Continuing from Wednesday’s blog post headlined Wirral Council planning on green belt fire station “inappropriate development” & “potential for significant harm”, I thought people might be interested in more of the emails that went between Wirral Council and the Merseyside Fire and Rescue Service about the plans for a fire station in Wirral West as it seems that detailed discussions were going on behind the scenes both at officer level at Wirral Council & Merseyside Fire and Rescue Service, as well as discussions with councillors too.

David – the land on the opposite site of Frankby road to St John the Divine is in the Green Belt so a fire station would be inappropriate development and very special circumstances would have to be demonstrated. However there is potential for significant harm to the Green Belt in this location because of its role in maintaining separation between Greasby and Frankby.

Following on from when we spoke last week, I recall you were going to get someone to look at the land at Upton By-pass/Saughall Massie Road to see if there was any potential for us to consider it as a site for the new merged Upton/West Kirby fire station. I think you also suggested that you’d get someone to produce a plan showing any ‘spare land’ in the Greasby area (back to the By-pass) so we can continue to seek out a potential site for the new station.

Further to your discussion with Andrew on Friday, please find attached site plans of two potential sites for the relocation of Upton Fire Station. We examined the whole area and these are the only sites that we consider have potential, in addition to the site already being considered. It should be noted, however, that these are still subject to significant constraints. The land at the corner of Saughall Massie Road is a Council-owned densely wooded site with access constraints. It is likely that there would be significant highways issues at the junction with Upton By-Pass. The land to the north of Upton Cricket Club is also subject to access constraints and is currently used for horse grazing. It has been submitted through the Call for Sites exercise for consideration for housing. Both sites are also less than 1 mile away from the existing station in Upton.

In terms of Green Belt sites, this type of development would be considered inappropriate and very special circumstances would need to be demonstrated to justify development. The capacity to accommodate fire engines on Frankby Road and the western part of Saughall Massie Road may also act as a constraint to development in Greasby/Saughall Massie.

Just to say that the site at the corner of Saughall Massie Road is a designated Urban Greenspace but although highly visible it does not really function as an accessible public open space and Overchurch Park is within 400m to the north, albeit on the other side of the bypass. The visual landscaping impact alongside the bypass could however be retained without retaining the whole of the rest of the site (although this is still likely to be controversial!). The highways issues are however likely to be overriding.

Subject: Potential Fire Station Sites

David,

Further to your discussion with Andrew on Friday, please find attached site plans of two potential sites for the relocation of Upton Fire Station. We examined the whole area and these are the only sites that we consider have potential, in addition to the site already being considered. It should be noted, however, that these are still subject to significant constraints. The land at the corner of Saughall Massie Road is a Council-owned densely wooded site with access constraints. It is likely that there would be significant highways issues at the junction with Upton By-Pass. The land to the north of Upton Cricket Club is also subject to access constraints and is currently used for horse grazing. It has been submitted through the Call for Sites exercise for consideration for housing. Both sites are also less than 1 mile away from the existing station in Upton.

In terms of Green Belt sites, this type of development would be considered inappropriate and very special circumstances would need to be demonstrated to justify development. The capacity to accommodate fire engines on Frankby Road and the western part of Saughall Massie Road may also act as a constraint to development in Greasby/Saughall Massie.

Would be grateful if colleagues able to give any more details on concerns on the highway’s issues. We tend to find that

a) Fire stations are a lot quieter than people imagine and rarely respond under blue lights
b) Quite often appliances respond when they are off site doing home fire safety checks etc

Just to say that the site at the corner of Saughall Massie Road is a designated Urban Greenspace but although highly visible it does not really function as an accessible public open space and Overchurch Park is within 400m to the north, albeit on the other side of the bypass. The visual landscaping impact alongside the bypass could however be retained without retaining the whole of the rest of the site (although this is still likely to be controversial!). The highways issues are however likely to be overriding.

