The nomination period for anyone wishing to stand as a candidate in the elections to become a councillor at Wirral Council closed yesterday. As usual elections in each of the twenty-two wards on Wirral are all being contested. Voters in Greasby, Frankby & Irby ward will elect two councillors due to the recent resignation of Tony Cox. Wards are listed alphabetically, then the candidates alphabetically by surname. If you are unsure what ward you live in you can enter your postcode here or check your polling card.

Although I wrote a blog post about the notice of election for twenty-three Wirral Council councillors about a week ago I haven’t yet written about the notice of election for the eight Members of the European Parliament held on the same day.

Below is the notice of election for the European elections. The constituency for a MEP is the whole of the North West of England which is millions of people who could vote in the election. Also candidates wishing to stand in the European elections have to find a deposit of £5,000. I presume (as in General Elections) the deposit is refundable if those candidates get x% of the vote.

NORTH WEST ELECTORAL REGION

NOTICE IS HEREBY GIVEN THAT:

1. An election is to be held for EIGHT members of the European Parliament for the NORTH WEST Electoral Region.

2. If the election is contested the poll will take place on THURSDAY 22 MAY 2014.

3. Nomination papers are to be delivered to the Regional Returning Officer for the North West, Room 134, Town Hall, Manchester, between 10:00 AM and 4:00 PM from TUESDAY 15 APRIL 2014 to THURSDAY 17 APRIL 2014 and between 10:00 AM and 4:00 PM from TUESDAY 22 APRIL 2014 to THURSDAY 24 APRIL 2014. Forms of nomination papers may also be obtained at that place, during those times.

4. The deposit for each registered political party or individual candidate, being the sum of £5000, can only be made by the deposit of legal tender or by means of a banker’s draft (banks operating in the United Kingdom or Gibraltar only), at the place and during the time for delivery of nomination papers. No other method of making a deposit will be available.

5. Applications to be included in the register of electors or for postal or proxy voting must be made to the relevant Electoral Registration Officer for the applicant’s area. Further information can be found at www.aboutmyvote.co.uk or www.northwestvotes.gov.uk.

6. Applications to be included in the register of electors must reach the relevant Electoral Registration Officer by TUESDAY 6 MAY 2014, if they are to be effective for the election.

7. All applications and notices in respect of postal voting and those in respect of changes to existing proxy voting arrangements must reach the relevant Electoral Registration Officer by 5:00 PM on WEDNESDAY 7 MAY 2014, if they are to be effective for the election.

8. All new applications to vote by proxy (except those applied for on relevant emergency grounds) must reach the relevant Electoral Registration Officer by 5:00 PM on WEDNESDAY 14 MAY 2014, if they are to be effective for the election.

9. On Monday Wirral Council’s Returning Officer started the election process by publishing the Notice of Election (a copy of it is below). Each ward in Wirral will be electing one councillor, except voters in Greasby, Franky & Irby ward who will be electing two councillors and therefore have two votes in the upcoming local elections.

The reason for this is that Tony Cox has resigned. As Tony Cox was less than two years through a four year term of office you may wonder why? The reason is that he’s been picked as the Conservative candidate for the General Election in Newcastle-under-Lyme and he felt that he couldn’t put his full energies into that without resigning as a councillor for Greasby, Frankby & Irby ward. The two Conservative candidates in Greasby, Frankby & Irby ward this year will be Councillor Wendy Clements and Tom Anderson. Tom Anderson was previously a councillor in Upton ward from 2008 to 2012 (with the lowest majority I remember in recent years of only four votes).

The first main item on the Cabinet last agenda was a scrutiny report on individual electoral registration that was referred to it by the Policy and Performance Coordinating Committee at its meeting on the 15th January. The original report to that committee can be read here, along with the scrutiny report as the report on Cabinet’s agenda was just a copy of the minutes of that meeting. It does however raise the question of as there have been five Cabinet meetings since the Coordinating Committee meeting of the 15th January (last Thursday’s was the fifth) why hasn’t it appeared on an agenda before now?

However, Councillor Jean Stapleton the Chair of the Scrutiny Panel addressed Cabinet on the subject of individual electoral registration (the other panel members were Councillor Moira McLaughlin, Councillor Denise Roberts and Councillor Steve Williams whose mug shots can be found on at the bottom of page 14 of the
report). Cllr Jean Stapleton explained what officers had told them they were doing to prepare for individual electoral registration.

In case you are wondering what individual electoral registration actually means, at the moment each year a form goes out to each household annually to confirm who is registered to vote there. However there will be a change (although not until after the next set of elections in May) and voters will be expected to register to vote on an individual, not household basis.

Councillor Jean Stapleton said that officers had told them that based on their test of matching data on the electoral roll with other information held by Wirral Council such as Council Tax information, that it was estimated (across the whole of Wirral) that 89% of people would be transferred to the new register automatically. However this percentage was lower in the “deprived areas” (and although she didn’t explicitly say it the wards that return Labour councillors at elections). She wanted Wirral Council to actively target these areas to maximise the numbers of registered voters and to use the additional funding they had been given this financial year by the Cabinet Office of £100,403 with a further unknown amount expected from the Cabinet Office in 2014/15.

