What was in the 11 A4 page witness statement of Surjit Tour (Wirral Council) about a Freedom of Information request for the minutes of a meeting of the Headteachers’ and Teachers’ Joint Consultative Committee (EA/2016/0033)?

At the outset I will make four declarations of interests.

1) I am the Appellant in this case (EA/2016/0033).
2) My wife was my McKenzie Friend in case EA/2016/0033.
3) I made the original Freedom of Information request on the 29th March 2013.
4) I am referred to by name (Mr. Brace) in paragraphs 1, 5, 6, 8, 9, 11, 13, 14 and 15 of the witness statement of Surjit Tour.
5) My profession ("local press") is referred to in paragraph 27.

This continues from two earlier blog posts headlined What were the 6 A4 pages of partially redacted minutes of a Headteachers’/Teachers’ Joint Consultative Committee meeting and the name of a LGA Associate Tutor that Wirral Council disclosed voluntarily in response to a First Tier-Tribunal (General Regulatory chamber) hearing (case number EA/2016/0033) about a Freedom of Information request first made in March 2013? and What was in the 5 A4 page witness statement of Andrew Roberts (Wirral Council) about a Freedom of Information request for the minutes of a meeting of the Headteachers’ and Teachers’ Joint Consultative Committee (EA/2016/0033)?.

Line breaks are indicated by a double horizontal line break. A picture of Surjit Tour at a public meeting of Wirral Council’s Coordinating Committee from the 15th June 2016 is below so people reading know who I’m referring to. I have included his signature, typed name and handwritten date at the end of the witness statement as an image.

What was in the "strictly confidential" report on Merseyside Recycling and Waste Authority that cost over £14,000?

What was in the “strictly confidential” report on Merseyside Recycling and Waste Authority that cost over £14000?

What was in the “strictly confidential” report on Merseyside Recycling and Waste Authority that cost over £14,000?

Last year Merseyside Waste and Recycling Authority paid Paver Smith (a PR agency which has since changed its name to Influential) £11,700 + VAT for 18 days work (at a rate of £650 + VAT) for an internal and external communications review. You can see the invoice for that work below.

The internal communication review involved ‘discovery’ sessions with MRWA staff, an online questionnaire and focus groups. Below is the internal communications bit of the report (with my comments under each page).

This is just the cover page for the report.

This report is “strictly confidential”. Why do I know this? Why I know because this page tells me so in red letters.

This is a contents page.

Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 4
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 4

A whole page on “introductory remarks” that contains a lot of phrases such as:

“employees and management must communicate in order for an organisation to function effectively”,
“there is real value in staff being clear on and understanding the forward mission and objectives of MWRA” and “Staff also carry an organisation’s brand out to the market, with clients, stakeholders and the public. Having them “on message” and carrying a unified and coordinated message can have great benefits”.

Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 5
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 5

This page deals with “Objectives and methodology” including this section on confidentiality:

  • It is crucial to the process on an internal communications review that all feedback is supplied in strictest confidence and handled with great care.
  • For the results to be helpful for an organisation feedback needs to be given openly and without concern.
  • Therefore all focus group interviews were undertaken in the strictest confidence under Chatham House rules with no attributing of specific statements to individuals.
  • The internal survey was structured also in a way to preserve anonymity.
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 6
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 6

This next page goes into detail about the three focus groups (Executive Management Team, Senior Management Team and Authority officers).

One of the more interesting comments on this page is “A common theme raised by all was the concern that MRWA had a “silo” culture where individual teams largely operated independently from each other and as a result there was little cross fertilisation or understanding what each team was working on/ looking to achieve.”

A comment like that probably makes you think that Merseyside Recycling and Waste Authority is a large organisation with lots of staff, however the staff structure on their website shows they have only about three dozen staff.

Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 7
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 7

This page has the rather telling comment at the top (EMT stands for Executive Management Team) “There was a staff perception that the EMT didn’t wish to engage in two way communication and discussion.” followed by “All expressed a concern that the intranet was used passively to disseminate information that staff were then assumed to seek out, but that active use of the intranet was however very low.”

Then it moves on to themes from the Executive Management Team focus group. Here are some quotes from that focus group:

“Concern was express that some of the staff had unrealistic expectations as to what they should be communicated to about.”

and

“The intranet was raised as a tool that wasn’t effective and not proactively used to access information.”

The senior management focus group also commented on the intranet and the silo culture.

“It was felt by some that too much reliance was placed on people proactively seeking out information on the intranet and that generally people didn’t do this. “

“A major concern for this group was what was described as a “silo” culture in MRWA with individual teams and functions working in isolation from each other and not enough interaction nor understanding of each other’s objectives, activity, challenges and successes. “

Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 8
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 8

The staff focus group found internal communications was “poor”, apart from HR related matters. This focus group also felt “that generally the quality of management communication was poor and that there was a lack of interest (from the organisation) in seeking and listening to staff’s views and ideas.”.

