Who’s leaving Wirral Council and what is a 20,085 signature petition against?

Yesterday’s email from Mr Tour, ended with “you are required to return to the public gallery”.
However when I did return to the entrance to the public gallery above the Council Chamber, after asking my question, Wirral Council’s Community Patrol unsuccessfully tried to stop me re-entering.
I have however sadly learnt in life to ignore a lot of Wirral Council employee’s more bizarre requests and slipped past him. The guy from Community Patrol tried to grab my arm to stop me but lost his grip.
Ironically as I had had a stand up protest downstairs over the nonsense over the seating arrangements, typing away notes on my iPad, in the hot weather my bare arm was so sweaty by then that his hand couldn’t grip on to me.
So I thank Surjit Tour for putting into place a chain of events that thwarted another Wirral Council employee.
As I’d forgotten to turn my tape recorder off downstairs there’s a tape of the whole matter and conversation.
Maybe Community Patrol will have better luck at the next Planning Committee?
Indeed Wirral Council losing its grip seemed to be a running theme of the evening.
The petition against the planning application for a fire station (on Council owned land) in Saughall Massie presented by Cllr Chris Blakeley has reached 4,034 signatures. The report from Wirral Council’s planning department recommends it for approval. The matter will be decided at the Planning Committee on the 20th July 2017, after a site visit on the 18th July 2017.
Another large petition, of a mere 20,805 signatures, submitted by Cllr Chris Blakeley on behalf of Cllr Jeff Green opposed the introduction of car parking charges in the country parks (which goes to a call-in meeting on the 18th July 2017).
Cllr Phil Davies (Leader) and the Labour councillors however does not agree with Cllr Chris Blakeley on many policy matters.
After questions for Cabinet Members from various councillors, there were general questions, followed by just over half an hour of debate about senior managers’ employment status.
A quick summary is Julia Hassall (Director of Children’s Services) resigned, Tom Sault (Assistant Director: Finance) is entering a “phased retirement”, Surjit Tour (Assistant Director: Law and Governance, Monitoring Officer and Senior Information Risk Officer) has resigned and Clare Fish (Executive Director for Strategy) has requested early retirement.
The Chief Executive, Eric Robinson also wants to regrade the Director for Children post to the £140-£155k band and create a new post for a senior manager (Director of Strategy and Partnerships) on a salary range of £103k-£115k. He also wants to increase the salary range for the Assistant Director: Law and Governance and Monitoring Officer post to a maximum of £93k. Those are most of the changes (there are some other ones too).
The changes to the senior management team that were recommended in a private meeting of the Employment and Appointments Committee were agreed by Council yesterday evening on a 35:25:1 vote (for:against:abstain). The 1 is the Labour councillor who is the Mayor abstaining. The other 35 are Labour councillors and the 25 were a combination of opposition councillors.
The effect is that Surjit Tour remains serving out his notice (until some point in September 2017), Clare Fish’s early retirement request is agreed, Tom Sault retires (but phased) and Penna (the external recruitment consultants) have a massive pay-day from advising Wirral Council on recruitment to all these posts (estimated by one councillor at ~£12k a post).
The senior management team was restructured last in November 2016 and at least one councillor suggested that changing again so soon implies that the previous model hadn’t worked.
Cllr Bernie Mooney referred to people being paid, “too bloody much”.
Certainly the senior management team hasn’t been changed this much since 2012, when a large number of them were suspended, then paid large sums to leave as the suspension wasn’t done properly.
There was also a short debate on wildlife sites.
Most people however were there in the public gallery (patiently waiting around two hours before the meeting got to that point) to hear debate on a Notice of Motion about the New Ferry explosion.
Cllr Warren Ward received cross-party plaudits for his work as a ward councillor for this area.
Labour councillors blamed it on the government.
Conservative councillors said that part of the response was the responsibility of Wirral Council.
In the end though, after just over 30 minutes of debate, councillors of all parties agreed a notice of motion that will result in Wirral Council writing a letter to the Prime Minister and a letter to the government minister for Communities and Local Government.
After that agreement, the Mayor called for a ten minute adjournment (which turned into a fifteen minute adjournment).

