On Monday evening the issue of the future of Lyndale School was debated by Wirral Council councillor for about forty-five minutes. I’m going to try and sum up what was said and decided in a short blog post so inevitably I will be leaving some things out.

The notice of motion by the Conservatives and Labour’s amendment to it is already covered here. The response from the Lyndale parents is here, in addition to that there were a further ninety or so responses to the consultation.

Cllr Paul Hayes (proposing the motion to keep the school open) started by referring to the consultation response by Lyndale parents and the passion and “strength of feeling” he’d observed at a recent consultation meeting (which you can listen to in full). He said he hoped all councillors had received a copy of the consultation response.

The Mayor Cllr Steve Foulkes said that some councillors had received it on the day of the meeting and that he didn’t believe they could be expected to read it in full as they hadn’t had time to digest it.

Cllr Paul Hayes continued by referring to an earlier consultation on Kingsway Primary School and the similarities between the two. He was critical of an officer chairing the Lyndale School closure consultation meeting and said that as well as the majority of people feeling that the officer wasn’t neutral, he also described him as “rude and dismissive”. He described the consultation process as “farcical”.

Cllr Stuart Kelly asked whether Labour’s amendment should be ruled out of order as it was negating the original motion. Labour’s motion deleted all paragraphs in the original motion bar one line. He said surely the same effect could be achieved by voting against the motion?

The Mayor (Cllr Steve Foulkes) said he would allow a legal opinion, but it had been a difficult decision on his part to allow the notice of motion on Lyndale School to be debated. From his point of view he felt that Cllr Stuart Kelly “didn’t have a leg to stand on” with regards to the [Labour] amendment being ruled out of order.

Surjit Tour said that the notice of motion referred it to the Cabinet as the final decision rested with te Cabinet. The amendment also did exactly the same in referring it to a special meeting in September. Therefore in his view the amendment was lawful.

The Mayor said that points of order was not the way he wanted to open the debate and asked the mover of the amendment to speak.

Cllr Phil Davies said that it had been agreed some time ago that they need to have a special Cabinet meeting and that there had been a very detailed consultation exercise, the results of which they had not yet seen. In his view the consultation responses were a “hugely important piece of evidence” which the Cabinet needed to consider before taking a view. To take the clear view expressed in the Conservative notice of motion before the special Cabinet meeting was “premature” as they would be making the decision now in advance of the special meeting. He was also very concerned that if the notice of motion was agreed then they would fall foul of predetermination. He thought it was a shame that Cllr Hayes had said that officers were not neutral.

He continued by referring to his time as Cabinet Member and again referred to the claim that officers were not neutral. Cllr Davies said that the amendment asked that they take no action on the motion tonight but refer it. Again he said that he was worried if they agreed the motion it would have predetermined the outcome before the Cabinet had considered the evidence, but there was no question that Lyndale School provided a “unique and caring environment”. He had visited the school but it was essential he had an open mind and considered all the evidence. He worried that if they made a decision tonight then they would be completely ignoring important evidence that they had not yet seen.

Cllr Andrew Hodson referred to his daughter who had learning difficulties, despite being in her 30s she had a mental age of nine. He considered himself lucky that she had her full health, but that the children at Lyndale had complicated health needs. Although his daughter lived in an establishment she still had her independence in fact [Cllr] George [Davies] had been at the opening.

He referred to the Corporate Plan about protecting vulnerable people and how Lyndale School was an essential service that met people’s complex needs. The staff at Lyndale were geared up to making sure that while receiving an education the children were safe and well cared for. He was perplexed by the decision as the Council would not benefit financially from the closure of Lyndale School so why do it? He finished by making a plea to keep the school open.

Cllr Phil Gilchrist said that the Childrens and Young People Department had told him they had received ninety response and that he had had time to read the documents. He knew that members of the Council had been concerned about the future especially [former] Councillor Tom Harney. He referred to the document received at the weekend and referred to the reference in it to a working party.

Cllr Gilchrist referred to the space that children using wheelchairs need, children with epilepsy, those require oxygen and those who required time consuming feeding. He had attended two of the consultation meetings and concurred with Cllr Paul Hayes’ description. He referred again to the parents’ response to the consultation quoting from it and that it may be September by the time the issue was resolved. He said that the high needs budget for 2013/14 was £31.7 million.

After being given extra time, he referred to the strain on families, the SEN Improvement Test and said that if they wished, councillors on the Cabinet could choose not to vote on this notice of motion (and amendment). The notice of motion was about Council’s view.

