Response from Cllr Jeff Green on Improvement Board issues

                        

Following the Improvement Board meeting held in public last month, exactly a month ago I emailed Graham Burgess (Chief Executive), Cllr Phil Davies (Leader of the Labour Group), Cllr Jeff Green (Leader of the Conservative Group) and Cllr Phil Gilchrist (Leader of the Lib Dem Group) about the progress on the commitments made at that meeting.

I indicated in that email that I would publish replies (unless the author stated otherwise) so that the public know what’s happening.

Nearly two weeks ago I received a reply from Cllr Jeff Green (which is below). It made sense to wait a little longer for replies from the others so that they could all be published together. As a month has gone by and I haven’t received a reply from another of the other three, below Cllr Jeff Green’s reply I include my original email. I haven’t changed the colour used for text in Cllr Green’s email, as Leader of the Conservative Group I think it would come as no surprise to people that he writes in blue!

Thanks for your email. Please accept my apologies for the delay in responding.

I think my record is pretty clear on this matter: I have always pushed for an un-redacted copy of the AKA report to be published and have been obstructed at every turn.

Sunlight is the best disinfectant and the sooner the light is shed on the actions of those responsible, the better.

A brief update on some progress I have made on the appendices to the Anna Klonowski Associates Limited report. Appendix B (the Equality and Human Rights Commission Letter dated 29th December 2010) has been helpfully supplied by Paul Cardin.

Appendices C (the first improvement plan) and D (the Care Quality Commission Inspection Report) I discovered at the weekend had already been published by Wirral Council as part of a Cabinet agenda from over three years ago.

Appendix G (the Standards for England decision notices) have already been published too and I am not asking for appendix L (medical information relating to Martin Morton). This just leaves appendices E, F, H, I, J, K, M, N, O, P and Q.

With regards to my supplementary question about appendix P (minutes of the DASS Monitoring and Development Sub Group Meeting), as this was the only meeting minutes referred to in the appendices list I made an error. My question should’ve referred to notes in a different appendix, which contained the notes of the Charging Policy Working Group held on the 22nd August 2005, my apologies for any confusion caused.

I would be interested in receiving an unredacted copy of the notes and accompanying table (unredacted in respect of the three councillors who were there if deleting the redaction of officer names is an insurmountable problem) of the Charging Policy Working Group. The only councillor I am able to ascertain was there so far was Cllr Pat Williams.

With regards to appendix E (charging policy for supported living services) as this was a policy I presume it was agreed by councillors. It therefore can’t be claimed that a policy falls into one of the reasons you gave on Friday for not publishing the appendices. Publishing it would help the public understand the series of events that happened and whether it was an unlawful policy implemented by officers or whether officers acted outside of an agreed policy.

I am sure you (apart from Cllr Gilchrist who couldn’t be there) remember the mood of the public at Friday’s meeting and how although Wirral Council has changed in some ways that convincing the public of that change will be a difficult challenge.

I asked the questions I did on Friday because if the public were informed fully about what actually happened, then knowing what happened and the chain of events that led to it would allow the public to decide for themselves whether the changes made since then would prevent a reoccurence in the future.

Until there is more disclosure of what went happened, despite Wirral Council’s desire to “move on” some members of the public will still want to know and the details of who, what, why, where and when which at the moment are answers that are only filled with speculation.

I hope this sets out my position and I look forward to a more detailed response about the future publication (or the reasons against publication) of the remaining appendices to the Anna Klonowski Associated Limited report and the question about removing the redactions of councillor and officer names (at Head of Service level and above) in the Martin Smith report.

Cllr Lesley Rennie asked, “Brian, I’m really pleased to note that Council are actually drafting a litter reduction strategy and clearly part of that strategy will be a key focus on dog fouling within that, but surely wouldn’t you not agree with me that the best way to discourage dog fouling is to increase not axe the number of dog wardens that we have? And therefore by increasing you may be able to improve the number of prosecutions for those that actually flout the law in that respect but I have to say Brian, unfortunately under your Cabinet leadership, the number of prosecutions have been nothing short of appalling.”

Cllr Paul Doughty asked, “I’d just like to ask the question, following a very interesting presentation by the Leader of Sevenoaks Council on Saturday a discussion was had with himself where he congratulated Wirral Council on the successful implementation of our garden waste scheme and also was pleased and able to see how low the cost of the service is when in his authority, a Conservative authority, the cost is £43 a year? And also can I congratulate the Cabinet Member on the percentage increase of garden waste composition announced that continues to be implemented?