Further to previous email see notes below and attachment which were provided for Chief Exec’s meeting

a) Sites discounted early
Two sites were considered at an early stage and discounted. One was a junior school on Mill Lane – there were concerns about access and no indications that school was willing to give up land. The second was a farm site on Arrowe road – No indications if land was for sale

b) Sites considered in more detail
Since then 6 sites have been considered in more detail. They have been identified by a mix of estates team detective work, suggestions by colleagues and suggestions by Wirral officers. The sites are analysed in more detail in the attached appendix. As it stands there are two “runners” left:-

  • Saughall Massie Road/Upton By Pass. This is owned by Wirral and looks quite positive based on recent correspondence despite being urban greenspace. It may be a little father from Greasby than planned but access good
  • The Library/Community hall site in middle of Greasby. However this site not suitable for ambulance services and we would have to deal with multiple partners. Locality is a political hot potato with large public outcry about supermarket development.

c) Latest Developments

Estates team have been liaising with various professional advisers to see if they had any information. We have heard rumours of one potential larger development being put together near Greasby. We are awaiting more details and location

Have also formally instructed Hardie Brack to look for sites and their report is awaited. We believe they may have identified three or four potential plots which we understand all to be farmland that might be for sale.

I have had the opportunity to speak with colleagues at officer level regarding the thoughts for the centre of Greasby and they are all supportive of the principle. We are, in conjunction with Wirral, exploring the possibility of a joint development on the site of the existing Library and Community Centre situated in between the Red Cat and Medical Centre on Frankby Road.

This would be an ideal location from an operational response perspective. The joint development may consist of a fire station, library and community facilities in an integrated building. It is possible North West Ambulance Service may also be interested in the development but that is by no means certain and would be subject to confirmation.

This proposal is at a relatively early stage and not all potential partners have yet been approached. Whilst I have a degree of confidence that such a development is deliverable I would ask that any response to constituents over this issue is heavily caveated to that effect.

My suggestion would be to respond along the lines of ‘Considerations are now focused on a site in the centre of Greasby in Wirral ownership. Whilst discussions are at a very early stage, the debate has been around delivering a shared public services facility that would add significant value to the community’.

Please could I ask for a quick update on decisions over stations in Wirral West following contact from constituents. Specifically

  • Have MFS identified land as yet in Greasby? – Not as yet. We are exploring the possibility of acquiring a site on the Greasby Frankby border and also a site at the junction of the Upton Bypass and Saughall Massie Road. As you are probably aware there are very few available plots of land in the area which would be appropriate for a fire (and possibly ambulance) station
  • If so when will any consultation process commence? – If we are able to acquire a site we will report this to the next scheduled Authority meeting and request approval to undertake a 12 week public consultation process immediately thereafter. I can send you the process we are utilising for the proposed merger in Knowsley (Huyton with Whiston) which was approved at the Authority meeting on 6th May if that would assist?
  • If not, what would the likely timescale be to implement alternative proposals and when would any consultation start? – If it becomes obvious that we will not be able to acquire a suitable site for a merger then we will report back to the Authority and advise them of the alternative options to a merger which on the Wirral would be the outright closure of West Kirby. Subject to Authority approval we would then undertake a 12 week consultation process immediately thereafter. Clearly this is the very last outcome we would want so we will explore every land option possible even if that requires consideration of alternative sites (hence the Upton Bypass and Saughall Massie Road reference above)

Dan explained that the alternative option was the closure of West Kirby outright which was also not platable and may cause them to reconsider. However it appeared that their initial view is to oppose.

I think we would like to initiate discussions with the community hall in any case. The issue we have is that as firefighters retire we can’t staff all the appliances and with two years to deliver a new station its important we don’t lose any time.

Unless that causes any major problems would you be agreeable to proceed. If nothing else at least we can work up properly what is proposed as a joint service hub that may help win hearts and minds!

One of the long running sagas that this blog has reported on has been the future of Upton and West Kirby fire stations. Merseyside Fire and Rescue Service have had two twelve week consultations on this in the last year. The first consultation was on the controversial Greasby library/community centre site in the heart of Greasby village. However in a dramatic U-turn following opposition Wirral Council who owned the site in question withdrew it from consideration part way through the consultation.

The second consultation, which finished on the 18th May and provoked similar levels of opposition to that shown in Greasby but for different reasons also involved a piece of land in Wirral Council’s ownership in Saughall Massie. A decision by Merseyside Fire and Rescue Authority following the second consultation is expected towards the end of June.