Wirral Council’s Planning Committee meeting held on the 10th November 2016 was standing room only because of the planning application about a fire station at Saughall Massie (APP/16/00985)
Updated on 30th November 2016 and the 11th December 2016 by JB: The site visit is scheduled for 11 am on the 13th December 2016. Contrary to what was said at the Planning Committee meeting reported below, the Planning Committee will then meet in the Civic Hall (1st floor) at Wallasey Town Hall, Brighton Street, Seacombe, CH44 8ED on the 15th December 2016 starting at 6.00 p.m. in order to decide on this planning application.
Last night’s Planning Committee at Wirral Council was another event in the long running political saga that is the attempts to start a new fire station at Saughall Massie and close Upton Fire Station and West Kirby Fire Station.
Committee Rooms 1 and 2 which were the venue for the Planning Committee at Wallasey Town Hall were both full (standing room only as you can see from the picture above) and Committee Room 3 in another part of the building was being used as an overflow.
Dan Stephens QFSM (Chief Fire Officer for Merseyside Fire and Rescue Service/Chief Executive for the Merseyside Fire and Rescue Authority) was looking very smartly dressed in what I will describe as his ceremonial uniform. He was there with what I will describe as an entourage of people from Merseyside Fire and Rescue Service including Ria Groves (Trainee Solicitor) and Colin Schofield (PFI Project Manager (part of his job is to manage the Saughall Massie Fire Station project)). Dan Stephens QFSM and his entourage stood near the door.
Also present were the three local councillors for Moreton West and Saughall Massie ward (Cllr Chris Blakeley, Cllr Steve Williams and Cllr Bruce Berry). They have opposed this planning application along with groups such as the Saughall Massie Village Conservation Area Society and the Wirral Society.
The vocal and public disagreements about this political issue between Cllr Chris Blakeley and Dan Stephens QFSM are mainly already on the public record, well documented and have been reported on by myself before and others, so I’m not going to rehash in detail the rather long history of the matter here.
I will briefly state however that Wirral Council withdrew its offer of land for this at Greasby which is what led to Saughall Massie being proposed. The effect of that is it has given some people hope that people power can overturn the previous cross-party political consensus behind it.
Also I had better point out that there was a rather long running First-tier Tribunal case in which I was the Appellant about the financial breakdown of expenditure for the new fire station first at Greasby, then Saughall Massie.
Present at the Planning Committee was Alan Rundle who had exchanged letters with Merseyside Fire and Rescue Authority about a proposed judicial review before the Greasby plans were abandoned for very similar issues to those that the First-tier Tribunal (in case EA/162016/160054) covered.
However in summary, Merseyside Fire and Rescue Authority have estimated £300,000* to pay Wirral Council for the land and an estimated £550,000 from the sale of the fire stations at Upton and West Kirby. To build a new fire station will cost an estimated £3.7 million (I’m not including the figure for the land in that), with £1.5 million offset by a government grant. The complete capital cost breakdown was not made public prior to the two twelve-week consultations (first on Greasby, then on Saughall Massie) that Merseyside Fire and Rescue Service ran on Merseyside Fire and Rescue Authority’s behalf.

CLLR STEVE FOULKES: Errm Chair, sorry with your indulgence and err errm with some trepidation, errm I’d like to move site visits on two sites errm.
The least err controversial one I think might be item 13 which is err Pipistrelle Rise which is well-known to Planning Committee and has one with a varied planning history, it’s a very unusual site given it’s site levels. So I’d therefore request that we have a site visit before we make any decision on that matter.

The next one is errm item 9, which is the err fire station, as you referred to Chair. I think it’s fairly obvious to any elected Member the level of concern and the public interest in this debate and I think it would be better for all elected Members who are making that decision to be forewarned, forearmed with an actual site visit and the layout of the area.
Secondly I think it will be plenty of time for us to get arrange as they said in Jaws, “I think we need a bigger boat!” Err, I think we need a bigger room, if we can arrange that in time for the next err meeting it would make it better for the public to engage with us.
I don’t expect people to be in a standing position for any length of time, I find it errm, it is of a matter of great public interest that we do have a site visit. I’m hoping errm, if we have brought you out on a winter’s night for to no avail, but it’s not unusual that applications of this type to have a site visit, so I will move a site visit on that matter.

CLLR IAN LEWIS: Chair, I endorse what Councillor Foulkes has said, but particularly in terms of where we have the meeting next time to discuss the fire application, can I suggest that we try and find a venue in Moreton/Saughall Massie to allow as many people as possible in that area to attend?

