Following the Council meeting on the 20th October 2014 when Labour councillors voted to go ahead to the next stage on closure of Lyndale School, Wirral Council started on the 22nd October 2014 its four-week consultation on closure which finishes on 19th November 2014. After this consultation is finished, the results of this consultation will be reported back to Wirral Council’s Cabinet.

I am unsure at this stage which Cabinet meeting the outcome of this four-week consultation on the closure of Lyndale School will go to. At the time of writing the following Cabinet meetings are scheduled for after the end of the consultation:

27th November 2014 | Special Meeting, Cabinet | Committee Room 1 – Wallasey Town Hall | starting at 6.15pm
9th December 2014 | Cabinet | Committee Room 1 – Wallasey Town Hall | starting at 6.15pm

Personally as the 27th November is a special meeting and occurs exactly one week and a day after the consultation ends, I would guess that this will be the public meeting at which the outcome of the second consultation and a further decision will be made. As agendas and reports have to be published at least a week before holding a Cabinet meeting, 27th November 2014 would be the earliest date it could be held.

However if this matter is called in after the Cabinet decision after the consultation and there are more delays in the process taking it past February 2015, it would make setting the 2015-16 Schools Budget problematic.

The reason is that if a final decision on closure is not made before February 2015, a contingency of funding Lyndale School from the proposed date of closure (January 1st 2016) to the end of that financial year (March 2016) would have to be added to the schools budget for 2015-16 of ~£140,000.

There are legal limits on when the 2015-16 Schools Budget has to be decided by and as there were delays earlier this year, I can see the next stages moving as fast as is humanly possible at Wirral Council (which when you do things as fast as you possibly can inevitably leads to mistakes).

However I would like to point out that the current consultation has at least one contradictory fact in Surjit Tour’s letter to me of the 30th September 2014 (although Mr. Tour obviously has to rely on what he’s told and take it at face value as I seriously doubt (although I could of course be wrong) that Mr. Tour visited Lyndale School and started asking children how old they are). I’ll explain what I mean (with references):

Here is the 13 page response from Mr. Tour. In it he states:

“8. Background

8.1 Lyndale School is a special school providing specialist educational provision for primary aged pupils, the majority of whom have Profound and Multiple Learning Difficulties (“PMLD”). There are 21 pupils currently on the roll, nine of whom will be transitioning to secondary school by the end of the 2015/16 academic year. The declining number of students admitted to Lyndale over recent years has drawn into question The Lyndale’s financial viability for the future.”

When I read Surjit Tour’s reply a few weeks ago, I thought it a bit odd that out of the eight year groups at Lyndale School, that almost half the school (nine out of twenty-one) would be in the final year and therefore leave to secondary school in September 2015 and not be affected by the proposals to close it. It seemed unusual at the time.

Mr. Tour repeatedly states throughout his letter that I have not provided evidence of my facts. However the evidence that proves him wrong on this was in fact published by Wirral Council on the 22nd October 2014 as part of the current consultation. Here is the table published as part of the Complete Proposal. The table is Pupil admissions and numbers.

Number in each year group in December 2015 assumes that all current pupils remain on roll, that no new children are admitted to F1 (Nursery) in September 2015, and that no further children join or leave other year groups from October 2014 onwards.

As you can see from the table above there are two children (one boy and one girl) in year 6 at Lyndale School who will start at a secondary school in September 2015, not nine as claimed by Surjit Tour in his letter.

This then has an effect on other numbers used in his letter.

According to Surjit Tour 21-9 = 12 (twelve pupils left in September 2015)
According to Julia Hassall 21-2 = 19 (nineteen pupils left in September 2015)

So who do I trust to give the correct figure for pupils at the Lyndale School? The Head of Legal and Member Services (Surjit Tour) or the Director of Children’s Services (Julia Hassall)? They can’t both be right, can they?

On the balance of probabilities because:

a) Julia Hassall actually works in the area of Wirral Council with responsibility for schools
b) that it seems highly unlikely that nine of the twenty-one pupils at Lyndale School (spanning eight year groups) would be in the last year group

I’m veering towards believing Ms Hassall (although I never really relish taking sides when two people in Wirral Council’s senior management team are giving out contradictory information).

There is also the point that someone could have misread the table above and used the total number of girls presently at the school (nine) instead of the number of pupils in year six (two) and given that information to Surjit Tour to use in his letter.

