A previous post on this blog deals with the first five minutes of the Improvement Board meeting. Since then over roughly a week since the video of the Improvement Board meeting was uploaded to Youtube, the first part of the meeting has been viewed nearly two hundred times at the time of writing! As there was such interest in it, I thought I’d continue with a transcript of the meeting, carrying on where I left off which was five minutes and twenty-four seconds in.

Joyce Redfearn (Chair, Improvement Board): We’re going to move on in terms of making sure we get through the questions. John Brace, are you present, yeah?

John Brace: As there are quite a lot of questions and they’re in here already, I’m quite happy with you reading them out if that would be speeding things up a bit.

Joyce Redfearn (Chair, Improvement Board): I think that’s really helpful of you and thank you for submitting it in advance, because people have the script in front of them and because it’s long, I won’t actually read it out as we did in one of the other sessions if that’s alright, but we will let you come back when we’ve given the answer, unlike the other sessions, in terms of if there are supplementary questions or points that you feel we didn’t cover from your email, ok? Thank you. Graham do you want to go?

Graham Burgess (Chief Executive, Wirral Council): Just in response to the first question which relates to a whole series of appendices to the AKA report, our view is that err all the appendices actually contain very sensitive personal information and to release those appendices would be in breach of data protection and also the duty we have to individuals who gave us information in confidence, or in relation to their own personal medical or financial circumstances. Therefore it’s our view that it would be inappropriate to release those documents as they contain a whole host of sensitive information. Clearly these matters can be tested, if you wish to test our view, via FOIs and the Information Commissioner, but so far our position has been and has not been challenged in respect of those appendices. It’s our view as you can see from some of them anyway, clearly showing they do contain very sensitive personal information.

Joyce Redfearn (Chair, Improvement Board): I think that was recognised within the question, certainly in terms of one of the appendices, thank you.

Cllr Jeff Green (Leader, Conservative Group): Yeah, can I just check when the Chief Executive said ‘we decided’ who the we were?

Graham Burgess (Chief Executive, Wirral Council): Well it’s the Council, I clearly represent the Council.

John Brace: Sorry, as I’m entitled to a supplementary on that. In relation to that list, I know that there were councillors present at that one and that was used as a justification that councillors had signed off on the special charging policy, so if you released it with the other names blacked out, wouldn’t that mean people could have at least a bit of accountability as to who the people were who agreed to that?

Graham Burgess (Chief Executive, Wirral Council): Can I also say Chair that with your agreement it would be the intention of the Council to print all these questions, place all these questions on our website and all the answers to them as well so it can be available for people who couldn’t make it at this meeting so they can see what we’re saying.

In respect of that, obviously this is a question that only came in at five o’clock last night which was reasonable and obviously your supplementary has just been asked now so I’d need to probably go away and take advice on that point and we’ll give you the answer both to you John personally and put the answer on the website for everybody to see and certainly Joyce and the Improvement Board will take that into account when they write the final report.

Joyce Redfearn (Chair, Improvement Board): So thank you, for that particular question, it’s really helpful. Do you want to keep on going in terms of the series of questions because we’ve got them in front of us?

Graham Burgess (Chief Executive, Wirral Council): The next question I think refers to the Martin Smith report and again our position is the Martin Smith report was redacted as it contained personal information and the Council has a legal obligation with regards to public disclosure of that information to the individuals mentioned in that report.

The Council’s responsibility extends not only to the public, but to any person or body to which the information relates, the Council considers every case on its merits and maintains its position that disclosure is not appropriate in these circumstances. Once again there are ways of challenging the Council, via the Information Commissioner another way if you think the Council is being unreasonable and the Council has and will always respond to the Information Commissioner’s ruling.

I would say however that perhaps the most important part of that report particularly is the recommendations around our whistle blowing, grievances and bullying policies, all of which have been progressed in line with that report and all of which is referred in response to critical incidents report that’s also considered by the Audit Committee last night.

