While much of the news focus has been on the large petition in opposition to changes to Hamilton Square, a report by Cllr Adrian Jones to a meeting of Wirral’s councillors on Monday evening outlines further detail on Neptune’s plans for Birkenhead.

His report states:

A number of other major developments are ongoing, including:
 
  • Negotiations are ongoing with Neptune Developments for the sale of three sites at Europa Boulevard to provide a replacement swimming pool and fitness suite, Budget Hotel, Food court and Fast Food Drive-through. Allied to this as Phase 2 will be the grant of an intermediate lease of
    Birkenhead Market to Neptune to safeguard its continued operation, with a view to the eventual grant of a restructured lease to facilitate the development of a smaller market which will, in turn, release land for the reconfiguration of The Grange.

  • The proposal to establish the Isle of Mann University ICT Faculty in Birkenhead is still being worked on. This will utilise the Conway Building and Municipal Building in Cleveland Street. Proposed Heads of Term have been prepared in anticipation of confirmation from the University that funding is in place.

In other words, Wirral Council plan to grant Neptune an intermediate lease of Birkenhead Market, then "develop" a smaller market so that some (or all) of where Birkenhead Market is at present can be sold to become part of the Pyramids and Grange Shopping Centre.

Meanwhile across the road from Birkenhead Market, Wirral Council look set to lease the Conway Building to what’s down in the report as the "Isle of Man University", but is more likely to be the Isle of Man College at the University of Chester.

Wirral Council’s Cabinet will meet next Thursday evening to discuss further cuts to Wirral Council’s budget for the 2016/17 year. Councillors are expected to agree to a public consultation on £2.5 million of budget options as well as a 4% council tax increase. Cabinet is also expected to agree to a staff consultation on budget options such as reducing the pay rise from 2% to 1%.

The consultation will run from the 18th December 2015 and finishes on the 29th January 2016. At the end of the consultation Cabinet will propose a budget to be voted on at a meeting of all Wirral’s councillors.

The nine budget options that Cabinet is expected next week to start a consultation on start on page 16 of this report to Cabinet and are:


  • Community Safety (£367,000) – litter enforcement was recently outsourced to Kingdom Security and this proposal would see the same happen to dog fouling enforcement, Wirral Council hope to increase income to the community safety service from landlords and schools.

  • Discretionary Housing Payments & Advice (£406,000) – this proposal would see Wirral Council only covering rent shortfalls to people in hardship to the amount they receive from the government, it would also see the end of Wirral Council providing welfare benefits advice.

  • Girtrell Court service re-provision (£155,000) – Girtrell Court provides short breaks for carers of adults with physical and learning disabilities, this proposal would see that service provided by the private sector instead of directly by Wirral Council.

  • Highways Maintenance and Road Safety (£320,000) – This proposal means Wirral Council would only use the money it receives for highways maintenance, only 100 out of 300 grit bins would be filled and school crossing patrols would be reviewed.

  • Leisure Centres and Golf Courses (£641,000) – Discounts and free access would be removed, such as free access for long serving Council staff, foster carers and families, free swimming for those under 18 in the school holidays and free swimming for the over 65s between 9am and noon.

  • Libraries Re-provision (£203,000) – Transferring up to 12 of Wirral’s libraries into "community ownership" (run by volunteers rather than paid staff).

  • Parks Community Partnership Working (£108,000) – Increasing the role of community organisations and volunteers in parks maintenance and looking to increase parks income.

  • Charging for the Pest Control Service (£30,000) – Charging landlords, business and residents who can afford to pay for dealing with rats.

  • Charging for the Garden Waste Service (£196,000) – Increasing the brown bin charge from £35 a year to £40 a year (but with a £5 discount if paid online).

So to summarise the proposed cuts (along with a 4% council tax increase) are to dog fouling, community safety, covering rent shortfalls for those in financial hardship, axing the welfare right service, the short breaks for carers service, highways maintenance, grit bins, school crossing patrols, free swimming for children, free swimming for pensioners, free leisure access for some Council staff, transferring many of Wirral’s libraries to be run by volunteers, having more volunteers involved in parks maintenance, charging for dealing with rats and increasing the brown bin charge by £5.

