Public Question Time 14th December 2015 where I ask a question to Councillor Adrian Jones

In his answer Cllr Adrian Jones states that Wirral Council is being “open and transparent”.

I provide below four pages from what Wirral Council supplied when I requested the Highway Services Contract that Wirral Council have with Bam Nuttall on which millions of pounds are spent each year.

These first two pages (according to the preceding page) are to do with the NRSWA Team (whatever that stands for). This team is described as “a separate team of 4 inspectors monitoring utility works and repeat defects. This team could integrate with the highway teams

Next is an email detailing some last minutes changes to the contract. The unnamed author of this email receives this blog’s first ever Sir Humphrey Appleby award for the sentence “Please find attached a revised copy of P112 of Volume 1, which now includes the omitted Tender Amendment relating to the uplift on rates for Coastal Defence Work in tidal conditions, and an additional page for Volume 3 Method of Measurement to be inserted in the Preamble, which compiles the clarifications issued during the tender period in connection with Price List Bandings into a coherent single document.

I was planning on writing today about the implications of the Comprehensive Spending Review (however that’s something that would really benefit from a very in-depth piece), but Wirral Council have published an interesting document about Cabinet meeting report protocol.

That probably sounds rather boring, but it shows the informal arrangements that everyone knew existed behind the scenes before reports were published are being put on a more formal footing.

Although much of it is probably the rather dry nuts and bolts and let’s face it there will still be people submitting reports late and chairs not following procedures with regards to late reports, it does seem an attempt at least to make what the press and public end up reading at least not full of obvious errors (and I’m not talking about spelling mistakes).

The report does state what I knew already, that the SLT (Senior Leadership Team or senior managers at Wirral Council) see reports before they’re published and have a chance to suggest edits.

Even before each public Cabinet meeting happens, Cllr Phil Davies has a meeting of his Cabinet (called a briefing) which the officers are expected to attend (usually in what’s called the Cabinet Briefing Room behind locked doors at Wallasey Town Hall) where he goes through the entire agenda and matters are discussed in private.

Interestingly, this report shows that the Cabinet briefing is used as a filter and the Cabinet briefing can be used to change the reports that are later published. I presume this practice of writing reports by committee leads to some bits being watered down.

There are also four compulsory steps a report has to go through before the press or public see it. It seems reports have to be run by legal (which makes me laugh considering some of the legal howlers I’ve pointed out on this blog over the years), human resources (which is understandable as many of the decisions are going to have HR implications), finance (again understandable) and the Head of Service (which has been standard practice for years anyway). As there are vacant heads of service posts, in that situation the relevant strategic director signs it off.

However there is one very important group of people this all leaves out, the public. Anyone involved with politics will of course comment and say that the last group of people involved in political decisions are the public.

This is what Wirral Council’s constitution states about decision-making:

13.2 Principles of decision-making
All decisions of the Council will be made in accordance with the following principles:

(i) proportionality (i.e. the action must be proportionate to the desired outcome);
(ii) due consultation and the consideration of professional advice from officers;
(iii) respect for human rights;
(iv) a presumption in favour of openness;
(v) clarity of aims and desired outcomes; and
(vi) Wednesbury* reasonableness (i.e. the decision must not be so unreasonable that no reasonable Council could have reached it, having taken into account all relevant considerations, and having ignored irrelevant considerations).

*This piece is too short to provide an in-depth description of the legal definition but it refers to the case law definition of "unreasonable" which is a reference to a Court of Appeal case from 1947, [1947] 2 All ER 680, [1947] EWCA Civ 1, [1948] 1 KB 223, [1948] KB 223.

Every policy disaster (whether the library closure fiasco which resulted in a public inquiry or half a dozen others I could mention here) has resulted because the public weren’t involved (or were involved/consulted but politely ignored by politicians and officers who had the arrogance to think they knew better) and/or the above principles weren’t followed.

Let’s take the Fort Perch Rock car park charging U-turn as an example. Principle (ii) above states the "consideration of professional advice from officers" yet officers didn’t tell them that if they started charging at Fort Perch Rock car park then the lease the Council had for the Marine Point development would lead to charges at hundreds of spaces at the other currently free car parks.