Also commented on by the staff focus group was that this had led to a “‘what’s the point’ culture with some staff and a sense of negativity and scepticism”. The staff group expressed a “strong desire that the outcomes from the internal communications review should be shared”.

Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 9
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 9

This page deals with the results of the questionnaire, there’s a pretty even split between people who think internal communications are poor and those that think it is satisfactory.

Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 10
Paver Smith report on internal communications to Merseyside Recycling and Waste Authority page 10

This is another page going into the results of the survey and has the line “Good internal communications are seen generally by staff as of crucial importance to their sense of satisfaction and general wellbeing an an employee.”

This page details the results to the question “How important do you think internal communication is?”.

Continuing from Wednesday’s blog post headlined Wirral Council planning on green belt fire station “inappropriate development” & “potential for significant harm”, I thought people might be interested in more of the emails that went between Wirral Council and the Merseyside Fire and Rescue Service about the plans for a fire station in Wirral West as it seems that detailed discussions were going on behind the scenes both at officer level at Wirral Council & Merseyside Fire and Rescue Service, as well as discussions with councillors too.

David – the land on the opposite site of Frankby road to St John the Divine is in the Green Belt so a fire station would be inappropriate development and very special circumstances would have to be demonstrated. However there is potential for significant harm to the Green Belt in this location because of its role in maintaining separation between Greasby and Frankby.

Hi David

Following on from when we spoke last week, I recall you were going to get someone to look at the land at Upton By-pass/Saughall Massie Road to see if there was any potential for us to consider it as a site for the new merged Upton/West Kirby fire station. I think you also suggested that you’d get someone to produce a plan showing any ‘spare land’ in the Greasby area (back to the By-pass) so we can continue to seek out a potential site for the new station.

I was just wondering if you had any news on either of these please?

Colin

Colin,

Confidential

Further to our recent conversation and the e-mail exchange last week, please find attached and below some thoughts from my Planning Policy Team about potential sites. Unfortunately, as you will read, there are a number of constraints to these sites but we are having difficulty identifying suitable sites in the Greasby area.

Happy to discuss!

Subject: Potential Fire Station Sites

David,

Further to your discussion with Andrew on Friday, please find attached site plans of two potential sites for the relocation of Upton Fire Station. We examined the whole area and these are the only sites that we consider have potential, in addition to the site already being considered. It should be noted, however, that these are still subject to significant constraints. The land at the corner of Saughall Massie Road is a Council-owned densely wooded site with access constraints. It is likely that there would be significant highways issues at the junction with Upton By-Pass. The land to the north of Upton Cricket Club is also subject to access constraints and is currently used for horse grazing. It has been submitted through the Call for Sites exercise for consideration for housing. Both sites are also less than 1 mile away from the existing station in Upton.

In terms of Green Belt sites, this type of development would be considered inappropriate and very special circumstances would need to be demonstrated to justify development. The capacity to accommodate fire engines on Frankby Road and the western part of Saughall Massie Road may also act as a constraint to development in Greasby/Saughall Massie.

I hope this helps. If you need anything else please let me know.

David.

Just to say that the site at the corner of Saughall Massie Road is a designated Urban Greenspace but although highly visible it does not really function as an accessible public open space and Overchurch Park is within 400m to the north, albeit on the other side of the bypass. The visual landscaping impact alongside the bypass could however be retained without retaining the whole of the rest of the site (although this is still likely to be controversial!). The highways issues are however likely to be overriding.

b) Quite often appliances respond when they are off site doing home fire safety checks etc

Subject: Potential fire station sites in Wirral

Kieran,

Joe Blott, one of our Strategic Directors has asked me to contact you following the recent meeting that Dan Stevens had with the leader of the Council. I understand that one of the discussion points was the various sites that we have been discussing over the past few months for a potential new fire station.

I understand that there may be a need to consolidate all the correspondence and to come to a view if any of these sites are possible locations and if there is a preferred site fro the Council to let you know whether it is available (if we own it) and what the planning considerations may be. I know that we (Asset Management and me from a planning perspective) have discussed a number of sites but would it be useful to meet to come to a considered position on this matter?

Please can you let me know what would be best?

Thanks,

David

Hi David

That’s very timely as I was just discussing with Colin holding a meeting to review the site options and it would make a lot of sense to do that jointly with your input. I’ll get a meeting set up with Colin Schofield, myself and (is it just) you from the Wirral side?