CLLR IAN LEWIS: Can I explain why Chair just for a moment? Clearly the number of people here tonight would be you know they’ve come along to take part in the democratic process to see how they make a decision.
There will be other people in that area, who haven’t been able to get here.
To drag everybody, these people again late December, can I propose we try and find a venue nearer to the site to consider this application, as an exceptional application?
CLLR ANITA LEECH (CHAIR): I think you know the only thing that I would say you know and I totally agree with what you’re saying there and if we can do that we should but in terms of we need to have the right systems in place, wherever it’s going to be.
We need to have the visual and the sound system, if we could find a venue

CLLR DAVID ELDERTON: Apologies for that, errm I totally endorse the move by Councillor Foulkes to have the site visit for number nine. It is essential that we get the widest possible publicity and transparency in making sure we end up with the right decision. So I do endorse that.
My quick reason for speaking at this time of course is to ask for a site visit on item twelve, which is Stone Hive, Darmonds Green, West Kirby. That is it looks a simple site in

terms of the application agenda we’ve got but it’s far more complex than it would appear on paper. So no doubt we will benefit from having a site visit for that particular development before we make a decision to approve or refuse it. Thank you Chair.

Maybe the Green Party aren’t like other political parties who take a "guilty until proven innocent (and we the party will decide upon what prove innocent means)" approach and grill the party member when a complaint happens. No I’m not referring to the recent suspensions of councillors in the Wirral Labour Group… but my own personal experience of the Lib Dems taking seriously a party political complaint about me from former Labour Cllr Harry Smith (sent to both me and the party with a Wirral Council "With compliments slip").
In essence his complaint was that when he was Vice-Chair of the Pensions Committee (the Pensions Committee manages the Merseyside Pension Fund worth £billions which has over a hundred thousand people either pensioners or employees part of it) I put in a leaflet to people in the Bidston & St James ward that he didn’t go to a meeting that reported the Merseyside Pension Fund had dropped by hundreds of millions of pounds.
His complaint was that he decided to go on holiday instead (he didn’t send a deputy to the meeting) and that my leaflet wasn’t unfair personally to him because it led to people going to his surgery and asking him questions (because and I mean this with a lot of dripping sarcasm of course, obviously the last thing a local councillor is paid a generous allowance of thousands of pounds a year for is to actually have to deal with the public and see what I write below for why the Labour Group of 2015 takes a different view on representing the public to Harry Smith). Therefore former Cllr Harry Smith (around the time of a one week suspension as a councillor for not apologising properly for bullying) wanted disciplinary action taken against me by the Lib Dem Party for telling the Bidston & St James residents the truth.
Ultimately the Lib Dem Party (who then were always very keen to curry favour with other political parties) gave him and his fellow Labour party members their way in 2011 but the Lib Dems (under a lot of pressure to get rid of me) did it so badly, the Birkenhead County Court ruled one of the Lib Dem councillors, the local Birkenhead party and indeed the whole Lib Dem Party had broken the law in doing so.
Thus proving that politicians are terrible at realising that there are legal limits on what they should or shouldn’t do. As many will know, the political class have an arrogant view at times that rules and laws apply to everyone but them! The MP expenses scandal showed that.
However to be fair (and hopefully as balanced as I can be) to the Lib Dem Party, their view is that an unlawful decision still stands and court orders should be flouted (and then the Lib Dem Party wonders why it lost 49 MPs at the recent General Election?)
As former Cllr Harry Smith didn’t get his way over that complaint he tried to stop filming of a public meeting of Pensions Committee meeting stopped, telling others on the Pensions Committee it I was because I was a member of a political party (at the time a lie as I wasn’t a member of the Lib Dems then, due no doubt in part to his complaints and moaning about me "blotting my copybook" as one party member put it). A rather young fellow Labour councillor had the gall to tell him such a point was irrelevant which really got him going, however I am digressing into stories from yesteryear. It was suggested to me recently that I should be more positive (however remembering how former Cllr Harry Smith used to be is enough to spoil anyone’s good mood)!
Returning to the Cabinet meeting, Cllr Adrian Jones explained that Rock Ferry High School had closed in 2011. He outlined the process that had to be followed if the Rock Ferry High School and the playing fields were to be used for a different purpose and that this required government approval from the Minister. He summarised the efforts so far on finding an alternative educational use for the buildings which unfortunately had not panned out.
The costs (business rates and security) of managing the vacant site were costing Wirral Council money. The original intention had been for Wirral Council to sell the buildings and playing fields. However following public consultation and "opposition" to disposal of the site, a compromise position had been found or as Cllr Adrian Jones put it, “However, we are a listening Council and following extensive public consultation it was evidenced that there was a very significant amount of opposition to that proposal.”
He went on to say that this option would produce a reduced capital receipt to Wirral Council, but this would allow the Residents’ Association to bring forward proposals for the playing fields and woodland.
Cllr Adrian Jones proposed the following recommendation.
"It is recommended that:
17.1 Cabinet approves the submission of the application to the Secretary of State for Education for the disposal and change of use of the former Rock Ferry High School.
17.2 Approve the mixed use option for the site as outlined in 6.4
17.2 Approve officers to progress development proposals to site (area A) for residential development in accordance with local planning requirements
17.3 Work with the newly formed Rock Ferry Residents Association to bring forward proposals for the management of the site (areas B and C)"
For the purposes of information 6.4 (which recommendation 17.2) of the report refers to states:
6.4 Take account of local views and develop a mixed use option for the site
(i) area (A) i.e. the main school site, development for housing
(ii) areas (B) and (C) the former playing field site could be considered for community asset transfer for continued sport use and open space. This is of particular interest to the residents in the area and plans for the management and development of the area are being considered. Football clubs in the area have expressed an interest and there are opportunities for obtaining grant funding. This area was previously designated as school playing fields and the only community use was through lettings agreed with the school, general community access was not endorsed.
Councillor Chris Meaden pointed out that it was in her ward and referred to "slightly heated meetings" that she had attended and that they’d listened to the residents, changed the recommendations so that the woodland was kept and the sports field. She thanks the residents of Rock Ferry and that "we hope we’ve proved ourselves to you"
Cllr Meaden went on to thank Jeannette Royle (Senior Manager, Asset Management), David Armstrong (Assistant Chief Executive) and David Ball (Head of Regeneration) for attending the meetings and she wanted to thank them for their support and their efforts in listening to residents.
The recommendation were agreed by Cabinet.