Isn’t it weird though that when Wirral Council makes a mistake like this, it always coincides with their world view of a “small school” (in this case seven pupils less than it actually is)?

If Wirral Council can’t get basic facts such as how many pupils of what age are at Lyndale School right, is it any wonder that there are problems of trust between those associated with Lyndale School and Wirral Council?

I wrote yesterday about “Is Lyndale School under threat just so Wirral Council can provide a further £2 million to a company that already has plenty?” , so I thought today I’d write a little more on the topic.

Last year, Wirral Council wanted to introduce a banding system for the extra costs at special schools. However at the last-minute they withdraw their application to the Secretary of State to do this.

Despite the fact it actually couldn’t be implemented in 2013-14, the policy was agreed by a close 8:7 vote at a call in meeting back in February 2014, so if it gets implemented next year for band 5 children at Wirral Schools the top up element for band 5 children is capped at £16,000 (this is in addition to the £10,000 each school receives per a child).

If however a child with special needs based on the Wirral is at a school outside Wirral or at an independent special school (such as West Kirby Residential School) on the Wirral this £16,000 upper limit at least by my reading of the policy doesn’t apply.

When questioned at the Coordinating Committee meeting on October 2nd 2014 and asked to explain this unfairness, David Armstrong (Assistant Chief Executive) explained that because independent schools are run as a business, Wirral Council pay more to independent schools because such businesses are run to make a profit.

I used to go to an independent school, called St. Anselm’s College. Between the ages of 12 and 14 the school complained bitterly at people like myself whose places were funded by Wirral Council because we were all told many times that the school got (if memory serves me correct nearly 20 years later so I may be a little rusty on the figure) £100 per a term less than this was actually costing them and this meant in effect they had to cross subsidise the education of people like myself by putting fees up. Across about 35 pupils, this was a deficit of about £10,000 a year at 1992 prices.

The school felt (or maybe influential parents on the board of governors felt) it was unfair to expect the well off parents to subsidise the education of other students and they chose to opt out of the local system becoming grant maintained in the mid 1990s (as grant maintained schools no longer exist it is now called an academy).

In other words even when I was actually a child in the Wirral education system (and too young to vote), I was being made aware of how angry (and let’s face it political) schools got at Wirral Council’s funding formula a whole two decades ago! This may sound awful to write like this but to a lot of large schools, each child at the school meant £x,xxx a year, which meant management trying to balance the books each year veered towards seeing children as a source of income and forgot that people prefer to be treated as people and not a line on a balance sheet. Each year children got old enough to leave, so there was the usual advertising in the local newspapers and open evenings each year to try and persuade parents to pick that particular school for their children.

That is the mistake that I sadly feel politicians and upper management at Wirral Council have made. It is very easy to just see Lyndale School as a line on a balance sheet and that there’s an underspend in the budget for closing schools and try and spend that budget. The debate has sadly got too much about money and dare I write the unthinkable “nobody really understands the full complexities of education funding anyway”?

It’s harder to look at the social fabric of what makes up a school, not just the staff and children at it but its place in the community. To give one example of this there’s the history of a school and the fond place in the hearts of people who no longer have children there but did at one stage. These are not factors that can never truly be measured by accountants at Wirral Council. Unlike other consultations, the consultation responses made to the Lyndale School closure weren’t published by Wirral Council, although you can read them as an exclusive on this blog.

In the recent past there was a move to close Ridgeway High School (a secondary school) here in Birkenhead. Ridgeway was the controversial political issue back then (I even remember speaking on TV about it), there was a large petition of thousands against closure handed in to Wirral Council and a call in meeting held in the Council Chamber which a lot of people associated with the school attended. It was controversial, but in the end in 2009 the Labour/Lib Dem Cabinet did a U-turn and Rock Ferry closed instead. The rest as they say is history.

Back then Cllr Phil Davies was the Cabinet Member for Education and was quoted as saying this about that U-turn in the Liverpool Echo, he said that it was a “pragmatic decision, based on the clear view from Ridgeway that they do not want to be part of these options” and “We are not going to force the school to close and be part of a review which they now no longer wish to be involved in.”