No, it fell to a local blogger to publish the pages of the lease, a large petition against it of thousands of people and a campaign against the charges from a former Conservative councillor in the marginal seat of New Brighton. This was despite Labour’s backbench councillors warning the Cabinet at at least one public meeting not to go ahead with plans for charging.

Next week, the Transformation and Resources Committee will discuss the high-profile issue of a fire station in Saughall Massie. At the Merseyside Fire and Rescue Authority meeting earlier this year where the decision was made, the petition organiser was given five minutes to speak and a delegation from the Saughall Massie Conservation Society was also given the opportunity to speak for up to five minutes.

Yes, you are probably going to say, this ties in with (iii) above, respect for human rights as article 21, which Wirral Council signed up to when Cllr Adrian Jones was Mayor quite clearly states

(1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.
(2) Everyone has the right of equal access to public service in his country.
(3) The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures.
 

Notice the importance of that word directly or through freely chosen representatives (that is politicians).

The other public bodies I report on either have mechanisms written into their constitution (for example Liverpool City Council has a regular public question time slot at many of its meetings and I’ve mentioned the mechanisms that Merseyside Fire and Rescue Authority has), so people can exercise their rights at public meetings and have their say before the decision is made.

At Wirral Council the public at public meetings get frustrated and heckle instead (then get told to shut up by the Chair or clear off which does show some politicians’ attitude towards the public outside of elections).

The Chair at last night’s meeting (despite his wish to get home in time to watch Coronation Street) tried to let many taxi drivers have their say (some more than once) before the decision to consult on increasing hackney carriage fares was made (if a decision is made following the consultation it’ll mean fares go up in time for Christmas).

Yet if there’s one point I am trying to make from this maybe boring piece about Wirral’s politics, it’s that the public should be more involved and you don’t encourage the public to turn up by expecting them to sit through meetings in silence and not have any influence over decisions that are going to affect their lives.

At the moment taxi drivers have more influence over decisions as there is a Joint Consultative Committee that meets regularly behind closed doors than I do over say Wirral Council’s filming of public meetings policy.

Yes, this probably sounds like as to why it’s a good idea to have politicians, or for the kind of public interest journalism I spend a lot of time doing but the point I’m trying to get at is one that Wirral’s political system doesn’t seem to have quite grasped which is "the will of the people shall be the basis of the authority of government".

At Wirral Council this seems to have morphed in the past to "the will of the officers shall be the basis of the authority of government" (and we expect politicians to rubber stamp decisions we refer to them).

Merseytravel’s (part of the Liverpool City Region Combined Authority) General Purposes Sub-Committee meeting on the 15th October 2015

I’ll start by declaring an interest as I use the car park at Birkenhead North Railway Station regularly.

At a public meeting today of councillors on the Merseytravel’s General Purposes Sub-Committee officers gave an update on projects including an update on what was happening to expand the Park and Ride at Birkenhead North Railway Station.

A Merseytravel officer had the following to say about this, "Birkenhead North, that’s the extended phase for the Park and Ride. Members [councillors] will remember we had some extensive investment in there over a two-year period, around £5.5 million with what was the Park and Ride interchange and the bridge as part of that scheme.

This is the land that we agreed with Wirral that we would take forward for the expansion of the Park and Ride scheme and that scheme will straddle, will commence early next year and will run through probably for about a five or six month period depending on the contractor’s programme when we receive that back."

There are 266 car parking spaces at the Park and Ride at Birkenhead North Railway Station. The work, expected to start next year to expand the Park and Ride will increase this by a further 366 car parking spaces. An increase in car parking spaces will solve the current problem of over parking.

Merseytravel is expected to ask Wirral Council in the near future for a lease of the land for the Park and Ride expansion at Birkenhead North Railway Station to go ahead.

There have been developments recently with a number of stories I’ve written about on this blog so I thought I would give an update for each story.

New Brighton Fort Perch Rock car parking charges

A week ago I wrote a story headlined Over 3,000 people have signed a petition against car parking charges at Fort Perch Rock in New Brighton but what happens next?

