Above you will see a somewhat youthful photo of myself campaigning in January 2008 for improvements to Birkenhead Park Train Station (in relation to the stepped ramp that passengers have to use to and from the platforms).

These steps cause problems for wheelchair users, cyclists and mothers with pushchairs as there is no lift at this train station.

What was the Upper Tribunal decision in [2019] UKUT 305 (AAC) (Brace v Information Commissioner and Merseyside Fire & Rescue Authority)?

                           

I won my Upper Tribunal (Administrative Appeals Chamber) appeal, which has been some good news in the last week. It means the earlier First-tier Tribunal costs decision award of £500 in favour of Merseyside Fire and Rescue Authority has been set aside and has to be re-determined.

The case reference number is [2019] UKUT 305 (AAC) or Brace v Information Commissioner and Merseyside Fire and Rescue Authority. I won on two points of law (one information rights, one welfare benefits rights).

Wirral Council’s Cabinet (including the Cabinet Member for Regeneration and Growth Cllr Tony Jones pictured above) will be deciding at a meeting on 4th November 2019 to “in principle” buy around two dozen shops in Milton Pavement and one shop at 13-15 St Werburgh’s Square from Mars Pension Trustees Limited (Mars Pension Fund).

The Cabinet will also be deciding “in principle” whether to add the Birkenhead Market site to its Wirral Growth Company joint venture with Muse Developments. Cabinet will also be deciding whether to remove the Allport Lane Car Park in Bromborough from the Wirral Growth joint venture following opposition to plans for housing on Allport Lane Car Park.

Above is an invoice I requested and received during the 30 day public inspection period. The invoice is from University of Liverpool to Wirral Council for £18,600 (£15,500 + VAT) and is for “settlement for three commissioned reports on the relationship between demographic change and demand for new housing”.

Last month I quoted from the permission to appeal given to myself in March 2019 by Upper Tribunal Judge Nicholas Wikeley on two grounds. As a final decision is yet to be reached and the matter is sub judice comments are turned off.