In 2013, Wirral Council’s Cabinet on the 7th November decided to award the Highway Services Contract to BAM Nuttall (which started on the 1st April 2014). BAM Nuttall won the contract out of three companies that bid for it and they replaced the previous contractor Colas. The contract runs from 2014 to 2018 and has an estimated value of £30 to £33 million (£6 to £6.6 million a year). At a meeting on the 7th November 2013 Wirral Council’s Cabinet spends less than two minutes deciding on awarding the £30 to £33 million Highway Services Contract to BAM Nuttall (that agenda item starts at 1m 40s)

This year was the first year I could request a copy of the BAM Nuttall contract during the audit and I’ve scanned in the first 83 pages (of a very long contract). The Highway Services Contract is for:

the provision of standby and call-out, reactive and preventative maintenance on all parts of the highway, public car park and coastal defence infrastructure for which Wirral Council is responsible, including: carriageways; footways; gully cleaning and drainage; street lighting and electrical services; traffic signs and road markings; street and coastal defence furniture; bridges; subways and retaining walls and sea wall and accesses; together with snow and ice clearance; including precautionary salting except for
 
maintenance of traffic signals equipment and their electrical supplies, all maintenance and improvement schemes estimated in value at over £250,000 and the provision of gritting vehicles and road salt.
 

The documents below cover the parent company guarantee with Koninklijke Bam Groep N.V. (no that’s not a spelling mistake but the name of a company based in the Netherlands), then the start of volume 1 (part 1) of the contract documents which covers form of agreement, bond (unfortunately the details haven’t been filled in on this), form of tender, declaration, what information is considered commercially sensitive for freedom of information requests, information assurance, insurance certificate (with AXA Corporate Solutions), parent company letter guarantee, contract data part 1 (data provided by Wirral Council, partnering information, more contract data on the optional parts of the contract (pages 62-63 add optional clauses about FOI requests) which includes matters such as TUPE, subcontracting, intellectual property, data protection, human rights, the Local Government Ombudsman, price adjustment for inflation and other optional clauses/changes to the contract).

The optional contract clauses added about FOI requests seem to mean that if a FOI request is made for information about or relating to the contract, that Wirral Council will contact BAM Nuttall and ask it to make representations if it wants information to be withheld. Page 24 of the contract classes the following parts of the contract as "commercially sensitive" which are Contract Data Part 2, The Price List and the Fee Percentage Schedules.

There are many decisions on the agenda of Thursday’s Cabinet meeting and many are about changing how Wirral Council does things to be more like how they’re done at Liverpool City Council.

I’m going to write about one proposed change that could be described that way and explain the problems it might cause.

Item 9 with the exceedingly dull title of Executive Arrangements and Pledge Champions (the latter doesn’t mean some councillors are pledging to stop drinking alcohol) proposes that from next year instead of Cabinet meeting in the evening, Cabinet meetings will be on Monday mornings at 10.00am.

From a public relations perspective I can see why they’d do this. For example each year for the past years I can remember, a rabble rousing trade union representative has turned up to a Cabinet meeting with a lot of supporters (I think one year so many it had to switch to the Civic Hall) which would be nigh impossible to do if your trade union members were at work on a Monday morning.

If Cabinet meetings had been on Monday mornings when a decision was made about Lyndale School, that would’ve meant the staff (including the headteacher) or the children affected couldn’t attend the meeting where politicians decided about their school.

On the plus side, public transport during the day means councillors would able to get to and from meetings without relying on taxis, but that’s not the point as strictly speaking public meetings are for the public not for the councillors.

Essentially having a Cabinet meeting on Monday mornings will rule out the public turning up or at least the ones with jobs. Of course some councillors have jobs too, but their employers have to give them paid time off work for this sort of thing.

Now the decision states that the Leader can decide to change the time of the meeting away from Monday morning. However if the agenda is published, the date and time of the meeting is set, then a topic on the agenda kicks up a fuss with large numbers of Wirral residents, how will it be possible to change the time of the meeting without confusing people as to when the meeting is?

Of course going back to public relations, a meeting on Monday evening would mean reports of Cabinet decisions could make the next edition of the Wirral Globe. I would be interested to hear people’s thoughts on changing Cabinet meetings to Monday mornings as there may be issues with this change that I haven’t thought of.

The issue of what happens to the former Rock Ferry High School site was on Wirral Council’s Cabinet agenda for a decision at last Thursday’s meeting.

Included with the reports for the meeting were details of the public meetings held. In case anyone has forgotten, one of the public meetings sparked a series of bizarre stories in the Liverpool Echo about what happened in the lead up to the 2015 General Election. The story continues with a Wirral Globe article and a Green Party investigation clearing its members of what Frank Field accused them of doing (which is that exceptional case of a party sticking by and believing its own members and not throwing them to the wolves when an influential member of another political party complains).

Maybe the Green Party aren’t like other political parties who take a "guilty until proven innocent (and we the party will decide upon what prove innocent means)" approach and grill the party member when a complaint happens. No I’m not referring to the recent suspensions of councillors in the Wirral Labour Group… but my own personal experience of the Lib Dems taking seriously a party political complaint about me from former Labour Cllr Harry Smith (sent to both me and the party with a Wirral Council "With compliments slip").

In essence his complaint was that when he was Vice-Chair of the Pensions Committee (the Pensions Committee manages the Merseyside Pension Fund worth £billions which has over a hundred thousand people either pensioners or employees part of it) I put in a leaflet to people in the Bidston & St James ward that he didn’t go to a meeting that reported the Merseyside Pension Fund had dropped by hundreds of millions of pounds.

