Planning Committee refuses plan for Tesco in Wallasey Village

Unusually I got to film the Planning Committee meeting. The first planning application was the controversial application for a Tesco in Wallasey Village (the officer’s report can be read here and here is a link that takes you straight to the start of that item in the video I took of it.

The officer introduced the item by saying a decision on the application was deferred on the 25th July for a site visit. She explained the planning history and the reasons why the officers were recommending it for approval. There was a petition objecting to it signed by over 1,200 people.

The lead petitioner gave his name as Lee Kendall and said that he was the principal transport planner at SCP (a transport consultancy based in Manchester). He referred to a technical report SCP had submitted and how they felt the level of parking was inaccurately described in the officer’s report and below the levels they’d expect. The lack of parking would lead to overspill parking in the nearby streets which in his opinion was contrary to policies SH6 and TR9.

Using an industry standard database they had estimated that the traffic would exceed the spaces in the car park leading to overspill parking which would have an impact on traffic flow and road safety. He also felt that the application should have included a proper transport statement. Mr Kendall also said that the amenities of local residents would be affected by noise during unsocial hours.

The main road it was on already had a poor road safety record and he listed the different types of accident recorded over the last seven years. Although a puffin crossing was a condition, with a school situated opposite the site there was the concern that there was the potential for an accident involving a child crossing the road by not using the crossing. In his view overspill parking would also increase the likelihood of an accident involving a child.

The first floor was only accessible via a stairwell, so he felt that this meant the application wouldn’t comply with part M of the building regulations, Disability Discrimination Acts and the Equality Act 2010. Although this was not a material planning consideration he asked why would they approve a scheme that would breach building regulations? He urged the committee to refuse the application.

Matthew Brooke (of Edgeplan, the Manchester based agents) replied on behalf of the applicant Alfa Trustees. He referred to the officer’s recommendation to approve the application and that it was an underused site. Mr Brooke said that a superstore would create jobs for local people and was a substantial change from the earlier refused proposal.

There were a lot of highways related conditions from the puffin crossing and officers could go further and put in yellow lines. He felt that the scale of development was correct but they were aware of traffic accidents in Wallasey Village. Mr Brooke said that the first floor of the store would not be accessible to the public and used for staff use only. He finished by asking the Planning Committee to approve the application.

A ward councillor, Cllr Leah Fraser also addressed the Planning Committee. She started by saying that she had asked officers for a copy of the traffic survey, but she’d been told over the phone that a survey hadn’t been done. Therefore Cllr Fraser felt the officer’s assertions in the report weren’t backed up by evidence. She’d asked how the estimated traffic level figure was arrived at. Cllr Fraser had been told that the figure was calculated using the proposed floor area.

In her opinion if parking would be contained solely in the car park she estimated that each customer would have to park, shop, pay and leave within ten minutes. This wasn’t likely to happen so overspill parking in the surrounding streets would result due to the under provision of car parking. She said a figure of twenty full-time staff had been given and that the parking needs of staff would further exacerbate the parking issue. As an example of this she said that at the site visit one of the Planning Committee had had to park on double yellow lines and there had only been fifteen on the site visit.

Cllr Fraser said that the overspill parking would affect the residents in sheltered accommodation at Granville Court as there were regular visitors and ambulances going to and from there. Customers would also park outside the nearby residential properties and the residents would see a decrease in the amenities they’d come to reasonably expect to enjoy.

She asked how the new store would employ disabled staff if the first floor was inaccessible for disabled people? Residents were also concerned about the noise of deliveries and air conditioning. The previous use of the site in her opinion had been an important buffer between commercial premises, however she didn’t consider a Tesco as a buffer.

Further concerns of hers were that there would be overlooking from nearby flats of the service area and deliveries from 7 am in the morning. Although a new store might create new jobs, Cllr Fraser felt jobs would be lost as some remaining shops would end up closing. She referred to the over a thousand people who had signed a petition against despite it being widely publicised. Cllr Fraser was amazed that the report did not include the results of a traffic survey and referred to the estimated vehicle movements and the “tremendous opposition” to the proposal. She asked the Planning Committee to refuse it on the grounds that it was contrary to policy SH6 and that the impact of vehicles and footfall had not been assessed.

The Chair invited the Planning Committee to discuss the application.

Planning Committee – 21/6/2011 – Part 1 – Introductions, application for a store in Noctorum

Present: Chair (Cllr Elderton), Cllr Mitchell, Cllr Clements, Cllr Hayes (Paul), Cllr Boult, Cllr Johnson, Cllr Kenny, Cllr Mooney, Cllr Realey and Cllr Kelly.

The meeting started with the Chair apologising for the meeting starting over five minutes late. He welcomed everyone to the meeting and asked those present (including officers) to introduce themselves.

He then asked for declarations of interest or party whip. None were declared. The minutes of the last meeting were agreed. Cllr Boult asked why an application had not been received (in reference to the minutes). The Chair thanked Cllr Boult for his question and said he would arrange for it to be handed out. Cheryl Barry said she would make sure it was done. The minutes were agreed.

Site visits were requested by Cllr Hayes for item 14 (APP/11/00449 – 24 Dibbinsdale Road, Bromborough – Rear 1st floor extension) and item 18 (APP/11/00449 – 24 Dibbinsdale Road, Bromborough – Rear 1st floor extension). This was agreed, so site visits will be arranged and the items deferred to another meeting for a decision. The Chair made it clear to anybody present that decisions on these items would not be made until then.

The Chair then asked for permission to rearrange the order of business to reflect the numbers of members of the public present. This was agreed and the first item to be considered was item 6 on the agenda – APP/11/ 00065 – Townfield Close, Claughton – Demolition of an existing petrol filling station and erection of Class A1 retail unit.