Yesterday evening Wirral Council responded to a Freedom of Information request about the e-mails that were sent between Wirral Council and Merseyside Fire and Rescue Service about this issue.

The emails make for interesting reading. As there are so many emails in three bundles of correspondence I may split this into different blog posts with half of the first bundle of emails below.

Thanks for the note….. to be very clear on the first point we expressly asked you to identify potential options. You certainly did not propose a site!

In relation to the other points I hope the comments below might help…..

  • The footprint we discussed was based upon the PFI stations we have built recently….. in general these are two bay with extensive community facilities. However in general most of the fire stations only house one appliance despite having two bays although we have been quite successful with the ambulance service in sharing sites.I can’t envisage us building an old style fire station without community facilities and would expect to have two bays as well to allow operational flexibility.
  • All three blue lights services have come under significant pressure to work more closely from government and I think there is a clear public expectation that in these challenging times for public services we would consider the possibility on any new build. In Merseyside we work very successfully with both NWAS and the Police and have several successful operations. In broad terms I would expect the presence of colleague services to be relatively small and not to add significantly to the building footprint (if it does suit their business plans). The PFI stations were designed prior to ambulance requests to move in but we have accommodated them without extension. There are lots of benefits for the local community around joint working by having the services co-located

A couple of initial responses.

– I think it is important to be clear that I responded to a request from MFRS for possible sites for a fire station on council owned land. We came up with two, of which this was one, the other was felt by MFRS to be too close to the current Upton fire station. This is very different to how the email could be read that “David Armstrong proposed” this site. Clearly MFRS has the option to look also at other suitable sites owned by others.

– Our discussions were around a single bay fire station and in that regard the site appeared to have potential, particularly having the front and rear access required by MFRS. The discussion extended to possible inclusion of the community facilities, in line with the very positive developments undertaken by MFRS in Wallasey and Birkenhead.

– I’d envisage that a marked up drawing would come back showing if and how a one bay fire station would fit on the site and possibly a second option of a one bay plus a community facility.

– To the best of my memory, I don’t recall any mention of possible use by police and ambulance “hence the reason for two acres”. I fully support the principle, both for operational and financial reasons but would ask the question – is that going to result in us trying to squeeze a quart into a pint pot here.

– It would be useful to see the footprints of i) single bay fire station, ii) single bay fire station and community, iii) larger joint facility on the land in question.

Sorry if the above sounds negative – I just feel the need to be cautious!

  • You have confirmed that WBC have granted a long-term (99 year lease ) to the local community trust occupying the community centre adjacent to the site. Can you please confirm the area of the site we discussed :

  • You stated the approval was granted for the development of supermarket in the red cat premises Can please confirm whether the proposed scheme for Tesco/Sainsbury has been approved adjacent to the site Library which can expand the options available for WBC & MFRS to consider development on proposed sensitive site. (see attached drawing for reference)
  • As we have discussed with you MFRS anticipate greater interest from associated partners – NWAS & Mersey Police for their respective occupational requirements which is the reason we need minimum of 2 acres of Land to avoid any design issues for a feasible development.
  • As we discussed – ideally MFRS & WBC can look forward on few options :
    1. MFRS can ideally build a Fire station in the proposed land subject to area confirmation.
    2. MFRS can develop a Fire station in the proposed land along with community facility while transferring the lease agreements from WBC to MFRS for the existing community centre subject to consultation with community centre and area confirmation.
    3. MFRS can develop a Fire station along with a community facility & Library facility within the associated occupant Lands subject to an agreement with WBC for Land and lease arrangements.

A couple of initial responses.

– I think it is important to be clear that I responded to a request from MFRS for possible sites for a fire station on council owned land. We came up with two, of which this was one, the other was felt by MFRS to be too close to the current Upton fire station. This is very different to how the email could be read that “David Armstrong proposed” this site. Clearly MFRS has the option to look also at other suitable sites owned by others.

– Our discussions were around a single bay fire station and in that regard the site appeared to have potential, particularly having the front and rear access required by MFRS. The discussion extended to possible inclusion of the community facilities, in line with the very positive developments undertaken by MFRS in Wallasey and Birkenhead.

