Continues from Cllr Lesley Rennie refers to proposed Saughall Massie fire station site in green belt as “a piece of scrappy land”.

CLLR JEAN STAPLETON (Lead Member for Finance, Assets and Efficiencies) representing Wirral Council: I would definitely go with the Chief’s recommendation and I concur with Councillor Rennie but I would suggest also Lesley you might have a word with your colleagues in West Wirral because there’s an opportunity for them here to show some political leadership in the community to help them, I hate to say but get their priorities right for humanity’s sake!

Labour’s Councillor Tony Smith and Councillor Phil Davies have submitted an amendment to the Conservative’s notice of motion on Lyndale School. Although it’s an amendment it retains only a sentence and a half from the original motion. If Labour’s amendment is agreed the text below shows how it’ll change the original motion. Text in the original motion that is deleted by Labour’s amendment has a line through it and extra text added by Labour’s amendment is in bold.

THE LYNDALE SCHOOL

Council, having regard to the support given to the campaign to keep the Lyndale School open by the public of Wirral, resolves that:

1. It is the firm belief of Council that the Lyndale School should remain open, and in order to bring to an end the anguish and uncertainty suffered by pupils and their parents and carers, calls upon Cabinet to confirm that the school will remain open when Cabinet next meets.

2. Council recognises the unique and caring environment provided by the Lyndale School to children with profound and multiple learning difficulties. Council acknowledges the value of this provision and affirms its belief that such provision should remain at the Lyndale School.

3. Council instructs officers to work with the Wirral School’s Forum in order to investigate how the funding of Wirral’s Special Schools can more closely reflect the will of Wirral’s residents, as expressed by the huge support given to the Lyndale School: that the quality and scale of provision for children requiring the services of special schools in Wirral should continually strive to improve and be in no way diminished.

Council believes that it would be premature to take a view on the future of Lyndale School without taking into account the outcome of the comprehensive consultation process which took place recently. Any statements in favour of a particular outcome run the risk of predetermination.

Council therefore notes the views contained in this motion and agrees to refer it to the special meeting of Cabinet on the 4th September. Cabinet will consider all options relating to Lyndale School together with the outcome of the consultation exercise at that special meeting.

However the predetermination rule was abolished on 15th January 2012 when section 25 (prior indications of view of matter not to amount to predetermination) of the Localism Act 2011 became law.

As readers of this blog will know I’m a great believer in openness and transparency. Elections are already pretty open and transparent processes with many of the major documents published as a matter of course throughout the election period. One of them that isn’t though is a candidate’s nomination papers. Each candidate in a local government election for a councillor has to fill out a nomination paper, get the signatures of ten electors in the ward they’re standing in, sign another piece of paper saying they agree to the nomination (including having this witnessed) and include with their nomination papers three pieces of legislation that detail reasons why a person could be disqualified from being a councillor (and sign a declaration to say they’re not disqualified).

During the election period from when the last date for nominations has passed to polling day any member of the public can ask to inspect the nomination papers (during working hours) and ask for copies. During this period I emailed Wirral Council’s Returning Officer Graham Burgess with such a request and ten days later (on polling day) received them. Each file has a copy of each candidate’s nomination papers, candidate’s consent to nomination and the various pieces of legislation that they’re required to include.

Oh and before anyone and asks if I’m related to the proposer and one of the assentors on the Lib Dem candidate’s papers as their surname is also Brace, I am. They’re my parents. The links to the nomination papers are listed alphabetically by surname. If you see anything crossed out and initialed by the candidate, the election office at Wirral Council will (if requested) check to see if the candidate has filled it out correctly and it’s a valid nomination. If they suggest a change, the candidate is usually asked to initial it to show it hasn’t been altered by anyone else. Candidates are also required to include their date of birth on the candidate’s consent to nomination as there’s a minimum age limit that a candidate can be.