Councillor Dave Mitchell said that the way the process worked was that councillors who stood were indicating that they wished to speak in the debate and that if no Labour councillors stood up then councillors who wished to speak should still be allowed to address the Council. Cllr Chris Blakeley said he had no objections.

The Mayor (Cllr Steve Foulkes) said that if that was an early test, that he would decide what goes on, who was asked and which councillor would make a contribution.

Councillor Dave Mitchell said that he’d pick up on the point made by Cllr Paul Hayes at the start. He too had been surprised at the way the presentation had been presented by officers to the parents and that the parents knew what was required and that the parents were the ones who should be listened to. Cllr Mitchell recommended that councillors read every page of the parent’s response to the consultation and absorb every part as it “rips to shreds” the proposal [to close the school] and deals with the real issue which was the children.

Cllr Mitchell continued by saying that it had nothing to do with the schools formula funding as it was all there set by the government and had never been taken away. This was not the case with education funding and the way the funding was divvied out was decided by Cabinet. One of the problems that concerned him with the consultation itself was the way parents had asked questions to officers and had no responses till the last day of the consultation.

Cllr Pat Williams objected to the Mayor refusing to let her speak. She said she was being deprived of her democratic right and that she’d been elected by the people of Oxton to speak.

The Mayor [Cllr Steve Foulkes] changed his mind and agreed to let her speak after all.

Cllr Pat Williams said that during the consultation period it was made abundantly clear that the appropriate place was to let the children remain at Lyndale School. She referred to the petition against closure of nearly 11,000 signatures which demonstrated how much Lyndale School was valued as a unique asset. She like other councillors referred to the parents response to the consultation and wanted the profound and complex needs of the children fairly reflected in the funding.

She had visited the school and was always most impressed by the caring an dedication of the staff and when she was Mayor had had the pleasure of formally opening the sensory garden. The consultation had ended and it was overwhelming apparent that Lyndale School should stay. She asked councillors to take note and resolve that Lyndale was to remain open.

Councillor Pat Cleary (the new Green Party councillor) said that he wanted to make a brief point. He said that Lyndale School doesn’t have to be closed and he appreciated the sincere feelings. He was disappointed as he didn’t understand the Labour councillors not engaging.

One issue he wanted to raise was that 18 months ago there had been a letter from the Leader of the Council during the What Really Matters consultation about whether local elections should only be held once every four years. It had been said that the reason the proposal was being brought forward was that early analysis of the consultation results had shown 91% supporting this change. In that instance a recommendation had been brought forward before the consultation was finished, he wanted to know why the current situation was any different?

Cllr Tony Smith said that he agreed that the uncertainty about Lyndale School must be resolved and had been an ongoing concern for a number of years. The consultation had been undertaken, but reducing numbers of children on the school roll, changes in funding arrangements and questions about the future viability of the school were the reasons behind the consultation. He stressed that the consultation was not about the quality of the education.

He continued by saying that any decision about future provision would be informed by individual needs and make sure people’s requirements were fully met. The government required the [SEN Improvement] test to be undertaken to show that the proposal was as good as or better than the children’s current provision. He said that they would make sure they had an up to date understanding of each child’s needs.

They had undertaken a consultation and there was oversight from the [Wirral] Schools Forum. The original decision had been called in and it was made clear then at the outset that the process should be open and transparent over the twelve week consultation.

Prior to the consultation starting, there had been a meeting with parent governors of Lyndale and throughout the consultation six public meetings. Eighty-five people from the community had turned up to these, with some attending more than one. Wirral Council had commissioned an independent person to consider each of the published options and any new options and consider the application of the government’s [SEN Improvement] test. All councillors had also been invited on an escorted bus tour which included Lyndale School. Twenty-two councillors had taken part in these visits on the 16th/17th June. He made the assurance that all information relevant to the consultation would be made publicly available prior to the Cabinet meeting to inform the decision making when the Cabinet would be taking all factors into account such as the needs and welfare of each individual child.

Cllr Jeff Green (seconder to the Conservative motion) reminded people that when Cllr Tony Smith spoke that closure is a preferred option. He reminded people why it was called in and referred to the speeches of Cllrs Hayes, Gilchrist, Mitchell and others (as well as congratulating Cllr Cleary on his maiden speech). He said a maiden speech was normally held in silence but the response from Labour councillors was because he’d beaten them in an election.

Cllr Green said that Lyndale was unique and incredibly special and that that needed to be safeguarded.

Despite a recommendation from planning officers to approve plans for four houses in Noctorum Dell, after hearing representations from the lead petitioner, a representative of Condy & Lofthouse Architects Ltd and Cllr George Davies (Claughton), the Planning Committee decided unanimously to reject the plans due to the impact on the character of the area (policy HS4), drainage concerns (policies GR7 and HS4) and because it would have an impact on the character and environmental qualities of Noctorum Ridge (policies HS4 and SPD2).