In the interests of balance I will point out the same article has a quote from Cllr Stuart Kelly saying he is “delighted” and this quote from Cllr Jeff Green “The Cabinet really must start thinking things through before making such critical decision on the future for Wirral residents. The anguish and alarm the decision to close Ridgeway created was wholly avoidable by a simple application of common sense, it would also have prevented this subsequent embarrassing climb down.”

Now, five years later when somebody else is Cabinet Member for Education (Cllr Tony Smith) and Cllr Phil Davies is Leader of the Council where have those fine principles of pragmatism that Cllr Phil Davies displayed back in 2009 gone? Where is the politician’s desire to actually represent the views of thousands of people that signed a petition against closure of Lyndale? Try replacing Ridgeway in those quotes with Lyndale and you will get the following two quotes (the kind of words I’m sure plenty of people wish Cllr Phil Davies would actually say):

Cllr Phil Davies that it was a “pragmatic decision, based on the clear view from Lyndale that they do not want to be part of these options” and “We are not going to force the school to close and be part of a review which they now no longer wish to be involved in.”

and Cllr Jeff Green “The Cabinet really must start thinking things through before making such critical decision on the future for Wirral residents. The anguish and alarm the decision to close Lyndale created was wholly avoidable by a simple application of common sense, it would also have prevented this subsequent embarrassing climb down.”

Certainly if those words were said today (and for the sake of everyone involved in this let’s hope something similar is said in the near future!), Cllr Jeff Green’s position would seem to be entirely consistent over time if you compare Ridgeway in 2009 to now. Ridgeway of course is and was back then a much larger school that Lyndale is, so therefore had the clout back then and political influence to make sure it was never closed.

Why does the Cllr Phil Davies of 2014 over Lyndale not display the same sense of pragmatism he showed over Ridgeway in 2009? What’s happened in the last five years? I know U-turns are embarrassing for politicians to make, but he should take a really long, hard look at one of his predecessors as Leader of the Council Cllr Steve Foulkes who refused to U-turn on library closures until the Minister launched a public inquiry and learn the lesson that that it can be disastrous for the Labour Group’s reputation to rely on the “professional” advice of Wirral Council officers and listen to those Wirral Council officers more than the views of many Wirral residents. Aren’t politicians supposed to be there to represent the public in the political process?

Wirral Council’s Coordinating Committee (which comprises fifteen councillors, two parent governor representatives, a Catholic rep, is required to have an Anglican rep but at this stage I don’t really know why there isn’t one), met on the evening of 2nd October to reconsider the Cabinet decision of 4th September 2014 which made a decision to consult on closure after the “consultation” earlier this year. Neither of the two parent governor representatives (who have speaking and voting rights) nor the Catholic representative (who also has speaking and voting rights) were present.

According to correspondence received hours before the meeting, a senior Wirral Council officer stated they have previously tried to persuade the Church of England to appoint an Anglican representative, but have failed and refers to this as merely an “anomaly”.

Here is the list of the people who made the decision itself and were there on the night, including matters such as whether they are spokesperson, Chair, Vice-Chair and which political party. I have listed people who are on the committee first, it is unclear to me who the Conservative spokesperson was or whether it was Cllr Bruce Berry or Cllr Leah Fraser who was deputising for him:

So to summarise, that is eight people on the committee and seven deputies substituting for people who are on the committee but chose to send a deputy in their place for reasons best known to themselves.

Ultimately the decision taken at the end of a long meeting (there were a series of votes at the end on whether to uphold the decision or refer it back to Cabinet to reconsider based on concerns councillors had) was to uphold the Cabinet decision of the 4th September 2014. This was taken on a majority of 9 votes to 6. Each of the alternative recommendations failed on a vote of 6 to 9. The alternative recommendations which were lost were proposed by by Cllr Phil Gilchrist (Lib Dem spokesperson) and Cllr Steve Williams (Conservative councillor).

Labour councillors (9) voted to uphold the Labour Cabinet decision. The joint votes (6) of the Conservative councillors (5) and Liberal Democrat spokesperson (1) voted against Labour’s recommendation.

Although six councillors were in favour of not implementing the Cabinet decision of 4th September and referring it back to Cabinet with their concerns, they were outvoted by the nine Labour councillors who voted against.

