra vires.

I am however not an unreasonable person and suggest the following course of corrective action. If this is followed I will happily withdraw my objection.

i) That the Pensions Committee holds a further meeting between now and 30th September 2015.
ii) The Audit and Risk Management Committee recommendation is altered (agenda item 12 meeting of the 22nd September 2015) to be conditional on the meeting outlined in i) and the same for any Cabinet meeting that has to approve the same item
iii) That at this special meeting it considers the items referred to in this objection in a way that is not open to legal challenge or perceived to be ultra vires and that the information for this meeting is published on Wirral Council’s website five clear days before the meeting.

As Wirral Council’s auditors Grant Thornton will no doubt make clear, the matter that forms this objections needs to be resolved before the accounts are signed off. I look forward to reading and hearing responses to this objection.

However as this is a perceived serious corporate governance failing, I am making this objection public.

After the U-turn last month on car parking charges at Fort Perch Rock car park, New Brighton I made a Freedom of Information request for the objections made during the consultation period.

In addition to a petition of objection which when the consultation finished had 876 signatures but now has 4,010 signatures there were nineteen written objections which included a thirteen page letter sent on behalf of the Wilkie Leisure Group.

Objectors referred to pay and display parking in Hamilton Square, Birkenhead and the reduction in visitors once charges for parking had started. Many objectors thought that car parking charges would put people off from visiting New Brighton. Some objectors thought that what charging would be unlawful. Others felt that Wirral Council ordering the pay and display ticket machines before the consultation on the proposed traffic regulation order started pre judged the outcome of the consultation.

The most detailed objection from Singleton Clamp & Partners Limited sent on behalf of the Wilkie Leisure Group stated:

The official reason for the U-turn given was the what was in the lease that meant that this could lead to parking charges elsewhere in New Brighton. Promenade Estates were quoted in a Liverpool Echo article by Liam Murphy that they would charge for parking at other car parks in New Brighton if charges at Fort Perch Rock car park were brought in.