The lead petitioner said, “Many residents are elderly, frail or vulnerable like myself. My husband suffered a stroke ten years ago, he will not cope with the disturbance that this will cause and I as his carer neither will I. As a Council you have a duty of care to your public and the people who vote for you to be in the position that you hold.”

Councillor Stuart Kelly said that three-storey buildings would be out of character for the area and also highlighted concerns he had about flooding and drainage. Cllr Anita Leech also had concerns about drainage and the overbearing impact on nearby bungalows.

Cllr Denise Roberts (Claughton) moved refusal of the planning application, which was seconded by Cllr Denise Realey.

This continues from Planning Committee (Wirral Council) 31st October 2013 Minutes, Declarations of Interest and Site Visits.

The first planning application decided (and the one that many people had come along to see a decision made on) was for four bungalows and some amenity open space on the Paddock, Kinloss Road, Greasby.

The Chair, Cllr Bernie Mooney asked an officer to introduce the planning application. He explained what it was for, why the officers had recommended it for approval and the officer’s response to the objections raised (which were mainly highway safety issues). He said that although it had a value as an open space, it was not designated as a green space or open to the public.

The lead petitioner introduced herself as Helen O’Donnell and explained why a hundred and forty-nine people had signed a petition objecting to the planning application. The first area of concern was safe access into and out of the housing estate, the petitioners felt that leaving this land open had been integral to the design of the original RAF estate. The petitioners felt that building here would lead to a loss of sight lines and a reduction in highway safety. Concerns were also raised about what would happen to the laybys which the petitioners felt were needed for a free flow of traffic. Helen O’Donnell also wanted the green rural route protected by the Planning Committee not approving the planning application.

The applicant, who introduced herself as Mrs. Glynn said that she hadn’t seen the photos circulated by Helen O’Donnell. She pointed out that the planning officers had recommended it for approval and that the proposed buildings were single storey and of a low density. She felt that everything had been done to meet the objector’s needs and repeated that it was recommended for approval by the planning department.

Cllr Steve Foulkes said he would like to hear from councillors who had been on the site visit. The Chair said that she had been on the site visit and that she couldn’t see what difference four households would make to access. Cllr Wendy Clements asked where the dwellings would be and asked for a response from the officers about the speed of traffic.

Matthew Rushton referred to an extra condition on the late list and that the greenery on the other side of the roundabout was maintained as public open space. An officer responded on highways safety grounds that there had been no accidents there over the last five years.

Cllr Eddie Boult said that he couldn’t see a problem with traffic on the site visit and that he found the photo circulated by the petitioners misleading as it was of a different area.

Cllr Geoffrey Watt said that he had also been on the site visit. Although he would be sad to see the loss of openness, there were still some green spaces left and he couldn’t think of a good planning reason for rejecting the planning application. He asked if a condition could be added to restrict the buildings to a single storey?

Cllr David Elderton pointed out that the photos weren’t of the site and that the police enforced the speed limit on this stretch of road, he agreed with Cllr Watt that it was nice to see urban green space, but again he couldn’t see any reasons for objecting to it.

Cllr Stuart Kelly agreed with what was said about traffic and pointed out that in the report it stated that it wasn’t designated as urban green space, however in the open space assessment it had been designated as open space (although officers had advised him this was in error). He referred to paragraphs seventy-four and seventy-seven of the National Planning Policy Framework and policy HS4. Cllr Kelly didn’t feel there were grounds to refuse it on highway safety grounds. He referred to a covenant on the land stating it was for grazing purposes.

The Chair thanked Cllr Kelly for his contribution. Cllr Foulkes said that when he had first joined the Council [in 1990], he had been on the Unitary Development Plan Working Party, but nobody had lobbied them then to make this land green space. He recognised that local people believed it was green space, but that the developer had set aside part of the land as an amenity space, he said he would struggle to support refusal if Cllr Kelly moved it. He felt that the extra car movements from four bungalows was insignificant and that he welcomed the comments from people who’d been on the site visit and pointed out that the photo was of somewhere else.

Matthew Davies said that it was designated in the Unitary Development Plan as a primary residential area. He referred to the criteria for a green space designation under the National Planning Policy Framework and said it couldn’t be described as beautiful and that it didn’t have historic or recreational value. If the planning application was refused on these grounds he thought that they would struggle to defend the decision at appeal.

Cllr Wendy Clements said she had looked at the map online and it was designated as urban green space.