– I’d envisage that a marked up drawing would come back showing if and how a one bay fire station would fit on the site and possibly a second option of a one bay plus a community facility.

– To the best of my memory, I don’t recall any mention of possible use by police and ambulance “hence the reason for two acres”. I fully support the principle, both for operational and financial reasons but would ask the question – is that going to result in us trying to squeeze a quart into a pint pot here.

– It would be useful to see the footprints of i) single bay fire station, ii) single bay fire station and community, iii) larger joint facility on the land in question.

Sorry if the above sounds negative – I just feel the need to be cautious!

As per our meeting on 8th January 2014 – I am emailing you MFRS understanding in confidence about the land in Greasby (attached )
Summarising the way forward as we discussed:

  • As we have discussed with you MFRS anticipate greater interest from associated partners – NWAS & Mersey Police for their respective occupational requirements which is the reason we need minimum of 2 acres of Land to avoid any design issues for a feasible development.
  • As we discussed – ideally MFRS & WBC can look forward on few options :
    1. MFRS can ideally build a Fire station in the proposed land subject to area confirmation.
    2. MFRS can develop a Fire station in the proposed land along with community facility while transferring the lease agreements from WBC to MFRS for the existing community centre subject to consultation with community centre and area confirmation.
    3. MFRS can develop a Fire station along with a community facility & Library facility within the associated occupant Lands subject to an agreement with WBC for Land and lease arrangements.
    4. MFRS & WBC can work together to formulate development template in line with any Tesco/Sainsbury proposals in the adjacent Red Cat premises along with Option 3 mentioned above which can be beneficial to all involved stakeholders and community in general.

Thanks for the note….. to be very clear on the first point we expressly asked you to identify potential options. You certainly did not propose a site!

In relation to the other points I hope the comments below might help…..

  • The footprint we discussed was based upon the PFI stations we have built recently….. in general these are two bay with extensive community facilities. However in general most of the fire stations only house one appliance despite having two bays although we have been quite successful with the ambulance service in sharing sites.I can’t envisage us building an old style fire station without community facilities and would expect to have two bays as well to allow operational flexibility.
  • All three blue lights services have come under significant pressure to work more closely from government and I think there is a clear public expectation that in these challenging times for public services we would consider the possibility on any new build. In Merseyside we work very successfully with both NWAS and the Police and have several successful operations. In broad terms I would expect the presence of colleague services to be relatively small and not to add significantly to the building footprint (if it does suit their business plans). The PFI stations were designed prior to ambulance requests to move in but we have accommodated them without extension. There are lots of benefits for the local community around joint working by having the services co-located

However there is potential for significant harm to the Green Belt in this location because of its role in maintaining separation between Greasby and Frankby.

The following is a work of satire.

Deep in the dusty, hot West was a town called Wirral. This tale is about a land grab, a common theme in these parts as some townsfolk had let greed enter into their hearts.

Outside of town were about ten acres of farmland known as Fernbank Farm where all day the pony club offered rides to the local children. Everyone had fun there and the pony club had been there for as long as people could remember and paid rent for the use of the land to their landlord. Everybody was happy.

Little did the pony club know then, but their landlord wanted them off that land. At first they thought everything was going as it had in years gone by as their landlord even sent them a new lease to sign, which they returned back thinking everything would be just as it was in the past.

However they didn’t know that the local politicians had had a meeting and at this meeting they had changed the rules so a hundred houses could be built on the land. This was deliberately kept a secret from the pony club on the instructions of Tony Simpson.

Once a deadline had been passed and a new lease had deliberately not been agreed (while telling the pony club they would happily agree to a new lease), the landlord went to Surjit “the Sheriff” Tour, who worked for the landlord to ask him what to do. He told them that he couldn’t turf the pony club off their land yet and in order to evict them he’d first need a judge to agree to it.

The pony club were surprised by this move and got Kirwan (a lawman and former politician to help them), he did his best but the pony club soon ran out of gold coins to pay him and asked for help from Lewis instead.

The pony club’s day in court came and in the judge’s chambers in the town’s courthouse a Judge explained to all (including two curious journalists from the local reservation) that it would have to go to a proper trial where everyone would have their say. Reluctantly the landlord agreed to this.

