Unfortunately this blog post will have comments deliberately turned off as proceedings are classed as “active” in this matter at the time of publication. This is because of legal proceedings in the Administrative Court (Manchester) in which a hearing date has been set.

David Ball of Wirral Council (agenda item 17) gave an update to councillors on Wirral Council’s Planning Committee about the judicial review. You can watch what he said to councillors above.

A hearing date has been scheduled later in January 2018 at the Administrative Court in Manchester.

Wirral Council had withdrawn the first enforcement notice, but a second enforcement notice had been served.

The second notice limits the time for compliance to 3 months from the date that the notice takes effect.

He explained that the 3 month period starts 28 days after the service of the notice.

As a caveat the solicitor advising the Planning Committee pointed out that when enforcement notices are served, the individual (or body) that the notice is served on can appeal it.

A hearing date is scheduled for 31st January 2018. Presumably from the description given by David Ball it will be at Manchester Civil and Family Justice Centre, 1 Bridge Street West, Manchester, Greater Manchester, M60 9DJ. Unfortunately I do not know the time, length of the hearing or case number at this stage. The daily cause list for the Administrative Court (Manchester) sitting on the 31st January 2018 should be published on Tuesday 30th January 2018.
