The Chair, Cllr Ann McLachlan (Labour) apologised for starting the meeting late.

1. Declarations of Interest

The Chair, Cllr Ann McLachlan Labour asked for any declarations of interest. None of the six councillors (including the Chair, Cllr McLachlan Labour) made any declarations of interest.

2. Minutes of the meeting held on the 20th August 2012

The minutes of the Investigation & Disciplinary Committee on the 20th August 2012 had been published on Wirral Council’s website.

The Chair, Cllr Ann McLachlan asked if the minutes were agreed?

Cllr Lesley Rennie disputed the minutes and stated they were missing that she had said at the last meeting that she wanted it minuted that she wanted Richard Penn to be invited to the meeting.

She pointed out that this was missing from the minutes.

The Chair, Cllr Ann McLachlan said it was fine as Mr. Penn was “in the building” [see above photo of Richard Penn waiting in lobby, Ground Floor, during agenda item 4 (not the room the meeting was being held in)]. She thanked Cllr Lesley Rennie for pointing this out. There were no more comments on the minutes of the meeting held on the 20th August 2012, so the Chair moved the meeting onto agenda item 3.

3. Exclusion of the Press and Public

The Chair expressed her opinion that the press and public should be excluded from the meeting for agenda item 4. She expected the two members of the public to leave, however a member of the public waited for the Committee to agree with this opinion. The reason she gave was that it related to “staff”.

The two members of the public left.

4.  Statutory Officers Preliminary Investigation – Preliminary Report/Report from the Independent Investigator

The Committee received the reports from Chris Hyams (Proper Officer), Tony Williams (Acting Employee Relations Manager) and Richard Penn (Independent Investigator).

Only Chris Hyams and Tony Williams were present at the start of this item.

The reports were about the suspensions of Bill Norman, Ian Coleman and David Taylor-Smith, following the decision made at the Investigation and Disciplinary Committee meeting of the 20th August 2012 (agenda item 4).

Cllr Paul Doughty (Labour, Chair) opened the meeting.

Cllr Jeff Green (Conservative, spokesperson) said that Cllr Peter Kearney (Conservative) had just qualified as a solicitor. A joke was made.

Cllr Paul Doughty (Labour, Chair) welcomed people and asked for declarations of interest. No declarations of interest were made.

Cllr Paul Doughty (Labour, Chair) asked Chris Hyams, Head of HR & Organisational Development to talk about item 2 (Senior Management Restructure.

Instead of Chris Hyams, Interim Chief Executive Graham Burgess spoke about the Improvement Plan, a “coordinated management approach”, a meeting on Thursday morning to significantly reduce tiers, a future Cabinet report in a “month or two” and a future Council meeting. He said the Strategic Directors would be at Deputy Chief Executive level and changes to the pay policy would have to be agreed by Council, he also talked about the acting appointments, suspensions and how they needed to extend and confirm a number of people in various posts. The Interim Chief Executive referred to Surjit Tour, Peter Timmins, Tom Sault, David Armstrong, Julia Hassall and Chris McCarthy.

Cllr Jeff Green (Conservative, spokesperson) asked a question, which was answered by Chris Hyams. She said they had had further representations and following advice, in September they would be setting up a subcommittee for the recruitment process. She referred to the outcome of the Chief Officers’ suspensions and an amended resolution, a consultation with Chief Officers and how it would be inappropriate to make permanent appointments.

He asked if members of the committee had any personal or prejudicial interests in agenda items to declare.

Cllr George Davies declared a personal interest by virtue of his wife’s employment in a school.
Cllr Paul Doughty declared a personal interest by virtue of his wife’s employment in a school.
Cllr Geoffrey Watt declared an interest because of his father-in-law.
It is possible others declared interests too but as they didn’t use their microphones, I couldn’t hear them.

The Chair, Cllr Geoffrey Watt then asked if they agreed the minutes of the Pension Committee meeting held on the 19th September 2011. He asked if could sign them as a true record. The committee agreed that he could. He said that they were signed.

The Chair, Cllr Geoffrey Watt then moved to item 3, which was the Investment Monitoring Working Party minutes of the 12th October 2011. He referred committee members to the exempt appendix too. He asked committee members to note those. The committee noted them.

The Chair, Cllr Geoffrey Watt moved the committee to item 4 which was the Local Government Pension Scheme Update and two reports. He said he would take this with item 11 (Any Other Urgent Business – Public Service Pensions – HM Treasury on the supplementary agenda.

The Chair Cllr Phil Gilchrist started the meeting by referring to guidance issued by email on filming of meetings (which was permitted). He asked for declarations of interest, none were declared. Cllr Phil Gilchrist pointed out that for the councillors who were late they would have to declare any interests once they had arrived.

He asked if the minutes of the meeting held on the 15th September were agreed? The committee agreed the minutes of the meeting held on the 15th September.

He asked if the minutes of the meeting held on the 27th September were agreed? The minutes of the meeting held on the 27th September were agreed.

Cllr Phil Gilchrist signed the minutes of the meetings held on the 15th & 27th September to show they were agreed.

Cllr Phil Gilchrist welcomed Cllr Wendy Clements to the meeting. He said he wanted to change the agenda order.

Cllr Paul Doughty arrived.

Cllr Phil Gilchrist said he wanted to consider Agenda item 16 (Early Voluntary Retirement/Voluntary Severance and Organisational Change) first. He asked Chris Hyams, Head of Human Resources and Organisational Development to introduce the report.

Planning Applications affecting Bidston & St. James ward (13/10/2011 to 2/11/2011)

There were only two planning applications decided by officers during this period.

The first was for the erection of one non-illuminated fascia sign at Park View Hotel, 426-428 Price Street, Birkenhead, CH41 4JQ. This is for an advertisement consent. However it has been withdrawn by the applicant.

The second is for erection of a rear balcony to a master bedroom at Brailsford, 59 ELEANOR ROAD, BIDSTON, CH43 7QW. This is for full planning application and was approved on 2nd November 2011 with two conditions.

The first condition is that work on it has to be started by 2nd November 2014. The second condition is that details of a 1.7m privacy screen have to be agreed in writing by Wirral Council and the privacy screen has to be erected and maintained.

There is one planning application from Bidston & St. James ward for a first floor fire escape staircase to the rear of 270 Conway Street, Birkenhead, CH41 3JA to be decided by the Planning Committee tonight. The reason for the referral of this to the Planning Committee is that is that a Labour councillor called Cllr Paul Doughty is a partner and architect at SDA Architects and Surveyors who are the agents on this planning application.

Any planning applications that Wirral Council councillors have a close association with get decided by the Planning Committee under existing Wirral Council policies.