Under separate cover I’ll send a copy of a short note I did for Dan trying to summarise where we are up to which might be useful for all

Best wishes

Thanks,

David

Attachments: summary of greasby sites update june 25.xlsx

Hi David,
Further to previous email see notes below and attachment which were provided for Chief Exec’s meeting

a) Sites discounted early
Two sites were considered at an early stage and discounted. One was a junior school on Mill Lane – there were concerns about access and no indications that school was willing to give up land. The second was a farm site on Arrowe road – No indications if land was for sale

b) Sites considered in more detail
Since then 6 sites have been considered in more detail. They have been identified by a mix of estates team detective work, suggestions by colleagues and suggestions by Wirral officers. The sites are analysed in more detail in the attached appendix. As it stands there are two “runners” left:-

  • Saughall Massie Road/Upton By Pass. This is owned by Wirral and looks quite positive based on recent correspondence despite being urban greenspace. It may be a little father from Greasby than planned but access good
  • The Library/Community hall site in middle of Greasby. However this site not suitable for ambulance services and we would have to deal with multiple partners. Locality is a political hot potato with large public outcry about supermarket development.

c) Latest Developments

Estates team have been liaising with various professional advisers to see if they had any information. We have heard rumours of one potential larger development being put together near Greasby. We are awaiting more details and location

Have also formally instructed Hardie Brack to look for sites and their report is awaited. We believe they may have identified three or four potential plots which we understand all to be farmland that might be for sale.

Andrew,

We are, in conjunction with Wirral, exploring the possibility of a joint development on the site of the existing Library and Community Centre situated in between the Red Cat and Medical Centre on Frankby Road.

This would be an ideal location from an operational response perspective. The joint development may consist of a fire station, library and community facilities in an integrated building. It is possible North West Ambulance Service may also be interested in the development but that is by no means certain and would be subject to confirmation.

This proposal is at a relatively early stage and not all potential partners have yet been approached. Whilst I have a degree of confidence that such a development is deliverable I would ask that any response to constituents over this issue is heavily caveated to that effect.

My suggestion would be to respond along the lines of ‘Considerations are now focused on a site in the centre of Greasby in Wirral ownership. Whilst discussions are at a very early stage, the debate has been around delivering a shared public services facility that would add significant value to the community’.

Subject: FW: Update on station proposals for Upton and West Kirby

Dear Dan

Please could I ask for a quick update on decisions over stations in Wirral West following contact from constituents. Specifically

  • Have MFS identified land as yet in Greasby? – Not as yet. We are exploring the possibility of acquiring a site on the Greasby Frankby border and also a site at the junction of the Upton Bypass and Saughall Massie Road. As you are probably aware there are very few available plots of land in the area which would be appropriate for a fire (and possibly ambulance) station
  • If so when will any consultation process commence? – If we are able to acquire a site we will report this to the next scheduled Authority meeting and request approval to undertake a 12 week public consultation process immediately thereafter. I can send you the process we are utilising for the proposed merger in Knowsley (Huyton with Whiston) which was approved at the Authority meeting on 6th May if that would assist?
  • If not, what would the likely timescale be to implement alternative proposals and when would any consultation start? – If it becomes obvious that we will not be able to acquire a suitable site for a merger then we will report back to the Authority and advise them of the alternative options to a merger which on the Wirral would be the outright closure of West Kirby. Subject to Authority approval we would then undertake a 12 week consultation process immediately thereafter. Clearly this is the very last outcome we would want so we will explore every land option possible even if that requires consideration of alternative sites (hence the Upton Bypass and Saughall Massie Road reference above)
Many thanks in advance for an update on this matter.

With my best wishes

Not sure if you got the message earlier – Tried to catch you on the phone before you went to council meeting.

Dan met Greasby councillors today – Wendy Clements and Tom Anderson (I think). This as at request of Lesley rennie. They do not appear to like the idea of a fire station in Greasby and their initial thought is to oppose the plan based on the conversation today. Dan explained that the alternative option was the closure of West Kirby outright which was also not platable and may cause them to reconsider. However it appeared that their initial view is to oppose.

The alternative to a merger of West Kirby and Upton fire stations in an outright closure of West Kirby which we would move to public consultation on imminently. I was in meetings yesterday afternoon so only picked up the e-mail last night. Thanks for the update. I shall wait and see if Lesley can change their minds about this location or not. In the meantime I will not look at this any further until I have some view from the Councillors. I hope there is a positive outcome.

I have copied David Armstrong into this e-mail so he is aware of the latest situation.

Regards,

David

Thanks Kieran,

David – to confirm Tom and Wendy were very clear that they would oppose the proposal. I will however speak to Lesley Rennie to establish how likely they would be to change their position given the alternative.

HI David

Not sure if you got the message earlier – Tried to catch you on the phone before you went to council meeting.

Dan met Greasby councillors today – Wendy Clements and Tom Anderson (I think). This as at request of Lesley rennie. They do not appear to like the idea of a fire station in Greasby and their initial thought is to oppose the plan based on the conversation today. Dan explained that the alternative option was the closure of West Kirby outright which was also not platable and may cause them to reconsider. However it appeared that their initial view is to oppose.

