This story continues from Upper Tribunal (Administrative Appeals Chamber) case involving information request to Wirral Council by Martin Morton listed for public hearing on Thursday 26th April 2018.

The hearing in Upper Tribunal case GIA/3037/2017 (previously First-tier Tribunal case EA/2017/0108) took place yesterday at Field House, 15-25 Breams Buildings, London, EC4A 1DZ. Unfortunately I wasn’t present at the hearing.

The Appellant is Anthony Martin Morton, 1st Respondent the Information Commissioner and the 2nd Respondent Wirral Metropolitan Borough Council.

It was a first instance hearing, having been transferred to the Upper Tribunal by the agreement of the former President of the First-Tier Tribunal (General Regulatory Chamber) and the President of the Upper Tribunal (Administrative Appeals Chamber) using a power in Rule 19 of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009.

Unrelated to this case, the President of the First-tier Tribunal (General Regulatory Chamber) has recently changed and is from Wednesday 25th 2018 Judge Alison Jayne McKenna (known as Judge McKenna). She was not the President who transferred this case.

The Upper Tribunal hearing held yesterday was held before Upper Tribunal Judge Kate Markus starting at 10.30 am and ending at approximately 4 pm. There was a one hour break for lunch and an approximately one hour closed session which Mr Anthony Martin Morton was excluded from.

The Appellant Anthony Martin Morton, 1st Respondent the Information Commissioner and 2nd Respondent Wirral Metropolitan Borough Council were all present for the hearing.

A written decision by Upper Tribunal Judge Kate Markus on disclosure of the disputed information is expected to be served on parties in around 1-3 months time and will be published on the Upper Tribunal’s website if not appealed.