Following a petition and an objection, the application for a takeaway at 46 Hoylake Road, Bidston which can be viewed on this map here has been turned down.

The reason given for refusal is below:-

" The proposal is within 40 metres of a residential dwelling located within a designated Primarily Residential Area and is considered to present potential for noise and disturbance to the amenities that the occupiers of neighbouring uses can reasonably expect to enjoy. The proposal is thereby contrary to Policy HS15 and SH4 of the adopted Wirral Unitary Development Plan and the associated Supplementary Planning Document 3 - Hot Food Takeaways, Restaurants, Cafes and Drinking Establishments. "

Once again it shows that when residents stand up against unwelcome developments in their local area, Wirral Council will turn down applications. I hope however in the near future that this empty shop (and the one next door to it) will be brought back into use.

At tonight’s Planning Committee meeting (starting at 6pm in Committee Room 1/2 at Wallasey Town Hall) another planning application unwanted by local residents is on the agenda, which is application APP/11/00065 for the demolition of existing petrol filling station and erection of a Class A1 retail unit. The report suggest to councillors that they should approve this application, despite the petition from over a thousand households against it. Certainly it will be the most well attended and debated item on tonight’s agenda. Interestingly (and unusually) the application has a qualifying petition for and against the proposal.

Arriva and the tale of the new bus stop at which Arriva buses won’t stop (for 5 months!) – Hoylake Road/Compton Road, Bidston

As regular readers of the Bidston & St. James Focus know, Merseytravel recently responded to a campaign we ran (on behalf of local residents of Beechwood) for extra bus stops on Hoylake Road near the Wirral Tennis & Sports Centre.

The one on the North side of Hoylake Road (opposite Compton Road) is fine and buses are stopping at it. Both stops now have timetables in too.

At the end of June I met with a representative of Merseytravel and Wirral Council on site. There was some concern about the effect of parking and traffic from Compton Road. However since a road of houses off Compton Road was demolished to make a park for Bidston Rise there’s been much less traffic coming into and out of Compton Road (which is short and only has houses one side). Both Merseytravel and Wirral Council agreed there would be no road safety issues as long as the bus stop didn’t obscure a drive on Hoylake or affect sight lines. At this point (a few yards from a set of traffic lights the traffic would be moving slowly anyway).

The bus would be fine stopping on the double yellow lines here and the no loading sign wouldn’t apply to a bus.

However a local resident recently stopped me in the street and told me that Arriva buses were not stopping at the Hoylake Road/Compton Road stop on the South side of Hoylake Road.

Originally Merseytravel had planned to put this stop further along Hoylake Road, but the resident outside whose house it’d be objected on grounds of parking and privacy. So instead it was sited nearer to the double yellow lines/no loading at Compton Road/Hoylake Road.

The resident said she had tried to get off Arriva buses at this stop, but they wouldn’t let her on/off, with the driver insisting it wasn’t a stop. However other operators such as Avon that use this route were stopping here. This sounded odd to me, so I wrote to Arriva.

Back in July all operators on the route (including Arriva) were written to about the proposed pair of new bus stops. This is what the Managing Director of Arriva wrote on the 16th July 2010 (before the bus stop was put in):-

Should existing bus stops be moved, Mr. Finnie would be more than happy to continue using these to aid access to the Tesco store for our customers. However, this would have to be fully risk assessed to ensure that these stops could be used safely

Bear in mind the existing bus stops weren’t moved, but new ones were added! A risk assessment was done by Wirral Council.

Arriva wrote to me again in a letter dated 23rd February 2011. In this they quote “The manager of Birkenhead depot has investigated and advised the following. Our drivers have been instructed not to serve this stop until we have carried out a full safety assessment on it. We apologise for any inconvenience this may be causing, but it is essential for the safety of our passengers, our drivers and other road users that this is completed before it is used. The stop will then be served once we have registered this additional stop with the Local Authority as we are required to do so.”

So, to summarise Arriva won’t stop their buses at a new bus stop which has been in place for 5 months. It’s already been risk assessed by Wirral Council and Merseytravel and been found to be a suitable site for a bus stop. The timetable insert (provided by Merseytravel) gives people the impression the Arriva services stop here. Today I took some photos of the stop and recorded a video to try and explain to Arriva (and the public) why they aren’t stopping here!

Hopefully Arriva will have some common sense in the near future and/or carry out their “full safety assessment”. I’ll be writing to Simon Finnie, the General Manager at Birkenhead (and back to Steven Hill) and taking him up on the offer of a site visit and Merseytravel if they wish to come.

I did make a one minute video of myself at the bus stop explaining the above, but the traffic seems to have drowned me out! When out this morning, I did bump into the resident who seemed pleased that someone was taking an interest in the problem. However she was walking someone to school and couldn’t chat long.

When I clear up the audio (or dub over it) I’ll post it on this blog. On a point of local history, when I was a teenager the secondary school used to play hockey on the astroturf pitches at Wirral Tennis & Sports Centre in the Winter and Spring term. As the school day finished at the Wirral Tennis & Sports Centre we were expected to make our own way back home as the school minibus only took a few back to the school gates (the school minibus took twelve, but about a hundred boys in my year did sports here each week arriving in a coach). In 1994-1996 I could have done with these extra bus stops (especially in the cold Winter!) as it would’ve saved me a few minutes walk after the slog up the steep hill with sports gear from the sports centre.

However, the main reason behind these stops is to help Beechwood residents who visit Tesco by bus to shop. These extra stops save about 3 minutes walk along Hoylake Road (which with heavy bags of shopping can be tiring for the elderly or disabled).