This means the Director of Childrens Services, Julia Hassall can now go ahead to the next stage of closing the Lyndale School which is a short consultation (lasting about a month). Even if Wirral Council were taken to court over this matter, Surjit Tour made it quite clear in a formal letter to me that they would not pause the process and would just carry on doing this, regardless of many outstanding legal concerns. In the interests of transparency at this point, I refer to the exchange of letters between myself (mainly the one of 8th September 2014) and Surjit Tour in this matter about the possibility of legal action through the courts.

He is of course entitled to his opinion on this matter, so am I. He has to work within the policy and budget framework of Wirral Council and is in a politically restricted post, I have to consider other concerns such as financial, legal, political and commercial (it’s complicated basically).

Following this consultation Wirral Council’s Cabinet will make a further decision at some future point on closure of the Lyndale School. As it was such a long meeting and negotiations over potential access to Wirral Council’s wi-fi network for live broadcast of meetings as they happen have stalled, only part of the footage of the five-hour meeting at the time of writing has been uploaded. You can watch video of part of the meeting below.

On a more personal note and this is just my opinion, I would like to point out (briefly) that politics comprises objective and subjective tests that can be applied when determining decisions.

Nobody expects politicians to be experts as they are there to represent the public interest. In certain areas such as law and other areas they have to rely on the internal advice of Wirral Council officers. That is why officers giving advice are in politically restricted posts and can’t really be seen to be taking sides in a party political matter.

Although it would be unlawful to drop Lyndale School’s budget by more than 1.5% under the minimum funding guarantee regulations this year (2014-15) compared to its 2013-14 budget, the government is currently consulting on draft regulations which would remove this current protection under the minimum funding guarantee for SEN places in 2015-16. However there is a current consultation on regulations which cover 2015-16 and the draft regulations put to Parliament may differ from those being consulted on.

In fact you only have to look at how the regulations on filming meetings of Wirral Council changed after the consultation and lobbying by people such as myself to show that that is a distinct possibility.

However how much Lyndale School receive this year for the education of children there and in future years is down to a complicated combination of the Wirral Schools Forum, Cabinet, Council and other factors beyond anybody’s reasonable control. A schools formula is arrived at locally by a combination of the Wirral Schools Forum, Cabinet and Council. This schools formula determines how much each individual school gets each year (and is changed each year).

In essence though, this shouldn’t really be about money. The law allows Wirral Council to close a school, however naturally they have to plan for what happens next to the existing pupils. Some will transfer to secondary school well before the planned closure date of January 2016. This should really be about the children of Lyndale School.

I will recite a little personal history here. My primary school was changed (when I was 10), not because of closure but because my parents had moved three miles away and transport to and from school was taking my mother longer than it was when I only lived a mile away.

Therefore my perception of what happens to a primary aged child when you do this to them, is somewhat clouded by that. Twenty-four years later, I still resent that decision, as I do not feel my interests were properly considered especially considering the fact I would’ve left that primary school within the next twelve months to go to secondary school and that we had moved house many years previous.

I can understand though that it resulted in a reduced carbon footprint as I could walk to the school I was transferred to. It ended up with me being admitted to hospital for a week though and knowing how much that costs makes it a false economy.

The children of Lyndale School are more fragile than I was at aged ten. Wirral Council identify themselves in a Equality Impact Assessment that the disruption will have an effect on the children.

However a letter from their legal department takes the contrary view that any potential risks can be mitigated against. Personally I have no confidence in Wirral Council that the potential risks have been mitigated at this stage, as my feeling is that such detailed planning won’t actually happen until a decision to close (or not close) the Lyndale School has been finally made at some future point. At this stage officers may consider behind the scenes that spending officer time and resources on planning for something that might not happen would not be value for money. However all scenarios should be explored if Wirral Council insists on going down this route.

Considering the high costs already expended by Wirral Council on their plan to close Lyndale School, one wonders if that seemingly large and endless budget allocation had instead been used for keeping the Lyndale School open, whether it would’ve been a better use of public funds. Each time they hold a public meeting it costs thousands of pounds and there have been many of these so far. Such is the price of democracy I suppose which has deliberately made closing a school a long and drawn out process so that a “spanner can be put in the works” to stop it at any one of many stages.

Some people are surprised it has not been stopped before now. However looking at the wider aspects of the way society treats disabled people, prejudice and other matters I am not wholly unsurprised by this course of events.