Continuing from Wednesday’s blog post headlined Wirral Council planning on green belt fire station “inappropriate development” & “potential for significant harm”, I thought people might be interested in more of the emails that went between Wirral Council and the Merseyside Fire and Rescue Service about the plans for a fire station in Wirral West as it seems that detailed discussions were going on behind the scenes both at officer level at Wirral Council & Merseyside Fire and Rescue Service, as well as discussions with councillors too.

David – the land on the opposite site of Frankby road to St John the Divine is in the Green Belt so a fire station would be inappropriate development and very special circumstances would have to be demonstrated. However there is potential for significant harm to the Green Belt in this location because of its role in maintaining separation between Greasby and Frankby.

Following on from when we spoke last week, I recall you were going to get someone to look at the land at Upton By-pass/Saughall Massie Road to see if there was any potential for us to consider it as a site for the new merged Upton/West Kirby fire station. I think you also suggested that you’d get someone to produce a plan showing any ‘spare land’ in the Greasby area (back to the By-pass) so we can continue to seek out a potential site for the new station.

It should be noted, however, that these are still subject to significant constraints. The land at the corner of Saughall Massie Road is a Council-owned densely wooded site with access constraints. It is likely that there would be significant highways issues at the junction with Upton By-Pass. The land to the north of Upton Cricket Club is also subject to access constraints and is currently used for horse grazing. It has been submitted through the Call for Sites exercise for consideration for housing. Both sites are also less than 1 mile away from the existing station in Upton.
In terms of Green Belt sites, this type of development would be considered inappropriate and very special circumstances would need to be demonstrated to justify development. The capacity to accommodate fire engines on Frankby Road and the western part of Saughall Massie Road may also act as a constraint to development in Greasby/Saughall Massie.

a) Fire stations are a lot quieter than people imagine and rarely respond under blue lights

Just to say that the site at the corner of Saughall Massie Road is a designated Urban Greenspace but although highly visible it does not really function as an accessible public open space and Overchurch Park is within 400m to the north, albeit on the other side of the bypass. The visual landscaping impact alongside the bypass could however be retained without retaining the whole of the rest of the site (although this is still likely to be controversial!). The highways issues are however likely to be overriding.

Further to your discussion with Andrew on Friday, please find attached site plans of two potential sites for the relocation of Upton Fire Station. We examined the whole area and these are the only sites that we consider have potential, in addition to the site already being considered. It should be noted, however, that these are still subject to significant constraints. The land at the corner of Saughall Massie Road is a Council-owned densely wooded site with access constraints. It is likely that there would be significant highways issues at the junction with Upton By-Pass. The land to the north of Upton Cricket Club is also subject to access constraints and is currently used for horse grazing. It has been submitted through the Call for Sites exercise for consideration for housing. Both sites are also less than 1 mile away from the existing station in Upton.
In terms of Green Belt sites, this type of development would be considered inappropriate and very special circumstances would need to be demonstrated to justify development. The capacity to accommodate fire engines on Frankby Road and the western part of Saughall Massie Road may also act as a constraint to development in Greasby/Saughall Massie.