The day of the trial came and another Judge was in charge. The landlord had hired expensive help from far, far away. The Judge said he was very sorry, but that he had no choice but to sign a possession order to turf the pony club off the landlord’s land. His hands were tied, he felt he had no choice but was very apologetic. If their landlord hadn’t been so underhand he said, he would have granted the pony club a new lease, but now unfortunately his hands were tied.

Once again the two curious journalists from the local reservation were there including a large number of the townsfolk who wanted the pony club to stay. The journalists wrote down what happened, told the local people and a story about the trial appeared in the town’s newspaper.

The husband of one of those put on trial felt the whole thing was unfair and complained. The landlord read his complaint but (surprise, surprise) said he didn’t agree. One of the two curious journalists from the local reservation even asked a question at a meeting of the politicians (it took a month for the politician to answer).

The landlord wasn’t entirely happy with these two going off the reservation at all, as well, these two were known to have caused trouble in the past but they also knew the townsfolk would really start kicking up a fuss if a large number of braves on horseback rode into the town because of how badly it had been handled. You see those on the reservation quite liked horses and didn’t like as it tended to be translated “white man speak with forked tongue”.

It wasn’t the done thing anymore for the landlord to label people (even those from the reservation) they saw as troublemakers as “crazy”. They’d done just that and ending up having to pay many, many, many (and probably a few more) gold coins to a Mr. Morton (a former employee) after he’d raised a big stink about their past skullduggery and a large amount of gold coins that the landlord had stolen accidentally removed in one of their “mistakes” and had said that they wouldn’t pay back (later changing their mind).

So what was the landlord to do? They asked a stranger from far away to come into town. The stranger did come into town, he talked with the pony club and he talked with the landlord.

Not quite understanding the rules of the game* Mr Aspin (the stranger) was from a far away town called Rochdale. He was not a lawman, but a surveyor but he did not like all he surveyed. Phrases such as “this is not an appropriate action for a Local Authority landlord to take”, “accusation of dishonesty”, “gnawed at his professional conscience” and “unfortunate sequence of events” ran through his report as a series of criticisms as to how the landlord had behaved.

*rules of the game referring to the landlord’s rule in that they preferred “independent” people to agree with them as if they didn’t it would mean no more gold coins from the landlord for them.

The stranger recommended they send an immediate written apology to the pony club, pay them them the gold coins they had paid to Kirwan and allow them to stay rent free as well as finding them somewhere else to move to.

Oh dear, what was the landlord to do? Sooner or later those two pesky reservation journalists would start writing about it (although on the plus side the landlord thought it might stop them writing about another of their dastardly schemes to try and close a local school called Lyndale) and then their mistakes would end up in the newspaper again which would mean all the townsfolk would know. Oh dear! How could they stop the press writing about it they thought? Let’s release the report on a Saturday they decided, the press won’t be at work then.

As no politician wanted to associate themselves with such an unpopular issue, they got the big cheese and well-known troubleshooter Mr. Burgess to apologise. “We apologise for the distress”, “the site is on of the three most valuable council-owned development sites”, “savings targets” and “we should have communicated better” he wrote as well as making the same commitment his boss had Councillor Phil Davies to find the pony club somewhere else.

Mr Burgess even went a little too far in some people’s minds in his enthusiasm and wrote things like “the independent investigation”“found that the Council acted legally throughout possession proceedings” when the investigator’s report in fact stated “I am satisfied that the Council followed the correct procedure in the preparation and issuing of Court proceedings. It is outside my remit to make further comments in this regard as a legal process subsequently followed resulting in the Court granting permission.”

So, one of the two journalists on the reservation saw what went on and wrote this tale and here it is. A partial victory for the pony club, but it seems that the fight will carry on.

This is very long and detailed. Today may well be the last time I write about the ins and out of the Fernbank Farm saga (unless more documents surface or something dramatically changes), as I can’t see anything changing in the near future. I hope however that this gives an insight about what happened “behind the scenes” at Wirral Council, as if the tenants were kept in the dark by what seemed to them to be a conspiracy of silence, how can politicians hold officers to account on this topic without knowing the full details?

