The meeting started ten minutes late and in a different room to the advertised Committee Room 4. Cllrs present on the panel were Cllr John Salter (Labour), Cllr Steve Niblock (Labour) and Cllr Cherry Povall (Conservative). Officers of Wirral Council were David Abraham (Legal Adviser), Anne Beauchamp (Committee Clerk) and Margaret O’Donnell (Licensing Manager). Representing Merseyside Police was Sgt Jenkins. Colin Fox (the proposed Designated Premises Supervisor) was represented by Samantha Brown/Ford of Napthens Solicitors.

When everybody came back, the Chair apologised for confusing Fox and Ford.

The decision was as follows:

“We have given careful consideration to the application made by Mr. Fox for the transfer of a Premises Licence in respect of the North Star, 294 Laird Street, Birkenhead. We have listened carefully to the representations by Mr. Fox and Mrs. Ford, his legal representative. We have considered the representations made in writing and orally by Sergeant Jenkins of the Merseyside Police.

In determining the application we have regards to the prevention of crime and disorder objective, the Council’s Statement of Licensing Policy and the relevant guidance issued under s.182 of the Licensing Act 2003, in particular paragraph 8.99.

We’ve heard evidence from Merseyside Police, that they have serious concerns that the transfer of the Premises Licence to Mr. Fox would undermine the crime prevention objective. Merseyside Police gave evidence that when the premises was subject to a closure notice, it operated in a breach of that condition of the licence and an alleged serious sexual assault took place at the premises which is currently being investigated by Merseyside Police.

After these incidents have taken place, since Mr. Fox has been involved with the premises. We were not satisfied that the applicant Mr. Fox, as a holder of the Premises Licence …

I have now been married to John, for four years, but John’s mother, also his brother, don’t want us to be together. I have gone out of my way to be there for him, but his mother said I should not stand by him if he wants to help the people with their problems. I should tell him to say “No!” Why, when he loves helping them?

Also, he loves writing, for his paper on the laptop. She said no, no, but he loves to write the truth. Also she does not want him to be happy as he is with me. She likes to treat him like a small child, but he is a grown man in his thirties.

Also, because I am not English born, she does not like me. Also, as she hit me in my face on the 27th December 2011 and made me have a black eye. Then a few days later, when I was at home having a transient ischaemic attack (TIA), and I dialled 999 for help. The ambulance came, but also the police came first and they demanded to take John away, because as I still had a blackened eye, which his mother had given me, they took John away.

I did not go with the ambulance to the hospital, but stayed behind. I waited an hour to make sure I could drive and went to the Custody Suite after ringing up. His mother had phoned the Custody Suite and did not contradict that he gave me the black eye when it was her who gave it to me. After I got there, one and half hours passed before he was allowed to come away with me.

We decided to have nothing to do with his mother or any member of that branch of the family. On the 10th May this year 2012, John and I had gone to bed. We have a cat called Stranger, a black cat, whom he loves very much.

During the night, or early morning, Stranger started to cry. He got out of the bed to see what the matter was, but unfortunately fell down the stairs. He banged his head and broke his arm.

Once again I informed the ambulance and we went off to the hospital. They couldn’t see to his arm there and then, but on the 12th May we were called back in again where they operated and plastered him up. Late afternoon they allowed him to go home.

A few days later, he was having a bit of a problem with the pain in his arm, and I was not feeling very well, so I dialled 999 to call an ambulance for myself. Once again the police came and they had been informed that I had pushed him down the stairs, but I had not pushed him down the stairs.

Going by what she had said to the police previously, even though I was having a transient ischaemic attack (TIA) they put me into handcuffs and dragged me away to the Custody Suite, for six and a half hours. They did not allow John to travel to the hospital with me. They dragged me down and up the steps causing injury. When John got to the Custody Suite, after having first gone to the hospital and missing me by five minutes, she stated to the officers not to let me out. Eventually they let me out after six and a half hours with no charge.

She is now stating that I don’t look after her son. She has informed Social Services of this fact, she desperately wants to break us up and for John to move away, so that she can keep him like a little boy for eternity.

Budget night at Wirral Council & Off licence application for 46 Hoylake Road, Bidston turned down

Well tonight councillors at Wallasey Town Hall meet to decide among other things Wirral Council’s Budget for 2012-2013.

So far we have had the surprise Labour Budget at its last Cabinet meeting on the 13th February, which was then rescinded by the new Conservative/Lib Dem Cabinet on the 21st February.

Labour councillors then “called-in” the decision by the Conservative/Lib Dem Cabinet of the 21st February to rescind their earlier Labour Budget recommendation to Council and the Budget procedure chosen by the Conservative/Lib Dem Cabinet. This call-in was decided at the Council Excellence meeting on Tuesday 28th February. This call-in failed mainly because Bill Norman said that Cabinet recommendations to Council from Cabinet weren’t subject to call-in as in his view it wasn’t an Executive decision, just a recommendation so Labour have tabled an amendment to the Budget procedure tonight.

However in more local news the Licensing Act 2003 subcommittee of Cllr Steve Niblock, Cllr Mike Hornby and Cllr Don McCubbin decided yesterday to turn down an application for an off-licence at 46 Hoylake Road. The reasons given were the objections of Merseyside Police (both Sgt Jenkins and Inspector McGregor were against it as they thought it would lead to increased crime and disorder).

The committee also had serious concerns about the integrity of the person who’d made the application for the licence and his alleged association with criminal activities. Trading Standards also spoke during the meeting about how they had seized counterfeit goods from the person applying for a premises licence.

The Subcommittee also felt the person applying displayed no understanding of the licensing objectives, despite previous involvement with other licensed premises, one of which had had its licence revoked due to violent crime. The issue of under age sales was also given as a reason by the subcommittee.

History walk (Bidston Hill) Saturday 5th November & fireworks displays

There will be a history ramble tomorrow on Bidston Hill between 10am and 12.30 tomorrow starting at Tam O’Shanter Urban Farm led by the ranger. Due to bat hibernation the windmill won’t be open on this walk.

Merseyside Fire and Rescue Service are advising people to take part in the public displays and will be removing any bonfires on public land. The local fire service recommend anyone with a wheelie bin to keep it away from doors and windows and if possible away from the public to lessen the risk of wheelie bin fires. For a free home fire safety check including free smoke detectors, to report an illegal bonfire (or build up of material) which will be quickly removed or for arson prevention advice contact Merseyside Fire & Rescue Service free on 0800 731 5958.

Merseyside Police will be running Operation Banger, which include high visibility policing, seizing illegal fireworks and other activities such as reducing underage sales of alcohol to young people.

In an update to a previous story on this blog I was on the bus yesterday reading the Metro and happened to notice this story in the Metro.

According to the story the Metropolitan Police’s specialist crime directorate have now announced he will appear at City of Westminster Magistrates Court today (27th September 2011) after being charged with one count of contamination of goods and two counts of administering a noxious substance.

As stated in the original story although the packets showed Neurofen Plus on the packaging, they actually contained Seroquel XL (which is a prescription-only medication).