Joyce Redfearn (Chair, Improvement Board): Thank you, is there anything further as you’re present that you want to ask? Move onto the councillors point which is in the next question.

Graham Burgess: Thank you, I’ll just stay standing up, shall I?

Joyce Redfearn (Chair, Improvement Board): Yeah, I think you should, you could keep your jacket off.

Graham Burgess (Chief Executive, Wirral Council): Again it’s a similar point that the Council does have responsibilities to the individuals named in these reports and this must be considered in relation to disclosure and redaction. Full disclosure of the Martin Smith report would in the Council’s opinion contravene its legal obligations under the Data Protection Act, with regards to upper management’s control of information in its possession.

Once again there are ways of challenging the Council independently if people have a different view and I would encourage people if they don’t agree with the Council’s position to challenge us and we will state our case to the Information Commissioner or any other relevant body. We believe as well as obligations to the public as a whole, we have obligations to individual members of staff, public, service users to protect their interests and that’s why we’re acting in this way.

If however, people think we’re wrong, then it’s worth challenging our position and we welcome people challenging our position. Thank you.

Member of public heckling: You’re wrong, you welcome challenges, you’re wrong. You’re far from being open and transparent and that’s ridiculous. I apologise to you all for that.

Joyce Redfearn (Chair, Improvement Board): That’s your view, so I, what we will do is allow further questions and comments at the end and I understand that was a heartfelt, but we’ll go through the series if that’s ok with you.

Graham Burgess (Chief Executive, Wirral Council): Can I just say clearly if people think we are wrong, that’s perfectly right to challenge us and there are ways of processing those and it can be challenged independently and we welcome those challenges and if we are wrong of course we will publish the documents.

The Coordinating Committee meeting was just so councillors could discuss one agenda item, the Wirral Improvement Board review, which is currently out (at least at the time of writing) for a rather short eleven day consultation ending on Friday 15th November.

Part one of the meeting (which you can view above) contained a rather long Powerpoint presentation from the Head of Policy and Performance/Director of Public Health (Fiona Johnstone). As usual though the more interesting comments were made by councillors and the first of those to comment was former Leader of the Council Cllr Steve Foulkes (which starts at 17:33 in the first video clip above).

He said, “Chair, I mean clearly the Council had found itself in difficult times with a number of highly critical reports. I have no intention of going back to the origin of those reports and the issues around them but needless to say it did certainly undermine confidence of the public in the Council to the degree where it felt necessary that we wanted to move and incorporate outside help and I got lots of things wrong in my position as Leader but one of the things we did get right was actually open ourselves up and suggest the sector led approach improving on what we’ve established. So I think we did the right thing at a very difficult time we felt.

We, under any circumstances a report of this nature and its independence so the people who were writing this report aren’t our people, there’s three political mentors who were signed up to the outcome of this report. If we took seriously and we did, the fact that say the Klonowski report, obviously independent was a significant issue then where reports praise us and they are also written independently then rightly we should give the praise equal value against the criticism because the fact is that’s an independent report. This isn’t us saying this about ourselves, these are people who work for us and see the change and you know from Chief Exec down to a number of officers it’s fairly unrecognisable the structure of the Authority from whence we started. So we have been able to make those changes.

I think we have made improvements to a point where we could run, be on our own and they’re saying that, so that’s to be welcomed. The one issue that is in the report that I think you I know slightly mentioned about audit and the audit committee. Certainly I know through working with Jim as Chair and the other Members who are represented on audit, we did make vast improvements to the way the audit committee functioned and its job. However this issue of independence I think alongside the world we’ve got where there are a number of independent views because we are cynical of politicians in general in the Wirral and so I think that the audit committee with an independent majority certainly should have more credibility on an ongoing basis Chair I think that’s true.

The thing is we’re by no means where we would like to be. We’ve also had an ambition to be you know a journey to excellence or whatever type of authority you want to be or an excellent Council and underneath we’re not. I think you said Fiona we’re not there. We don’t expect to be perfect and any large organisation will always make errors and we shouldn’t be castigated for a single error and that’s the way it always is because you know errors will happen in whatever work, walk of life you’re in. Mistakes do happen.