She felt that it should be a high priority in 2014 as she felt that the public were virtually unaware of this change. She said that non-IER registered voters would remain on the register for the 2015 General Election (originally the change was planned to be in place for the 2015 General Election but proved too contentious) and said that once the new register was published on the 1st December 2015 that these non-IER registered voters would be removed. She asked Cabinet to accept the recommendations.

Councillor Phil Davies said, “Ok thanks Jean. I mean I think it’s an excellent piece of work, I think you’ve highlighted I think a key issue really in the report which is about those areas of the Borough where there’s a need to do some targeted work to increase registration. Just to explain a little bit about what form that targeted work might take out of interest?”

Councillor Jean Stapleton said that there would be opportunities to target particular areas, even to drill down to postal districts “within a deprived ward”. She said it was a fantastic opportunity for Wirral Council to go round “knocking on doors”. Cllr Stapleton said that they pass “swathes of doors” where people weren’t registered to vote and she said it was an opportunity to talk to those people. She said she was “delighted with the opportunity” but that the real worry she had was over the register used at the 2016 elections.

Councillor Ann McLachlan, Cabinet Member for Governance and Improvement said, “Yes, thank you Chair. I mean first of all I’d like to say how I welcome this report and I’d like to start by congratulating the members of the panel on a really excellent piece of work. When we set up the policy and performance committees, this is exactly the kind of work that we hoped would be done as scrutiny work.

Thanks Jean, Councillor McLaughlin Moira McLaughlin and Denise Roberts and Councillor Steve Williams for plodding through and it really is an excellent piece of work. The report it does really highlight you know the areas of deprivation that we are going to target them and I’ve noticed that there is issues around possibly using local media, radio, ICT and of course you know the key role of elected Members is in highlighting .. you know those crucial tools to ensure that we want to make sure people are retained on the register because although there’ll be this changeover to the new register, people are going to be asked for additional information. Where that information around National Insurance numbers and dates of birth is not there, if people don’t respond and react to that they could fall off the register.

So it’s really key that we ensure that we you know as elected Members, but as Council play a role in that and I hope that some of that work that we’ll do in you now using the money that’s being fully funded, is being fully funded by the government I hope we’ll use that work in terms of making sure that we use you know ICT, use local media to ensure that we do update, to ensure that people aren’t but I notice as well in the report that you highlight the work and preparation that the Council has already done and in terms of data matching we came out quite above the average really on the work that’s been done so far and we’ve got in place an electoral management system and I think we’re working closely with other authorities on this, you know … Merseyside wide authorities so there’s some kind of project plan for the media to ensure that when the Electoral Commission fund and launch their campaign that we’re running with our campaign locally.

So you know I think as I said this is an excellent piece of work, a fully funded piece of work. I fully endorse the report and completely accept the recommendations that are there which I’m sure we’ll want to do and a fabulous piece of horizon scanning work so you know we need to pass on our thanks to the members of the panel and I’d like that recorded thank you.”

Cllr Jean Stapleton responded to Cllr Ann McLachlan’s comments. Cllr Phil Davies referred to recommendation three in the report that “Chairs of constituency committees are requested to include IER
as a topic for discussion as part of their forward planning in the New Year”. He said that they would have to pass this request on as not all constituency chairs were councillors.

Cllr Phil Davies went on to describe it as an “excellent piece of work” and congratulated her and the team behind it. Cllr Jean Stapleton congratulated the officers and Cabinet agreed to endorse all the recommendations.

Recently there has been a lot of anger expressed by the public over a proposed 11% pay rise for MPs from 2015. Wirral Council’s councillors (unlike MPs who after the expenses scandal agreed that the Independent Parliamentary Standards Authority would set their pay) still decide on what they’re paid. In fact the legislation states that when voting on this matter they don’t even have to declare an interest!

In a parallel with MPs, in order to keep the base amount that councillors get low over the years and presumably avoid a similar kind of bad publicity that the proposed pay rise for MPs is receiving, the base amount for being a Wirral Council councillor is currently set at £8,712 (equivalent to ~168/week). There are (in many cases similar to the MP’s expenses system) a bewildering amount of ways that Wirral Council’s councillors can increase this.

Each year what Wirral’s council’s councillors are paid is published on Wirral Council’s website. These figures I link to are from 2012/13. As Wirral Council’s financial year finishes about a month before we usually have elections (apart from next year when local elections will be combined with the European elections) there are some small amounts for people that were councillors for only a few weeks in that year or were elected part way through the financial year. If you discount these part year amounts, the amounts range from the basic £8,712 to £30,437.60 for the Leader of the Council Cllr Phil Davies.

In addition to the amounts in that list councillors receive extra if they represent Wirral Council on certain outside bodies such as Merseytravel or Merseyside Fire and Rescue Authority. Both of these bodies decide themselves on their own allowances scheme.

So what is proposed at Wirral Council? Well periodically the allowances scheme is reviewed by the “Independent Panel on Members Allowances”. The Independent Panel doesn’t meet in public and there isn’t any public consultation on its findings.