Matthew Davies said that they had had a piece of work undertaken as part of the core strategy as to where the open spaces were. The consultant had picked this site, whereas Wirral Council had meant the consultant instead to include the site maintained by the parks and recreation department on the other side of the roundabout.

Cllr Watt asked again about a condition limiting the bungalows to a single storey. Matthew Davies replied that there could be a condition added restricted it to a single storey.

Cllr Denise Realey proposed approval (with the extra condition), Cllr Irene Williams seconded this. Eight councillors voted in favour. Three (Cllr Stuart Kelly, Cllr Geoffrey Watt and Cllr Paul Hayes) voted against. One councillor abstained, so the application was approved.

Cllr Stuart Kelly asked, “I liked what the Cabinet Member said in her report about the commissioning of services, but is the Cabinet Member embarrassed that Wirral was named and shamed over the summer as the council with most contracts with most care homes on Merseyside using zero hour contracts for their employees?

Is she also aware the response that was given to me when I submitted a Freedom of Information request which asked how many contractors for Wirral Council providing Council services have used zero hour contracts? The reply I received was Wirral Council does not have a policy on the use of zero hour contracts and that Wirral Council would not hold information about the resource management of our contractors as how they manage resources is a matter for the contractor. Does she still stand by that reply on behalf of the Administration and believe that resource management is not a matter for the Council when considering that we place contracts for care services for vulnerable people and when will we see a policy on the use of zero hour contracts by companies Council contracts with to provide services?”

Cllr Simon Mountney asked, “The Cabinet Member in her report details changes to residential and day services, which have been delivered on time and within Budget. Can she explain what effect the department’s failure to hit the performance indicator for permanent admissions of older people to residential & nursing care homes, as reported to Cabinet on Thursday will have on the department’s Budget and can she please give me an assurance that the same rigour and process are applied to the alleged payment of £48,000 is as being applied to the Martin Morton issue please?

Cllr Anita Leech asked, “I was delighted to hear from students and staff when I recently visited Moreton Day Centre which falls within my ward, that the much smaller group of students remaining have been able to carry out alternative and increased activity and participate in the local and vibrant community as well as the usual centre based activities and they are happy with the proposed move to other.. and I’d like to personally thank the staff of the day centre, parent and carer’s groups and the officers of the Council for the hard work they’ve put into reviewing this unfortunate closure as we’re providing what appears to be a facility that could be improved upon for the students remaining. I would however like to ask the question with regards to the hundred people who transferred from the services from Moreton. Did one to one consultation take place as was indicated to identify the needs of the individual and were their places allocated accordingly? And secondly how was the transition for the students, were there any issues?”

Cllr Phil Gilchrist asked, “Can I ask the Cabinet Member about the domiciliary contracts and the care of the elderly? What monitoring is undertaken in Wirral to ensure that Wirral isn’t subject to some of the problems identified recently nationally where mistakes were made by very limited time available for clients?”

Cllr Chris Jones responded, “Thank you very much for your questions, it’s nice to know you’ve actually looked at my report.

I suppose I can answer the two together really about the domiciliary contracts. If you had read the second page of my report, you’d see that we’re trying to support the principles of the ethical care charter, which looks after the workers as well as some looking at the people who need care. We are actively encouraging people and the firms who are going to tender to not use any zero hours contracts and we’ve asked for a report from the HR department to find out how many contractors that are generally used by the Council are using these zero hours contracts.

Stuart’s commissioning of services, we’re doing an awful lot of work with the NHS which has been a huge problem in the past I think we’re working far more closely together now around intermediate care and all the rest of it. The zero hours contract I’ve already answered Stuart. Chris Begya and Jacqui Evans’ reports are, Jacqui Evans is undertaking and is personally involved with the commissioning work and is making great inroads into that and looking at savings as well as improving quality of care for the people of the Wirral.

Anita asked about Moreton Day Centre. Everybody who attended Moreton has had a one to one .. they also had a .. visit to their new centre which we felt was really important. About seventy people have actually transferred, mainly to … which is a really popular choice mainly around .. moving anyway and to Heswall but others have gone to Pensby and Eastham as well but increasing places at Dale Farm taking extra visits to Dale Farm, and generally people have settled really well. Some of the staff have moved with the service users so .. a little bit of continuity of care for those users. Thank you Mr Mayor.”

Continues from Planning Committee (Wirral Council) 26th September 2013 APP/13/00866: 151 Victoria Road, New Brighton, CH45 9LB – Change of use of a property from a single residence to a house of multiple occupation to provide 12 bedrooms with communal kitchen, living rooms and bathrooms. Also to include alterations to windows to the front elevation.