Personally I thought nothing further would happen on this story until the September meeting of Wirral Council’s Highways and Traffic Representation Panel. However, since writing that story Wirral Council have issued a press release that’s titled either “Resort parking plans quashed” (when it’s linked to from their homepage) or “Wirral Council leader says no to plans to charge for parking in New Brighton” from the press release.

There is a very interesting quote in the press release from Councillor Phil Davies that states “Cllr Pat Hackett, our Cabinet Member for the Economy, has been meeting with traders and business leaders in New Brighton to discuss the proposals, and they made a powerful case for not proceeding. When we looked at the plan and the possible impact on parking and tourism across the whole of the resort, I made the decision to stop the proposal”.

On the 22nd December 2014, I wrote on this blog When Wirral Council introduces car parking charges at Fort Perch Rock, will 3 hours free parking end for a further 423 New Brighton spaces? (later updating it this year by including the public notice). I published the three pages of Wirral Council’s lease for the Marine Point development at New Brighton that detailed if Wirral Council introduced car parking charges at Fort Perch Rock car park, charges could be introduced at the supermarket car park and the “health and fitness” car park (originally Bubbles was going to be a gym but they couldn’t find a company that wanted to run it as a gym). This was plenty of time before the 2015/16 budget for Wirral Council was agreed on the 24th February 2015 for councillors to change their mind.

An article by Liam Murphy in the Liverpool Echo states “But Promenade Estates, who manage part of the successfully regenerated resort, say if the charges are imposed they would have little choice but to follow suit. This would mean parking charges on the car parks serving Morrisons, The Light Cinema, Bubbles play centre and other businesses.”

So it wasn’t just a “possible impact” but a “probable impact”. On the 9th December 2014, Councillor Phil Davies proposed and voted for this resolution at a Cabinet meeting, that was seconded and agreed by all councillors including Cllr Pat Hackett:

“We also feel that it is appropriate to introduce a modest charge for parking at Fort Perch Rock in New Brighton up to 6 p.m.”

“67.We also feel it is appropriate that a modest charge for parking up to 6 pm. at Fort Perch Rock in New Brighton should be introduced.”

So Councillor Phil Davies U-turned on his own policy! However it begs the following question, if the reason for stopping the proposal is the impact on parking across the resort (as stated in the quote from Cllr Phil Davies), then why wasn’t he told about the impact on parking elsewhere in Marine Point by his own officers before Cabinet made the decision? As you can see below from the first page of the lease that has the clauses about parking, Wirral Council is the landlord for the Marine Point development.

I’ll also draw readers attention to a leaflet from April 2015 from Tony Pritchard (the Conservative candidate for New Brighton ward and former councillor opposing parking charges at Fort Perch Rock car park.

The mysteriously missing Employment Tribunal judgement

I wrote previously about my failed attempts to get a copy of an Employment Tribunal judgement in a case involving Wirral Council. I have since been told by a clerk to the Employment Tribunal that the case hasn’t concluded and that there will be a final hearing listed for November 2015. After the final hearing I can request a copy of the judgement.

Merseyside Recycling and Waste Authority and DHA Communications

An earlier story headlined Why did Merseyside Recycling and Waste Authority pay a PR agency £650 + VAT a day? which involved Merseyside Recycling and Waste Authority paying a £1,625 monthly retainer has led to a statement from Merseyside Recycling and Waste Authority which I will quote here:

“I confirm that the Authority no longer retains DHA Communications and the use of their services ceased as of March 31st 2015. The Authority recognises that some parts of its relationship with DHA Communications was not fully formalised in some time periods. The Authority has reviewed its practices in relation to this type of contract and has now put in additional measures and monitoring in place to ensure that an accurate audit trail is retained.”

Wirral Council’s Cabinet agree to continue council tax freeze for 2015/16

                                       

Last night’s Cabinet meeting included Labour’s fifteen page budget recommendation to Council on the 24th February so the items below are just some highlights. Although the Wirral Council element of Council Tax is being frozen at 2014/15 levels, the Council Tax for Wirral residents may still go up because of a rise in the amount for Merseyside Police.