a) Fire stations are a lot quieter than people imagine and rarely respond under blue lights
b) Quite often appliances respond when they are off site doing home fire safety checks etc

a) Sites discounted early
Two sites were considered at an early stage and discounted. One was a junior school on Mill Lane – there were concerns about access and no indications that school was willing to give up land. The second was a farm site on Arrowe road – No indications if land was for sale
b) Sites considered in more detail
Since then 6 sites have been considered in more detail. They have been identified by a mix of estates team detective work, suggestions by colleagues and suggestions by Wirral officers. The sites are analysed in more detail in the attached appendix. As it stands there are two “runners” left:-
Saughall Massie Road/Upton By Pass. This is owned by Wirral and looks quite positive based on recent correspondence despite being urban greenspace. It may be a little father from Greasby than planned but access good
The Library/Community hall site in middle of Greasby. However this site not suitable for ambulance services and we would have to deal with multiple partners. Locality is a political hot potato with large public outcry about supermarket development.
c) Latest Developments
Estates team have been liaising with various professional advisers to see if they had any information. We have heard rumours of one potential larger development being put together near Greasby. We are awaiting more details and location
Have also formally instructed Hardie Brack to look for sites and their report is awaited. We believe they may have identified three or four potential plots which we understand all to be farmland that might be for sale.

We are, in conjunction with Wirral, exploring the possibility of a joint development on the site of the existing Library and Community Centre situated in between the Red Cat and Medical Centre on Frankby Road.
This would be an ideal location from an operational response perspective. The joint development may consist of a fire station, library and community facilities in an integrated building. It is possible North West Ambulance Service may also be interested in the development but that is by no means certain and would be subject to confirmation.
This proposal is at a relatively early stage and not all potential partners have yet been approached. Whilst I have a degree of confidence that such a development is deliverable I would ask that any response to constituents over this issue is heavily caveated to that effect.
My suggestion would be to respond along the lines of ‘Considerations are now focused on a site in the centre of Greasby in Wirral ownership. Whilst discussions are at a very early stage, the debate has been around delivering a shared public services facility that would add significant value to the community’.

Please could I ask for a quick update on decisions over stations in Wirral West following contact from constituents. Specifically
Have MFS identified land as yet in Greasby? – Not as yet. We are exploring the possibility of acquiring a site on the Greasby Frankby border and also a site at the junction of the Upton Bypass and Saughall Massie Road. As you are probably aware there are very few available plots of land in the area which would be appropriate for a fire (and possibly ambulance) station
If so when will any consultation process commence? – If we are able to acquire a site we will report this to the next scheduled Authority meeting and request approval to undertake a 12 week public consultation process immediately thereafter. I can send you the process we are utilising for the proposed merger in Knowsley (Huyton with Whiston) which was approved at the Authority meeting on 6th May if that would assist?
If not, what would the likely timescale be to implement alternative proposals and when would any consultation start? – If it becomes obvious that we will not be able to acquire a suitable site for a merger then we will report back to the Authority and advise them of the alternative options to a merger which on the Wirral would be the outright closure of West Kirby. Subject to Authority approval we would then undertake a 12 week consultation process immediately thereafter. Clearly this is the very last outcome we would want so we will explore every land option possible even if that requires consideration of alternative sites (hence the Upton Bypass and Saughall Massie Road reference above)

I saw Lesley Rennie last Friday and she did mention to me the meeting was taking place.
I was in meetings yesterday afternoon so only picked up the e-mail last night. Thanks for the update. I shall wait and see if Lesley can change their minds about this location or not. In the meantime I will not look at this any further until I have some view from the Councillors. I hope there is a positive outcome.

Dan met Greasby councillors today – Wendy Clements and Tom Anderson (I think). This as at request of Lesley rennie. They do not appear to like the idea of a fire station in Greasby and their initial thought is to oppose the plan based on the conversation today. Dan explained that the alternative option was the closure of West Kirby outright which was also not platable and may cause them to reconsider. However it appeared that their initial view is to oppose.

I think we would like to initiate discussions with the community hall in any case. The issue we have is that as firefighters retire we can’t staff all the appliances and with two years to deliver a new station its important we don’t lose any time.
Unless that causes any major problems would you be agreeable to proceed. If nothing else at least we can work up properly what is proposed as a joint service hub that may help win hearts and minds!

Can I suggest we have a meeting to discuss our options and possibly include Graham, Phil Davies and even Jeff Green please?
The alternative to a merger of West Kirby and Upton fire stations in an outright closure of West Kirby which we would move to public consultation on imminently. That will undoubtedly result in a degree of political impact and I would want us all to be on the same page in terms of a collective position.