It’s how you react to those mistakes, it’s what you do about them and what the overall point of this is. At the same time making this journey against the most difficult financial background that I think anybody’s ever seen in their lifetime. It’s never been easy on local authorities, but the level of savings we’re being asked to make are of such a magnitude, it can’t be easy to this improvement, trying to do an improvement job at the same time as these other things.

So I welcome in general, I welcome the report. It’s a job half done, but half done we shouldn’t be complacent and we should try to move on. You know we’ve all had to do a little bit of sort of inward reflection. Are we doing our best as individuals, each one of us around the table and the lead officers as well and to agree with members of the public engaging in the debate. We’re doing our bit, we changed something that we do to make this Council better.

Certainly I know numbers of Members have engaged in training, taking those roles on, we’re certainly working hard on scrutiny as Alan over there will testify. I think we do need to take on board a review of scrutiny committees in the new year.

Comments that are in the report and those particularly those around health and social care scrutiny committee that’s had you know quite a number of comments made. We need to do that whether that means we supplement it by members of other committees, we need to be open-minded, imaginative in the way we approach it. So if someone throws a problem at us then we need to work together to deal with that.

There have been various levels of engagement with various Members but I think you know credit to the three party leaders who have sat in a room together on numerous occasions throughout this journey and tried and have generally seem to have been able to work together, it’s a comment made within the report.

So I think all in all if we accept the critical reports of an independent nature and basically say we take them verbatim because to do otherwise would be stupid and people would say you’re trying to hide or you’re trying to alter it. I don’t agree with every single word in the summary but by and large the message was we got ourselves into a dark place and we needed to get out of it.

I think likewise we should recognise that this is you know a journey of improvement that’s been undertaken, it’s been recognised by others outside the Council. We should be thankful for it and thank those who are part of it. As the presentation has gone on I’ve put a number of words together. I’ll see if it finds favour, it’s not particularly controversial but I think we need to accept where we are, never mind the fact that we can always improve and we shouldn’t forget those mistakes from the past and rectify those mistakes from the past as soon as we can, we just need to recognise that.

It’s been a difficult period and this is a good report, a good independent report. We should take it for what it is and use it as an encouragement, a bread and butter role in the process for Members, members of staff, Chief Officers, members of you know for every single employee we should say thanks for being involved in this. We are moving in the right direction. That’s just my take on it, you may disagree.”

Audit Commission criticise Merseytravel in audit report on Mann Island lease

Unfortunately I arrived at the meeting (starting at 2.30pm) about fifteen minutes late, caused in part by an eight minute delay due to Platform 1 at nearby James Street station being closed (which is run by Merseyrail in which Merseytravel have a controlling interest) and other reasons.

When I got there (and negotiated my way to the first floor using the terribly confusing system for the lifts where you have to enter your floor number and press another button before you get into the lift), the meeting had started, the agenda had already been reordered and the item I was particularly interested in (ten) had already started as unfortunately items 3-9 were being left to the end of the meeting. I had missed completely agenda items 1 (Apologies for absence) and 2 (Minutes of the last meeting), which is no big loss as the minutes can be read on Merseytravel’s website and who was absent could be ascertained by who was there.

Agenda item 10 was the Audit Commission: Completion of 2011/12 Audit which sounds dull but wasn’t. The Audit Commission were there to report on the Completion of the 2011/2012 Audit for Merseytravel (both the Merseyside Integrated Transport Authority and Merseyside Integrated Transport Executive).

The audit fees had increased by £10,140 due to an extra two and half weeks of unplanned work required by the District Auditor, Audit Manager and Principal Auditor which related to four areas:-

a) responding to queries from officers, councillors and members of the public,

b) problems with working papers, quality assurance not being robust, not all agreed improvements being made,

c) changes to accounts and disclosures

and

d) errors in the accounting treatment for the Mann Island lease (see picture below) and lease incentives.