During the election campaign there are strict limits on what each candidate can spend on their campaign, included in the limit are amounts spent by third parties such as the political party that nominated them. The limit if memory serves me correctly is set at £600 + 5p per an elector and candidates (and their agents) have about a month after the election to submit a detailed election expenses claim of money spent and where it came from. I’m not sure how much interest there would be in how much each candidate spent and the source of their funds. Once an election expenses claim has been submitted they are open to public inspection at Wallasey Town Hall for up to two years, although if you want copies Wirral Council can charge. If you’d like me to write in the future about the election spending in the Upton by-election and the source of the funds for each candidate then please leave a comment.

The winning candidate is also required to also state the source of the funds for their election campaign in the Register of Interests which is published on Wirral Council’s website in answer to the question “The name of any person, other than a relevant authority, who has made a payment to you in respect of your election or any expenses incurred by you in carrying out your duties?”. If anyone reading knows what is meant by “relevant authority” please leave a comment as I presume it is meaning that councillors don’t have to include in answer to this question the allowances they get for being a councillor? I think councillors are allowed up to a month after their election to answer the questions in the register of interests as currently (on the 12th November) Cllr Patrick’s page on Wirral Council’s website has no link to a register of interests page.

Wirral Council – Wirral Council 23rd May 2011 – Part 12 – speech (Cllr Adrian Jones) on leader motion

Cllr Adrian Jones then said he hoped people would support the position that the Conservatives almost sought to prolong. He thanked Cllr Lewis for the gracious way [he referred to Labour in his speech] and his past association with Pat Hackett. He asked if Ian Lewis was willing to revise that. Cllr Ian Lewis replied that he wasn’t that desperate.

The Mayor said [following advice from the Borough Solicitor Bill Norman] that it was safest to have a separate vote first to remove the leader and then one on who the new leader would be rather than the motion as a whole.

The first vote was to remove Cllr Jeff Green and Leader of Wirral Council. This vote was along party lines.

Labour councillors (for) 30
Conservative councillors (against) 26
Lib Dem councillors (abstain) 9

So the vote was carried by four votes and Cllr Jeff Green was removed as Leader of Wirral Council. The next motion was to choose Steve Foulkes as leader of Wirral Council. A card vote was requested. The voting was against along party lines.

Conservative councillors (against) 26
Lib Dem councillors (abstain) 9

So the vote to appoint Cllr Steve Foulkes as Leader of Wirral Council was carried by 4 votes. In total from the start of the meeting it took 98 minutes to get to this point!

The Mayor asked Cllr Steve Foulkes if he accepted the nomination to be Leader of Wirral Council. He did.

Cllr Rennie next to speak said “If it was true [in relation to the Foulkesworld Twitter account] she was really worried, however she thought it was the product of a twisted mind. She said there had been signs of progress and that never before had the Council, staff, officers and residents worked together. She said they had run things in an open and transparent manner and hoped it would continue. Never in [Wirral Council’s] previous history had there been such a wide consultation exercise. The wishes of the people had been carried out or if impossible they had been written to. The next administration had to engage openly and honestly. Cllr Green’s leadership had supported a strong and able Cabinet with the support of the Liberal Democrats. However not here today were three Lib Dem former Cabinet members [Gill Gardiner, Bob Moon, Simon Holbrook]. She was concerned that a new administration would take Wirral Council back to the “bad old days” driven by dogma.

She said whenever a party is in government that members of that party who are local councillors suffer. She referred to John Major telling Conservative councillors in 1995 to take a sabbatical and that it may be a while. After 24 years, Wirral Council was Conservative led, run for the people of Wirral. She took a dim view of the Lib Dems and said there were not nine empty seats as there had been in 1991. She said she couldn’t imagine they were elected to Wirral Council to sit on their hands. Cllr Rennie repeated they were not elected to sit on their hands, but thought perhaps they had lost the glue that kept them together under the strong leadership of Simon Holbrook, deputy leader Gill Gardiner, Bob Moon and Stuart Kelly (who had been to one Cabinet meeting). She said it would be a shame to be tearing things apart when they had been willing to challenge when necessary.