The first document I below is a letter dated 14th March 2014. The context to this letter is that after the fast track trial, the husband of one of the two defendants made a complaint to Wirral Council. This letter is the reply. I’ve not included the Wirral Council logo on the letter, Malcolm Flanagan’s signature or the www.wirral.gov.uk that appears at the foot of each page.

The letter refers to the letter sent in July 2012 to the tenants with the eviction notice (and which forms part of the eviction notice) as the “wrong letter”.

Fernbank Farm complaint

I refer to your complaint of 18 February 2014, regarding the above matter as well as the pack of information including memory stick that you submitted to me on 24th February.

I have been asked to review your complaint under the authority’s complaints process. I have looked at the matters you raise in how the authority acted in these proceedings. I have reviewed your comments as well as the information available to me and spoken to the officers concerned and set out below my views of the complaint.

As far back as 2000 the land in question had been allocated as a potential housing development site/primary residential as identified within the Council’s Unitary Development Plan. The restriction of developing such green field land which had been in place for some time was abolished nationally in May 2012. This then opened up the possibility of the property to development and realising a very significant capital receipt once it had been agreed by the authority. This national change was put before Cabinet on 27 September 2012 and the development restraint was effectively withdrawn on 15 October 2012 at Council.

The authority’s budget process identifying the stark financial position of the authority came to the fore in the September period under the direction of the Interim Director of Finance. It was at this point that wholesale reviews of authority expenditure, income and assets were undertaken. At the Council meeting in October this detailed the severe financial challenge the authority and that it must take drastic action to balance its budget.

It is then as the scale of the budget issue crystallised this property’s standing as a sizeable and realisable asset increased significantly in importance. It is my view that it was this budget process that changed the authority’s position on this property and it was not its original position.

I am satisfied that, despite what the later actions or inactions may make this look like, in May 2012 there was I believe an intention on the part of the authority to negotiate a new lease with the current tenants. I believe this is shown from the early contacts between the tenants and the authority.

I do not believe the authority intentionally used the wrong letter in July 2012. It is clear though that by some time no later than November 2012 the authority had chosen not to respond to enquiries in recognition of how the authority preferred to see the situation develop. I accept the tenants did write and phone but the authority did not respond and I do not think the authority denies this. At the hearing the authority’s officers said this is what they did and why they did it. The Judge at the hearing described this as “staying silent” and it is seemingly something a landlord can legally chose to do, as the tenant still has an available remedy to apply to the court to protect their own position.

I can though understand your concern on this stance and that the tenants were given no clear signal that this was the authority’s developing position. Again I appreciate your view on this non engagement and how you judge whether this is an appropriate way of transacting business as a public body.

In your complaint you asked who authorised the change in position in effect to “stay silent” and were they entitled to do that. My understanding is that officers in Asset Management have within their job description to act in a commercial manner and to effect the best position for the Council. In my interview with David Armstrong he made it clear that while the decision had predated him given the scale of the budget issue he could foresee no other alternative that he could have taken if it had been his service area at the time.

You have also commented that Mr Armstrong was unaware of the legal action. I have spoken with him and having looked at the timing of contacts no other action than the letter of August 13 was being referred to by you. He is clear that when speaking to you he thought from the information you gave that something else had been done without him being aware. This was not the case and it was the August 2013 being referred to.

Reviewing all these matter, I believe that it was a proper and legal position that the authority was entitled to take in recognition of its budget situation. In its formal role as Landlord, it acted within its rights, in a way to best manage its interest which was to re-acquire the property and realise the best possible receipt for use as capital in the future.

I fully realise you will view that differently. The stance taken by the authority was a formal and legal position but I realise how that translates in human terms on the impact it has on the longstanding tenants and the associations members.

Regrettably whilst appreciating your concerns on the authority’s manner of getting to the position it favoured, I cannot uphold your complaint that it was wrong of the authority to do this. I accept that the “non action” did not alert the tenants to the change in the Landlords intention as it was not something they anticipated from the authority.

Whilst I cannot uphold your complaint for the above reasons, I do appreciate the strength of feeling it has caused in so many people affected by this.

