In a follow-up to yesterday’s story Wirral Council’s Cabinet agree 150 year lease for fire station in Saughall Massie I am going to write an editorial on a related matter. I’ll start by pointing out that I was the Appellant in the First-tier Tribunal matter referred to and Applicant in the related Upper Tribunal case.

Below is an opinion piece, I am not a legal professional and one of the costs decision referred to is sub judice. However as Editor I have decided there is a public interest in these matters being written about for various reasons.

Wirral Council’ Cabinet this morning agreed to a 150 year lease to Merseyside Fire and Rescue Authority of land it owns in Saughall Massie for a new fire station.

During the meeting, Cllr Phil Davies referred to a petition opposing the lease started by Cllr Chris Blakeley (who is a councillor for the area concerned).

In a response to an earlier story on this blog headlined Will two overlooked covenants for “enjoyment of light” prevent a fire station at Saughall Massie from happening? Merseyside Fire and Rescue Service stated,

“the “Retained Land” detailed in Land Registry title number MS503610 does not include the land upon which Merseyside Fire & Rescue Authority have planning permission to build a new fire station.“

Below is the text of a letter I received earlier this month from a David Ball at Wirral Council following a stage 1 complaint I made about the grant of planning permission APP/17/00306 (which was for a fire station in Saughall Massie).

I will point out that there are aspects to the letter I don’t agree with, but in the interests of transparency, the public interest in the matter and the seniority of David Ball I am publishing it below. As it’s two pages, a link break is shown between the two pages.