His complaint was that he decided to go on holiday instead (he didn’t send a deputy to the meeting) and that my leaflet wasn’t unfair personally to him because it led to people going to his surgery and asking him questions (because and I mean this with a lot of dripping sarcasm of course, obviously the last thing a local councillor is paid a generous allowance of thousands of pounds a year for is to actually have to deal with the public and see what I write below for why the Labour Group of 2015 takes a different view on representing the public to Harry Smith). Therefore former Cllr Harry Smith (around the time of a one week suspension as a councillor for not apologising properly for bullying) wanted disciplinary action taken against me by the Lib Dem Party for telling the Bidston & St James residents the truth.

Ultimately the Lib Dem Party (who then were always very keen to curry favour with other political parties) gave him and his fellow Labour party members their way in 2011 but the Lib Dems (under a lot of pressure to get rid of me) did it so badly, the Birkenhead County Court ruled one of the Lib Dem councillors, the local Birkenhead party and indeed the whole Lib Dem Party had broken the law in doing so.

Thus proving that politicians are terrible at realising that there are legal limits on what they should or shouldn’t do. As many will know, the political class have an arrogant view at times that rules and laws apply to everyone but them! The MP expenses scandal showed that.

However to be fair (and hopefully as balanced as I can be) to the Lib Dem Party, their view is that an unlawful decision still stands and court orders should be flouted (and then the Lib Dem Party wonders why it lost 49 MPs at the recent General Election?)

As former Cllr Harry Smith didn’t get his way over that complaint he tried to stop filming of a public meeting of Pensions Committee meeting stopped, telling others on the Pensions Committee it I was because I was a member of a political party (at the time a lie as I wasn’t a member of the Lib Dems then, due no doubt in part to his complaints and moaning about me "blotting my copybook" as one party member put it). A rather young fellow Labour councillor had the gall to tell him such a point was irrelevant which really got him going, however I am digressing into stories from yesteryear. It was suggested to me recently that I should be more positive (however remembering how former Cllr Harry Smith used to be is enough to spoil anyone’s good mood)!

Returning to the Cabinet meeting, Cllr Adrian Jones explained that Rock Ferry High School had closed in 2011. He outlined the process that had to be followed if the Rock Ferry High School and the playing fields were to be used for a different purpose and that this required government approval from the Minister. He summarised the efforts so far on finding an alternative educational use for the buildings which unfortunately had not panned out.

The costs (business rates and security) of managing the vacant site were costing Wirral Council money. The original intention had been for Wirral Council to sell the buildings and playing fields. However following public consultation and "opposition" to disposal of the site, a compromise position had been found or as Cllr Adrian Jones put it, “However, we are a listening Council and following extensive public consultation it was evidenced that there was a very significant amount of opposition to that proposal.”

He went on to say that this option would produce a reduced capital receipt to Wirral Council, but this would allow the Residents’ Association to bring forward proposals for the playing fields and woodland.

Cllr Adrian Jones proposed the following recommendation.

"It is recommended that:

17.1 Cabinet approves the submission of the application to the Secretary of State for Education for the disposal and change of use of the former Rock Ferry High School.

17.2 Approve the mixed use option for the site as outlined in 6.4

17.2 Approve officers to progress development proposals to site (area A) for residential development in accordance with local planning requirements

17.3 Work with the newly formed Rock Ferry Residents Association to bring forward proposals for the management of the site (areas B and C)"

For the purposes of information 6.4 (which recommendation 17.2) of the report refers to states:

6.4 Take account of local views and develop a mixed use option for the site

(i) area (A) i.e. the main school site, development for housing

(ii) areas (B) and (C) the former playing field site could be considered for community asset transfer for continued sport use and open space. This is of particular interest to the residents in the area and plans for the management and development of the area are being considered. Football clubs in the area have expressed an interest and there are opportunities for obtaining grant funding. This area was previously designated as school playing fields and the only community use was through lettings agreed with the school, general community access was not endorsed.

Areas B and C are detailed in the report. Areas B and C are playing fields and area A covers the buildings and part of the playing fields.

Councillor Chris Meaden pointed out that it was in her ward and referred to "slightly heated meetings" that she had attended and that they’d listened to the residents, changed the recommendations so that the woodland was kept and the sports field. She thanks the residents of Rock Ferry and that "we hope we’ve proved ourselves to you"

Cllr Meaden went on to thank Jeannette Royle (Senior Manager, Asset Management), David Armstrong (Assistant Chief Executive) and David Ball (Head of Regeneration) for attending the meetings and she wanted to thank them for their support and their efforts in listening to residents.

The recommendation were agreed by Cabinet.