At the recent hearing the Judge gave the authority the right to take back the property I believe, in six months from the date of the decision. I am aware that Mr. Armstrong, Assistant Chief Executive, at the hearing indicated the offer of occupancy by the group for a longer period of 12 months. I believe this shows as the senior officer Mr Armstrong is keen to try to offer support for the club and not just act as quickly as the law allowed.

I have spoken to Mr. Armstrong and he is keen to mitigate the loss of the land to the group. He has also indicated to me his intention is to have the officer’s look at alternative sites for the group and to hopefully agree a suitable way forward over the next few weeks. I have had no reason to doubt the authority’s intention to support this process, while realising a very considerable asset, to help as much as reasonably possible those affected by its decision.

I do realise you will be disappointed by the outcome of my review in not supporting your complaint. However I remain clear that whilst all was done by the authority in a legal manner I appreciate how the change to a more commercial operation in handling this situation has been seen by those affected.

I have to advise you that my review is undertaken at Stage 1 of the authority’s complaints process. If you are dissatisfied with my review you do have the right to request a further review, which can be requested by writing back to me and it would be reviewed by another officer.

I refer to another £350.00 standing order payment received against the above mentioned customer 4206583 dated 1st August 2013. Even after the customer number had been made inactive on the AR system, it appears any money being received quoting a valid customer will still appear on their account.

I have again refunded the money back to the Associations bank account but this time have asked for another customer number to be set up with the clients address details and merged the old customer number 4206583 with the new one, therefore making 4206583 invalid so hopefully as the Association quote their customer number when paying by BACS/Standing Order the AR system will now not recognise it as a valid number and place it in our unidentified payments were we will be able to refund straight away without the money hitting their account.

Can you please confirm and send me a copy of the letter that you have sent to the above requesting that they now cancel the standing order payment.

After 31st May 2013 Pony owners will have lost the right to renew if they do not apply to court but Sundry debtors must not charge or accept any rent.
Spoke to Tony after getting first message and again, ignore phone call as any commercial firm would do.

Tony has spoken to David Armstrong about situation.

Spoke to Peter Rowlands after 31st May need to apply to court to get them off, after 6 months get protection again. Peter will need to check with Anne Quirk. V important that Council accepts no rent.

Emailed and spoke to Debbie Finance cannot stop any rent payments being received either by tenant using customer number old invoice number of name. Debbie checked with IT.

* Peter Rowlands is Wirral Council’s officer contact for property that they are auctioning off through Pugh Auctions. Therefore it is clear that Wirral Council’s intention was to get a possession order for Fernbank Farm, evict the tenants and sell the property off to the highest bidder. Obviously before then a Cabinet Member would have to decide to declare it “surplus to requirements” which is something that can’t be decided while the tenants are still there.

One of the new items added to Wirral Council’s Forward Plan (which will be decided by Wirral Council’s Cabinet in June) is The Wirral Borough Council (Grange Road, Birkenhead) Compulsory Purchase Order 2008 which relates to an outstanding compensation claim.

Although the Forward Plan doesn’t mention it, Cabinet will be asked to accept a recommendation from officers to settle a claim made by B&M Retail Limited arising from the The Wirral Borough Council (Grange Road, Birkenhead) Compulsory Purchase Order 2008.

B & M Retail Limited objected to Wirral Council’s use of compulsory purchase orders to build an Asda in Birkenhead Town Centre which resulted in a planning inquiry. The twenty-four page report of the Planning Inspector Christina Downes into Wirral Council’s use of their compulsory purchase order powers can be read by following that link.

Two of the people at Wirral Council named on the equality impact assessment for the recommendation to June’s Cabinet to settle the compensation claim of B&M Retail Limited will be familiar to those who have read the media coverage about the court case involving the tenants of Fernbank Farm back in January. They are EIA Lead Officer Tony Simpson (line manager for David Dickenson) and Chief Officer David Armstrong. Head of Section Jeannette Royle is also named on the Equality Impact Assessment.

How much the compensation claim of B&M Retail Limited is for is not known, however it is likely to be for a large amount. It is listed as a key decision on the Forward Plan, which means it is either for £500,000+ or is for ten percent or more of the agreed budget for this area. The Cabinet Member for this area is Councillor Adrian Jones (Cabinet Member for Central and Support Services).