Cllr Phil Gilchrist asked, “My question is on the issue of garden waste, I wonder if the Cabinet Member has an idea or an estimate how many brown bins are likely to be returned and what is likely to be the fate of the brown bins in terms of their recycling or reuse and what is he going to do with the brown bin mountain?”

Cllr Janette Williamson asked, “Given the Council’s very difficult financial position can you afford to implement the Wirral Coastal Strategy?”

Cllr Tony Norbury, “This question relates to the Coastal Strategy. I welcome the proposals for Council to explore funding options in relation to the Coastal Strategy. Given the serious level of flooding that has been within the Borough recently to people’s homes and land, can the Cabinet Member advise when and where work has been done in relation to this issue with United Utilities and the environmental officers?”

Cllr Stuart Kelly asked, “I liked what the Cabinet Member said in her report about the commissioning of services, but is the Cabinet Member embarrassed that Wirral was named and shamed over the summer as the council with most contracts with most care homes on Merseyside using zero hour contracts for their employees?

Is she also aware the response that was given to me when I submitted a Freedom of Information request which asked how many contractors for Wirral Council providing Council services have used zero hour contracts? The reply I received was Wirral Council does not have a policy on the use of zero hour contracts and that Wirral Council would not hold information about the resource management of our contractors as how they manage resources is a matter for the contractor. Does she still stand by that reply on behalf of the Administration and believe that resource management is not a matter for the Council when considering that we place contracts for care services for vulnerable people and when will we see a policy on the use of zero hour contracts by companies Council contracts with to provide services?”

Cllr Simon Mountney asked, “The Cabinet Member in her report details changes to residential and day services, which have been delivered on time and within Budget. Can she explain what effect the department’s failure to hit the performance indicator for permanent admissions of older people to residential & nursing care homes, as reported to Cabinet on Thursday will have on the department’s Budget and can she please give me an assurance that the same rigour and process are applied to the alleged payment of £48,000 is as being applied to the Martin Morton issue please?

Cllr Anita Leech asked, “I was delighted to hear from students and staff when I recently visited Moreton Day Centre which falls within my ward, that the much smaller group of students remaining have been able to carry out alternative and increased activity and participate in the local and vibrant community as well as the usual centre based activities and they are happy with the proposed move to other.. and I’d like to personally thank the staff of the day centre, parent and carer’s groups and the officers of the Council for the hard work they’ve put into reviewing this unfortunate closure as we’re providing what appears to be a facility that could be improved upon for the students remaining. I would however like to ask the question with regards to the hundred people who transferred from the services from Moreton. Did one to one consultation take place as was indicated to identify the needs of the individual and were their places allocated accordingly? And secondly how was the transition for the students, were there any issues?”

Cllr Phil Gilchrist asked, “Can I ask the Cabinet Member about the domiciliary contracts and the care of the elderly? What monitoring is undertaken in Wirral to ensure that Wirral isn’t subject to some of the problems identified recently nationally where mistakes were made by very limited time available for clients?”

Cllr Chris Jones responded, “Thank you very much for your questions, it’s nice to know you’ve actually looked at my report.

I suppose I can answer the two together really about the domiciliary contracts. If you had read the second page of my report, you’d see that we’re trying to support the principles of the ethical care charter, which looks after the workers as well as some looking at the people who need care. We are actively encouraging people and the firms who are going to tender to not use any zero hours contracts and we’ve asked for a report from the HR department to find out how many contractors that are generally used by the Council are using these zero hours contracts.

Stuart’s commissioning of services, we’re doing an awful lot of work with the NHS which has been a huge problem in the past I think we’re working far more closely together now around intermediate care and all the rest of it. The zero hours contract I’ve already answered Stuart. Chris Begya and Jacqui Evans’ reports are, Jacqui Evans is undertaking and is personally involved with the commissioning work and is making great inroads into that and looking at savings as well as improving quality of care for the people of the Wirral.

Anita asked about Moreton Day Centre. Everybody who attended Moreton has had a one to one .. they also had a .. visit to their new centre which we felt was really important. About seventy people have actually transferred, mainly to … which is a really popular choice mainly around .. moving anyway and to Heswall but others have gone to Pensby and Eastham as well but increasing places at Dale Farm taking extra visits to Dale Farm, and generally people have settled really well. Some of the staff have moved with the service users so .. a little bit of continuity of care for those users. Thank you Mr Mayor.”