Can you give me a buzz on 07855 207571 if you want to discuss

2009 Public Inquiry into Wirral Council’s library closures including Bill Norman’s email and Sue Charteris letter

Reading through the Wirral Council’s response to critical reports 2010-2013 there is one report not included because it was published about a month before the cutoff date of 2010, it’s the report written by Sue Charteris following the public inquiry ordered by the Secretary of State into Wirral’s library closure program held at the Floral Pavilion which describes Wirral’s failure in these terms “The Public Inquiry into Wirral Metropolitan Borough Council’s (MBC) Library Service has found the Council’s decision to restructure its Library Service to be in breach of its statutory duties under the Public Libraries and Museums Act 1964, to provide ‘comprehensive and efficient public Library Services for all persons desirous to make use thereof'”

The text of Bill Norman’s email to councillors who received a copy of the draft report, before the final report was published is below along with a link to the letter from Sue Charteris (marked private and confidential).

Subject: Extraordinary Council – 12 October 2009

Dear Councillor

Following last night’s Extraordinary Council meeting, please find attached a copy of the letter dated 27 July 2009 from Sue Charteris to me. The letter enclosed two copies of the draft Report prepared by Ms Charteris following the two day Wirral Libraries Public Inquiry.

The 27 July letter makes it clear that the draft Report was provided to me on the basis of a specific obligation of confidentiality. Because Sue Charteris was appointed by the Secretary of State to conduct the Libraries Inquiry, her requirements as to confidentiality are the requirements of the Secretary of State and are legally enforceable. This has the effect of making the draft Report ‘confidential information’ for the purposes of Part 5A of the Local Government Act 1972.

Confidential information is different to ‘exempt information’. With exempt information, Members may resolve to exclude the press and public from meetings; but it is a matter for their discretion. (In addition, Part 5A of the 1972 Act provides for all Members generally to have an entitlement to receive exempt reports.) Confidential information is different: the Council must comply with the terms upon which the information is provided. Section 100A(2) of the 1972 Act expressly makes clear that nothing in Part 5A authorises or requires the disclosure of confidential information in breach of the obligation of confidentiality.

In line with the terms of the obligation of confidentiality in the 27 July letter, I have only circulated the draft Report to those Members within the Cabinet and those officers from whom I needed comments prior to responding to Sue Charteris. That response by me to Sue Charteris is also covered by the same obligation of confidentiality. The obligation of confidentiality remains in place and no Member or officer should publicly discuss the contents of the draft Report prior to the Secretary of State’s decision being published.

As was pointed out last night, the 27 July letter does not list the names of who may see the draft report. As the recipient of the letter, that judgement fell to me and I accept personal responsibility for my decision in that regard (this was not a matter on which I took any external legal advice). However, I wish to emphasise that my decision was absolutely not intended to be a reflection as to any individual Member’s ability to respect confidences.

I was asked last night to list those persons to whom I have shown a copy of the draft Report. Although I do not believe that there is any legal obligation on me to disclose this information, equally I understand the exceptional level of interest in this matter. I have therefore decided to provide that information.

In order to enable me to respond to Sue Charteris on the contents of her draft report (which was a combination of factual corrections, clarifications and legal arguments) copies of the draft report were provided to the following persons:

Steve Maddox, Chief Executive
Jim Wilkie, Deputy Chief Executive
Alan Stennard, Director of Regeneration
Ian Coleman, Director of Finance
Howard Cooper, Director of Children and Young People
Jim Lester, Head of Cultural Services
Emma Degg, Head of Tourism and Marketing
Rosemary Lyon, Interim Head of Legal and Member Services
Councillor Steve Foulkes, Leader of the Council
Councillor Simon Holbrook, Deputy Leader of the Council
Councillor Phil Davies
Councillor Gill Gardiner
Councillor Bob Moon

Under the Public Libraries (Inquiry Procedure) Rules 1992, the Final report by Sue Charteris will either be published with the Secretary of State’s Decision letter, or will be available on request by any person who appeared at the Inquiry and asked to be notified of the Decision (which I believe will include a number of Councillors who spoke at the Inquiry). Given that the Final report will become public knowledge, in my view there cannot be any ‘public interest’ justification for disclosing the contents of the Report prior to the Secretary of State’s Decision. In the light of this, any Councillor who breaches the obligation of confidentiality would also be likely to be in breach of the Members’ Code of Conduct.

If any Member wishes to have more information of the legal framework for my decision, or on the Public Libraries (Inquiry Procedure) Rules, please let me know.

I have no objection to this email being shared with the press or public. However, the attached letter was written by Sue Charteris and I ask that you seek her permission before disclosing it to anyone else.

Regards

Bill