The officer introduced the report for this item and said it was a vacant greenfield site that was there to give an area of land as amenity open space for the new development. The objections received were about the loss of the open space. The applicant contended that the amenity open space was surplus to requirements, but the local planning authority (Wirral Council) contended that it had value.

The officers had assessed the proposed development and had no problems with it except for the policy issue about the loss of the amenity open space. Included in the late list was further information, the applicant had offered a sum of £40,000 to be spent on the adjacent play area, but the officers were still recommending refusal.

The Chair asked if a ward councillor wanted to talk to the Planning Committee?

Cllr Ann McLachlan said that any plans for the open green space would cause tension with the local residents, but that the plans were for low-cost affordable housing. In respect of the views of the local residents there were six key objectors, however she understood their concerns, but their fears had been allayed and assurances given. She wanted to speak in favour of the application for a dozen two bedroom bungalows. Although a provider had not yet been identified, this could be secured through a condition or a s.106 agreement.

Cllr McLachlan said that the properties would be “a drop in the ocean” but a welcome development. She had concerns about the benefit reforms as people were “crying out for two bedroom” properties. The local area to the site was residential and it would be on an amenity piece of green space. It’s use was for informal play and it did have some community use, however it was quite overgrown. There had been some dog owners pulling up in cars allowing their dogs to foul this piece of grass and in her view approving the application would deal with a number of the current problems. The applicant had offered £40,000 (subject to the plans being approved) to be spent on the adjacent play area and for these reasons she supported the application.

Cllr Wendy Clements asked a question about the affordable housing requirement. Matthew Davies responded by saying that if the application was approved it would be subject to a s.106 agreement for affordable housing. There would also be a commuted sum to upgrade the existing play facilities and a condition for highway improvements if councillors decided to approve it in addition to a number of other conditions.

Cllr Brian Kenny said he had read the paperwork and listed to the discussion. In his view a dozen two bedroom bungalows satisfied a demand for affordable housing. He accepted the officer’s view that it needed a s.106 agreement and thought it would fit well with the area. Cllr Kenny referred to antisocial behaviour issues raised by the local councillors and was heartened that the applicant had suggested giving £40,000 to upgrade the adjacent play area. He said that if you believe everything you read in the press that the Cabinet Member for Housing (Cllr George Davies) was keen. Cllr Kenny was in favour of approving the application.

Matthew Davies said they would need to give a reason why they were approving it contrary to the normal policies and that this needed to come from the Planning Committee. He explained that if approved, extra conditions that would need be attached to the approval including a site waste management plan.

Cllr Paul Hayes said he accepted the need for affordable housing, but didn’t buy into the argument that it was needed because of antisocial behaviour and dog fouling. In his view those sorts of issues would only be dealt with through tougher enforcement.

The Chair, Cllr Bernie Mooney, referred to the extra money for the play area, the extra money for upgrading the highway and the extra £1,500 for the school crossing patrol. She asked the Planning Committee if they were happy?

Cllr Stuart Kelly was not happy. He accepted that affordable housing was important, but in his view the need to build more houses shouldn’t mean they should lose green space sites. Cllr Kelly said the site was used for informal play and that they had to get the balance right between building houses they knew they needed and providing people with space for children to play, he was not happy with building houses on a piece of green land, as there was lots of overgrown green land and it would set a precedent for further applications for housing on green space.

Cllr Kelly said that it had been set aside as part of the original planning application and put there for a reason, he was not willing to set aside policies as in his view they needed the amenity space as much as they needed affordable housing. He said that they had a policy which said they should have this sort of amenity put in place and he felt that backing out sent out a poor message as he felt developers should build on brownfield sites rather than a site used for informal play.

Cllr Denise Realey asked if the site had been identified for housing under the Strategic Housing Assessment? The officer said it hadn’t.

Cllr Brian Kenny said that he wanted to move approval of the application on the grounds that it would provide affordable housing that there was a demand for. He said it fitted well with the character of the area and removed a number of current problems. Cllr Kenny said it was important they approved it and the applicant had agreed to invest £40,000 in the adjacent play area. He moved approval. Cllr Joe Walsh seconded approval.

Cllr Kelly moved an amendment to the proposal to approve, that it would be refused for the reasons given in the officer’s report. Rosemary Lyons (legal adviser) advised the Chair not to accept the amendment as in her view it wasn’t amending the proposal to accept the planning application. She said that Cllr Kelly could vote against the proposal to approve the application.

The Chair took a vote on the motion to approve the planning application.

The application was therefore approved.
