The Chair Cllr Paul Doughty welcomed people to the Employment and Appointments Committee meeting, he asked for any declarations of interest. No declarations of interest were made. He said he had received apologies from the Lib Dem spokesperson Cllr Mark Johnston and it would be possible that Cllr Harney would arrive in his place.

He gave those on the committee extra time to read the minutes of the meetings held on the 7th February and 14th February (copies of which had been handed out) as these hadn’t been included in the reports pack. Cllr Jeff Green asked if these had been published on the intranet, an officer answered that they had. Cllr Jeff Green then asked when they had been published. The officer said they hadn’t had a meeting since the 14th February, there was due to be one [on the 11th March] but it had been cancelled. The Chair asked if there were any matters arising, nobody raised any so the minutes were agreed.

Cllr Green asked if the dates of the meeting were correct, the Chair said they were right in his diary. Tony Williams (Human Resources Manager) pointed out a correction to be made to the minutes. The Chair asked if they were happy for him to sign the minutes?

The Chair said that agenda item 11 on Monitoring Compromise Agreements had been dealt with in the open part of the meeting last time and he proposed the same at this meeting.

Cllr Green said they were simply appendices and he couldn’t spot anything specific.

Chris Hyams said that referring to item ten, she was recommending it stays exempt. Cllr Jeff Green said that it didn’t identify people, but Chris Hyams disagreed and said individuals could be identified. Cllr Green asked how anyone would do that as he could see no reason at all for it to exempt as individuals would be really difficult to identify. Chris Hyams said that the report had been consistently exempt and individuals could be identified. The Chair said for consistency they would continue with item 10 being exempt. Cllr Green asked how you could see who the individuals are?

Cllr Chris Jones said that people know who’s on the redeployment register so they would be able to identify them. Surjit Tour said that the test was if through reasonable inquiry they could work out who the individuals were or could enable their identity to be revealed.

Chris Hyams said that when the numbers were lower it was easier to identify individuals.

The Chair moved the meeting on to item 3 (Managing Attendance).

Council Excellence Overview and Scrutiny Committee (Special) 22nd January 2013 Four yearly elections, Destination Marketing, Pest Control, redundancies and procurement


The Council Excellence Overview and Scrutiny Committee was a special meeting with only one main agenda item which was to discuss the 2013/16 Budget proposals which are currently part of a consultation with the public (until 31st January 2013).

The Chair, Cllr John Hale said that in his view the Committee was without a lot of the information he would’ve liked on the Budget options, and that he was “not in agreement with the move to four yearly elections”. He also disagreed with the saving on Destination Marketing as this money “brought an awful lot of visitors to the Wirral” and had spin offs for businesses on the Wirral.

Cllr Phil Gilchrist (Lib Dem spokesperson) arrived and apologised for being late. The Chair asked Cllr Stuart Wittingham if he had any comments to make?

Cllr Wittingham said he was pleased that most of the savings were to the back office and that he wasn’t saying that the front line wouldn’t be affected. He had no comments to make on a four yearly election cycle but described it as a “substantial saving”.

The Chair said it was not a very substantial saving “at the cost of democracy” and that there was still “insufficient information”. He’d be moving to note matters with the exception of the four yearly elections that he was opposed to and the 100% cut to Destination Marketing, which he said supported major activities and brought in thousands of visitors to the Borough.

Cllr Hale had asked what the Pest Control reduction meant and that the answer given was that it would result in their staff being reduced from five to four. He said it also meant that the home insulation program which had only met 59% of its target wouldn’t be able to continue with the rest. However £50,000 would be kept in the Budget for fuel poverty.

Cllr Gilchrist said that previously when the Council had let people retire or take voluntary redundancy, there had been criteria that had had to be looked at such as the need to pass on their expertise or whether it would cause a problem for the service if they left, he asked if officers had discussed the rationale for restructuring?

The Chair asked Chris Hyams to answer the question.

She said the proposals were either for a restructure or service changes. In the case of a restructure, Chris Hyams said that they would seek volunteers first, but may need to move to compulsory redundancies. In order to maximise redeployment opportunities they would look for volunteers across the organisation. They couldn’t let people go where their jobs were required, but would be looking at things on a proposal by proposal basis.

Cllr Gilchrist made a further comment about redundancies.

Chris Hyams responded said the strategy had been to seek voluntary leavers, but ensuring they had the capacity in the services to let them go “at the appropriate time”. She gave the example of letting volunteers go in day services and redeploying people from residential to day services. However the voluntary leavers couldn’t leave until the redeployed workers were ready to move into their posts. She said they wanted to do it quick enough that they were not incurring the need for more savings, but at a time that was right taking into account their notice periods and with due consultation and process.

The Chair asked about suppliers.