Reading its report its conclusions are based on the input of councillors (a census of councillors on pay, other authority’s independent reports and the direct input of Cllr Phil Davies, Cllr Jeff Green and Cllr Phil Gilchrist) as well as senior officers at Wirral Council.

In distinct echoes of the Independent Parliamentary Standards Authority proposed 11% pay rise for MPs, Wirral Council’s independent panel recommends “When the financial climate allows, due consideration should be given to reinstating the 5% austerity cut in the basic allowance.”

However the rest of the recommendations remain relatively uncontroversial and are unchanged to what they were previously. The allowances for the Mayor and Deputy Mayor (of £10,700 and £1,500) remain the same. Both the Mayor and Deputy Mayor attend a lot of different events during their year in Wirral. The Mayor also has to chair Wirral Council Council meetings. Keeping order and making sure Council meetings don’t degenerate into people speaking being drowned out by heckling, requires courage, tact and a sense of humour as well as the respect from other councillors.

About a year ago, much of the work of the Employment and Appointments Committee (such as appeals against dismissal, grievance hearings etc) was delegated to the Chief Executive Graham Burgess so the special responsibility allowance of its Chair of £2,751 is proposed to be scrapped.

The Chairs of the new Constituency Committees won’t receive any extra for their role, but this will be reviewed once they are “up and running” (suggested for October 2014). Pensions for Wirral’s councillors have been ruled out until the end of the current Government/Treasury consultation exercise.

The panel estimated that the average councillor spends twenty-three hours a week on the role and that any future increases in allowances should be linked to staff pay.

Finally I’ll make a number of what could be termed party political points (*breaking a general rule of mine on this blog and no I’m not a member of a political party despite rumours to the contrary) about councillors allowances and elections.

The arrangements that the political parties on Wirral have with their councillors (as far as I know and please leave a comment to the contrary if I am wrong) is that their councillors contribute a share of their allowances to their political party. This money is then used at election time (in conjunction with sources of other money) by that political party to help their candidates win votes from the public and get re-elected.

This is why there is only one independent councillor on Wirral Council (who was elected as a Lib Dem). Any independent candidate would have to either be independently wealthy in order to fund their own campaign or have a wealthy patron in order to stand a chance financially against the taxpayer funded political parties.

It leads to a system of safe seats on Wirral where one political party holds all the seats in a ward for a very, very long time. Voters are in such wards can become apathetic of voting as they feel the election is a foregone conclusion and their vote won’t make a difference to the outcome. The only thing that tends to shake things up are boundary changes.

Personally I view this current situation as bad for democracy (although those who it benefits may disagree). As much as some politicians may not like scrutiny, they make better decisions more in tune with public opinion when other political parties (and individuals) are scrutinising them. If a politician feels they may in the future either suffer the embarrassment of losing an election (or not be reselected by their party as their candidate) it can lead to them working harder in the public interest for the full term of their office (and not just at election time).

We have a system on Wirral where politicians’ future career prospects are based on reselection by their party who then goes on to fund their campaign (subsidised by the taxpayer). Comments on the system of democracy we have are welcome.

P.S. I’ll also formally announce something here I decided a while ago. I won’t be standing as a candidate in the Wirral Council elections in 2014.

Writing this blog and publishing the footage of public meetings (only possible because of media and consultancy work I do that is better paid than writing about Wirral Council) is in my view more in the public interest than the commercial work I do.

To be honest with you I’m much better at being a blogger with the freedom to say things as I see them rather than get bogged down in the party politics of Wirral (which is tarnished by a past reputation for doing things for party political reasons rather than acting in the public interest).

On a related matter the proposed legislation which includes a clause about filming Council meetings (the Local Audit and Accountability Bill) reaches its third reading and report stage tomorrow (17th December 2013). These are the last of its stages in the House of Commons.

There are two more stages to go after that before it becomes law. Once it becomes law there will be secondary legislation on the filming issue (the Local Government Association wants to be consulted on it), which will hopefully make the current unsatisfactory situation much clearer.

If the only result of starting this blog (and no it wasn’t just me getting angry about this issue but other people too I’m not going to take the sole credit despite this blog being cited in one of Pickle’s press releases about it) is that a change in the law will mean councils (and other bodies spending public money) in England won’t have any spurious legal grounds be able to justify banning audio or video recording of their meetings, then hopefully the greater openness and transparency that results will be a greater contribution to democracy than I could have ever achieved had I been elected as a Wirral Council councillor. Personally I would’ve preferred to try out the human rights arguments about the filming matter in a court of law, but a change of legislation is a better long-term outcome.

On the subject of courts of law, the libel case involving Jacqui Thompson (the woman who was arrested for filming a Council meeting in Wales) has a hearing in the Court of Appeal today. Update 14:40 Permission to appeal was refused. There have been reports in the press about the legality of Carmarthenshire County Council’s paying for its Chief Executive Mark James’ legal costs in this case.

In more local legal matters the issue of Wirral Council’s request for a possession order for Fernbank Farm will be decided at Birkenhead County Court some time in the New Year.