I’ve rewritten this blog post a few times as it is connected to tonight’s Coordinating Committee meeting about Lyndale School and the earlier Cabinet decision on the 4th September 2014.

The funding formula the government will use for allocating schools funding in 2015-16 hasn’t been decided yet and is now out to consultation.

It seems Wirral Council officers have for nearly a year been predicting what form the regulations will take. If changes are made to the regulations as a result of the current consultation it is also possible that this will change how much funding Wirral Council will receive in 2015-16 for Lyndale School.

Certainly it seems entirely premature at this stage to go through a consultation on closure when there is uncertainty at this point as to the funding regime.

However, where does this leave Lyndale School? Looking through the proposed regulations for school funding in 2015-16 a few things did occur to me.

There is a set amount, a lump sum that each primary school receives irrespective of its size of places or pupil numbers. This six-figure sum will be lost to Wirral Council if Lyndale School closes and would ultimately result in less money being spent on children.

One of Wirral Council’s arguments for closing Lyndale School, is that the £33,470 Lyndale would receive in inclusion funding in 2015-16 would be shared between the other ten special schools who would each receive an extra £3,347 each.

Actually that’s wrong. This is because £33,470 is a full year allocation and if Lyndale was closed, it would be done part way through the year (January 2016 is about three-quarters through the 2015-16 financial year). So Lyndale School would get about £25,102 for inclusion funding in that year, which would leave £8,368. This would then be shared between the ten special schools (if Lyndale closed) who would each receive a further £836.80 each, not £3,347.

This was an error in the Cabinet report to its meeting of 4th September 2014, repeated in Surjit Tour’s letter of 30th September 2014 and repeated in the papers for tonight’s meeting. The effect of which is to exaggerate the financial case for closing Lyndale School. To my recollection the error wasn’t highlighted during the Cabinet meeting on the 4th September 2014. However I’m sure there are possibly many other errors in Wirral Council’s education department’s arithmetic, with regards to Lyndale School funding, which I haven’t spotted yet (who in a twist of irony actually also have a duty to teach children mathematics).

A key meeting of the Merseyside Fire and Rescue Authority will decide on Thursday 2nd October 2014 whether to consult on the closure of Upton and West Kirby fire stations (on the Wirral). Fire officers are asking councillors (which includes four Wirral Council councillors) to agree on consultation on the closure plans.

If politicians agree to a consultation it will run from the 3rd October 2014 for twelve weeks.

One of the more controversial aspects to this closure plan is it involves building a new fire station on Frankby Road, Greasby on a piece of land now owned by Wirral Council (used for a library, children’s centre (there is a current consultation on closure of these run by Wirral Council), community centre and other uses.

Negotiations between Wirral Council and Merseyside Fire and Rescue Authority have been ongoing for some time. If the consultation went to plan and the other two fire stations closed, the site on which the library, community centre and children’s centre would be cleared. In its place a new fire station, library and community space would be built. Indicative floor plans might be available by the date of the meeting on Thursday.

Agreement in principle to a lease from Wirral Council to Merseyside Fire and Rescue Authority has been given by Wirral Council officers, but no action will take place until the consultation has taken place.

After the consultation, a further report will come back to the Merseyside Fire and Rescue Authority in order for a decision to happen. However closing two fire stations will lead to an increase in response times. There will however be a saving in salaries (of about £900,000 a year) by having one fire station instead of two.

Building a new fire station at Greasby will cost about ~3.45 million, however this could be offset by selling the land that Upton and West Kirby fire stations are now on. Mersey Fire and Rescue Authority is hoping to get a DCLG grant of £1.5 million towards the cost of building the new fire station and will hear back from DCLG on that towards the end of the year.

Any difference will be met from reserves built up in part by a underspend in last year’s budget. The capital costs of the project (appendix H) are being kept secret for commercial reasons (whether this is the Fire Authority itself, DCLG and/or a third-party is a little unclear).

Wirral Council now have four representatives on Merseyside Fire and Rescue Authority. These are Labour (3) Cllr Denise Roberts, Cllr Jean Stapleton and Cllr Steve Niblock and Conservative (1) Cllr Lesley Rennie.

Currently the makeup of the committee that will make a decision on Thursday in Bootle comprises up of 16 Labour councillors, 1 Lib Dem councillor and 1 Conservative councillor.