The Wirral Council officer responded by saying, “Yeah Chair, thanks Chair, one of the one of the issues that had been identified through the work that the Local Government Association are doing with us with on the Improvement Plan is a weakness in procurement, how the Council procures its related goods and services. There are a number of processes that we can improve upon, one of the issues is that we have a purchase order system, but the majority of purchases don’t go through that purchase order system. So we believe that by improving the governance of that system to actually make it so that 90% goes through that purchase order system, we’ll be able to negotiate with suppliers and get a better deal. Hopefully the volume issue, we will get a better deal.

We’re also looking at how we actually manage our procurement function. One of the things that we’re doing is basically is to have overall category managers, which have an area of spend rather than the generic purchasing officers. A category manager would have an area of spend for instance Adult Social Services and become knowledgeable in that field and achieve savings with suppliers. We feel that the evidence from other councils is that we’re not getting value for money now just now and that the savings are achievable if we can actually both improve our processes and improve maybe we carry out procurement with these category managers.

It’s a process that’s used in the private sector and maybe we’ll use it in the public sector. We’re looking at best practice elsewhere, we’re getting advice both from other Councils and from the Local Government Association, now we actually need a step change in getting more out of our procurement activity because clearly with the financial challenges that the Council’s facing we’ve got to get more for less in effect and we believe that we can actually achieve the savings in procurement.”

Employment and Appointments Committee (Wirral Council) 15th November 2012: Compromise Contracts and Grievance Policy Changes


Last Thursday’s Employment and Appointments Committee had the usual regular report on attendance. However it was the new Employee Relations Performance Report that received some press coverage in the Wirral News about the large percentage of employees that have had dealings with Human Resources in the Department of Adult Social Services (which according to the quote in the article from the Director mainly involve “absence management”). An extension to the current Occupational Health contract with Capita Health and Well being was also agreed.

Changes to the Grievance Policy were also agreed with the aims of the changes to speed up the process and give more of a role to line managers.

Outside of the more high-profile compromise contracts reported in the media, compromise contracts totalling nearly £100,000 covering three employees had been agreed by officers.

The Chair, Labour Cllr Paul Doughty asked Tony Williams, Acting Employee Relations Manager to introduce the report.  Tony Williams said it was a regular report to update the Committee on attendance and referred to figures in the report.

Cllr Harry Smith (Cabinet Member for Streetscene and Transport) and Cllr Chris Meaden (Cabinet Member for Culture, Tourism and Leisure) arrive.

Tony Williams said the report showed that health issues were the highest cause of absence, which they were doing work to address, with an example being given of stress awareness. He also referred to the absence rate at the Department for Adult Social Services. He asked if there were any questions?

Cllr Paul Doughty said the report was for noting, so it was noted.

4. Update on Managing Workforce Change and Redeployment 03:20

The Chair, Labour Cllr Paul Doughty asked Tony Williams, Acting Employee Relations Manager to introduce this report.

Tony Williams said there were now fourteen employees on the register, he said at the last meeting there had been six, but five of these had been resolved. He said three on the register had complex circumstances, with two of these being due to disability, he referred to exempt appendix 12.

The Chair, Labour Cllr Paul Doughty referred to exempt appendix 12. He asked if anyone had any questions?

Cllr Mark Johnston, Liberal Democrat spokesperson asked about the reason behind the increase in employees on the register from the Department of Law, HR and Asset Management?
Tony Williams answered Cllr Johnston’s question by saying it related to a graduate trainees program. Cllr Mark Johnston asked a further question to Tony Williams. Tony Williams replied.

Cllr Leslie Rennie, Conservative asked about a point she had raised at the briefing. She wondered if the senior management restructure would lead to people’s jobs being subject to risk. She asked if in future members of the Committee, Leaders and Deputy Leaders could receive updates more regularly, such as fortnightly?

Chris Hyams answered.

The Chair, Cllr Ann McLachlan asked if the minutes were agreed?

Cllr Leslie Rennie disputed the minutes and stated they were missing that she had said at the last meeting that she wanted it minuted that she wanted Richard Penn to be invited to the meeting.

The Chair, Cllr Ann McLachlan said it was fine as Mr. Penn was “in the building” [see above photo of Richard Penn waiting in lobby, Ground Floor, during agenda item 4 (not the room the meeting was being held in)]. She thanked Cllr Leslie Rennie for pointing this out. There were no more comments on the minutes of the meeting held on the 20th August 2012, so the Chair moved the meeting onto agenda item 3.

3. Exclusion of the Press and Public

The Chair expressed her opinion that the press and public should be excluded from the meeting for agenda item 4. She expected the two members of the public to leave, however a member of the public waited for the Committee to agree with this opinion. The reason she gave was that it related to “staff”.

The Committee received the reports from Chris Hyams (Proper Officer), Tony Williams (Acting Employee Relations Manager) and Richard Penn (Independent Investigator).