The meeting was held in the rather cramped Committee Room 2 (which has been made even smaller by the recent building work) on a very hot Summer afternoon. Cllr Phil Davies started the meeting by asking people to introduce themselves (everyone had a nameplate though). So those that were there introduced themselves which included Cllr Phil Davies, Claire Fish, Julia Hassall, Chris Begya, Sue Green, Cllr Chris Meaden, Julie Webster, Cllr Phil Gilchrist, Annette Roberts, Dr. Abhi Mantgani (who complained that his name was misspelt on his nameplate), Fiona Johnstone and various others.

There were apologies given for Graham Hodkinson, Cllr Jeff Green, Cllr Tony Smith and various others. No declarations of interest were made and the minutes of the previous meeting were agreed.

The first main item was a demonstration of Puffell. Although the agenda showed that the presentation would be given by Dr Jennings and Mr. Jackson, the presentation was given by people from Ice Creates Ltd, who gave a (yes I’m sure you can guess already) Powerpoint presentation about Puffell. One of the interesting things they did say was that in their market research they’d found people had a “distrust of local authorities and government”, which was why “you won’t see a local authority name on Puffell”. The rest of their talk basically seemed to be a sales pitch. They told the audience that since its launch twenty-five days earlier, 622 users had registered on Puffell, 224 were following them on Facebook and 131 following on Twitter (just for comparison I currently have 361 followers on Twitter). They also went into the demographics of who was using it, as well as their aims (convincing people to reduce their alcohol intake, cut down on smoking etc).

There was a question asked about their use of the Wirral Well database, they said they used it when people searched for things but the website was only a tiny bit of Wirral Well. Another of the board said they were working with Ice Creates Ltd and were “quite excited by it”. Someone else asked about accessibility issues for patients with disabilities such as arthritis, which they said they were working on. He also asked about how they were measuring their outcomes and was told that they have the ability to track behaviour change, such as a patient losing weight. Cllr Phil Davies asked about those on the Wirral that don’t access the internet and was told they could access the internet at the libraries or on their mobile phones. He also asked if they collected postcode data and was told they did.

The meeting then moved onto a report on Budget transfers section 256, which had two additional documents, 5AA and 5B. Unfortunately at this point the building work starting making a racket right outside Committee Room 2 and due to there being no microphones, it was very difficult to hear what Dr. Abhi Mantgani was saying. His report was about joint working between the Clinical Commissioning Group and Wirral Council in the area of social care (such as community equipment and adaptions, telecare, crisis response services, meeting increased demand etc). The amount allocated to Wirral for this for 2013/14 was ~£6.4 million and the Health and Wellbeing Board was being asked to give its support to the proposals. Dr. Mantgani said that one of the uses of the money would be to facilitate discharge of patients so that people could manage their health conditions in their own homes.

Cllr Gilchrist asked about how many numbers of people would be helped by the money? Cllr Phil Davies asked if it was new money and was told no. Other people commented on and discussed this item.

Item six was on the 2013 Spending Review and its appendix. Claire Fish briefly introduced this item, Cllr Phil Davies asked how the money would be accessed and was told they were waiting for more guidance on that by both Dr. Mantgani and Fiona Johnstone. Cllr Gilchrist also asked a question on this item about changes to hospital discharge.

Cllr Phil Davies wanted a written vision of an integrated health and social care system to which Dr. Mantgani replied it was “not something you write on the back of a fag packet” and would require a “lot of work to be done”. After some more discussion the Health and Wellbeing Board moved to the next item on the Long Term Conditions Integration Programme and its appendix. The Health and Wellbeing Board was told of the Pioneer Bid (which was later on the agenda at item 14. Cllr Phil Davies asked a number of questions on this item and referred to the recent LGA Conference, where Wirral had been one of a number of authorities chosen to take part in a pilot of community budgets, which included health and social care integration. Cllr Gilchrist asked a question about case reviews and was referred to pages forty-four and forty-nine in the report. Cllr Phil Davies finished the item by saying, “I mean the thing about the community budgets pilot as well is again there’s no money attached to that, but it’s just that the good thing at the conference, coz it was about the only good thing that Eric Pickles I think that said errm, was it just it just gave you that national recognition err which is good for Wirral to have that to have that. We were the only one in the North West, the only Council in the North West that got included in the pilot, so that’s really good. So well done Eric. Right OK, let’s move swiftly on.” which was followed by laughter and Dr. Mantgani saying, “It’s going to appear on Youtube.”

At this point, although there were another nine items on the agenda, unfortunately I had to leave to go to a meeting of the Regeneration and Environment Policy and Performance Committee.