Instead of Chris Hyams, Interim Chief Executive Graham Burgess spoke about the Improvement Plan, a “coordinated management approach”, a meeting on Thursday morning to significantly reduce tiers, a future Cabinet report in a “month or two” and a future Council meeting. He said the Strategic Directors would be at Deputy Chief Executive level and changes to the pay policy would have to be agreed by Council, he also talked about the acting appointments, suspensions and how they needed to extend and confirm a number of people in various posts. The Interim Chief Executive referred to Surjit Tour, Peter Timmins, Tom Sault, David Armstrong, Julia Hassall and Chris McCarthy.

Cllr Jeff Green (Conservative, spokesperson) asked a question, which was answered by Chris Hyams. She said they had had further representations and following advice, in September they would be setting up a subcommittee for the recruitment process. She referred to the outcome of the Chief Officers’ suspensions and an amended resolution, a consultation with Chief Officers and how it would be inappropriate to make permanent appointments.

Cllr Phil Davies (Labour, Chair) welcomed people to the meeting. He asked councillors if they had any declarations of interest to make? None were given. He moved the meeting onto agenda item 2 (Senior Management Restructure) and indicated to the Interim Chief Executive Graham Burgess to speak about this item.

Graham Burgess referred to the Improvement Board, the Improvement Plan, the support of all three party leaders and proposals to address concerns. He said it was the first stage of a wider management reshaping. Mr. Burgess said the proposals would create three posts, which were key roles.

Cllr Anne McArdle (Labour, Adult Social Care and Health) arrived at 5.06pm.

The Interim Chief Executive continued to talk about “key corporate priorities”, his desire to “break down silos” and “challenge across departments”. He said that 5.4 [of the report] gave more detail and said it was his intention to make a further report. He referred to a Director’s meeting on Thursday and that there would be numbers of posts they would be losing and it was likely to look at and need to ask senior officers to leave.

Cllr Ann McLachlan (Labour, Improvement and Governance) spoke. Cllr Phil Davies (Labour, Finance and Best Value) said he wanted to address the corporate governance issues. He said he would support the recommendations and referred to the Employment and Appointments Committee later. Cllr Davies (Labour, Finance and Best Value)  referred to “radical changes”. He announced there was no “Any Other Business” and the meeting closed at 5.17pm.

Agenda Item 1 – Appointment of Chair

Cllr Brian Kenny and Cllr Adrian Jones proposed Cllr Ann McLachlan as Chair.
There were no other nominations so Cllr McLachlan was made Chair.

Cllr Dave Mitchell proposed Cllr Adrian Jones as Vice-Chair, however it wasn’t seconded. There was a second valid nomination as Vice-Chair so Cllr Brian Kenny was made Vice-Chair.

Agenda Item 3 – Exempt Information – Exclusion of the Press and Public

The Chair suggested that the public and press were excluded from the rest of the meeting for agenda item 4 (Update in Relation to the Suspension of Council Officers) (reason given – Information relating to any individual and agenda item 5 (Any Other Urgent Business Approved by the Chair) (although there was no AOB).

Agenda Item 4 – Update in Relation to the Suspension of Council Officers

The Investigation and Disciplinary Committee received an update in a 16-page preliminary investigation report about the matters that led to the suspensions of Bill Norman, Ian Coleman and David Taylor-Smith (but also relate in part to the earlier suspension of David Green).

It related in part to:-

1) This public interest report published by the Audit Commission on 8th June 2012 entitled Highways and engineering services contract award and management.

2) The Council’s policies on senior officers declaring interests and whether these had been followed.

3) Various other matters relating to the above four suspended individuals.

The following resolution was then agreed,

“(1) the progress being made in respect of the preliminary investigation be noted; and

(2) the way forward in relation to the three Statutory Officers, as outlined in paragraph 5.6 of the report, be agreed.”

Chris Hyams continued that they had liaised with their partner agencies and there would be disruption to travel. The Mersey Ferries would close, so would the Mersey Tunnels. However Wirral Council did have a letter that allowed them to bring critical employees only through the Mersey Tunnel, but they would have to keep such travel to a minimum.

She said the buildings plan would be published next week, some employees would have to report to alternative buildings as their usual building would be closed. Only those who signed in would get paid and any absences would be addressed. Guidance had been issued. Sickness on the strike day or during the strike week would have to be confirmed with a GP’s note.

She continued by saying that pay for strikes would be deducted at 1/5th of a week’s pay, with pension contributions altered. This would affect pay paid in the January cycle. There would also be pickets of council buildings, rallies and marches. There would be a rally at Birkenhead Park and Liverpool City Centre.

Chris Hyams said that the Chief Executive had issued a communication to all authority employees with frequently asked questions for employees. There would be communication with the public and press releases on the day before the strike.

Cllr Steve Foulkes said it would be remiss not to have an update. Despite the disruption, he had “massive sympathy” for the people going on strike. At his own workplace they had balloted for strike action as a last resort to get their point heard. He understood it was the law that people had the right not to take part in strike action. It was right to get an update and he said that we “are taking it seriously”.
