I thought it would be a good idea to restart a regular feature I used to do on this blog which was looking to the week ahead with a brief summary of what’s happening.

Wirral Council’s Families and Wellbeing Committee meets tomorrow (Tuesday 1st December) at 6.00pm at Wallasey Town Hall. There are no motions on the agenda but councillors will discuss the all age disability strategy and the day services local authority company called Wirral Evolutions.

Wednesday evening sees the high-profile issue of a fire station at Saughall Massie return for a debate by the Regeneration and Environment Committee. Also to be debated is a motion on Wirral’s nuclear industries. The changes to how Wirral Council will deal with objections to traffic regulation orders (already agreed by the Standards and Constitutional Oversight Committee will also be discussed. This public meeting also starts at 6.00p.m.

On Thursday you are literally spoilt for choice for public meetings and if I wished I could probably spend all day filming them!

The Merseyside Police and Crime Panel meets starting at 10.00am in the Council Chamber in Huyton. On the agenda are updates on serious and organised crime, the appropriate adult scheme, sustaining excellence, a home office pilot for mental health nurses to be colocated in custody suites, a night-time levy consultation (the consultation has already finished but just applies to Liverpool and 70% of the levy on licenced premises will go the police for policing Liverpool’s night-time economy), proposals for future Chief Constable recruitment and other routine items.

The Merseytravel Committee of the Liverpool City Region Combined Authority meets starting at 2.00pm in the Authority Chamber, 1st floor, No. 1 Mann Island, Liverpool, L3 1BP.

Other than minutes and the co-option of Cllr Joan Lilly (who replaces the late Cllr Sharp), councillors will hear an update on smart ticketing, discuss the Merseytravel Fees and Charges Review for 2016/17 and a report on delivering an improved bus "offer".

Then in the evening at Wallasey Town Hall starting at 6.00pm Wirral Council’s Transformation and Resources Policy and Performance Committee meets. Councillors will debate a motion on freedom of information requests proposed by the Lib Dems (I should declare an interest here as it relates in part to Information Commissioner’s Office decision notices that relate to my requests), security of access to Council issued devices and a report on the Council’s social media policy and its appendix.

On that last report I should also declare an interest as their current social media policy by my initial reading of the policy/report to councillors seemed to state that Wirral Council employees (unless they can prove some business need such as the press office) were prevented from accessing this blog, the associated Facebook Group, Twitter account and as mentioned in the report itself also video of public meetings of Wirral Council on Youtube. However a reader has left a helpful comment stating that this blog isn’t blocked which is useful information I am interested to know.

I’d better declare a financial interest as Youtube pays me a very small amount in royalties from videos I’ve filmed (and by small I mean £1.10p for October 2015). In fact Wirral Council blocks employees from watching its own Youtube channel.

If the new policy goes ahead, Wirral Council employees will be allowed to read this blog (after writing this a reader left a comment to say they already can despite this blog falling into the social media category) and the above sites that fall into the social media category in their breaks.

However Big Brother, sorry Wirral Council will be watching what they get up to, so who knows what red flags you’ll raise if you read this blog or Wirral Leaks or well something really subversive like Wirral Council’s Youtube channel!

So that’s the round up for the week, I used to also provide a quick overview of what’s happening this week local government wise in two more open and transparent public bodies the House of Commons/House of Lords which you can watch online.

This afternoon starting at 4.00pm the Communities and Local Government Select Committee will discuss the Cities and Local Government Devolution Bill. The Cities and Local Government Devolution Bill has implications for Merseyside over an elected Mayor in 2017 and the devolution changes that have already received a lot of press coverage. As I’ve seen at least one local government officer here in Merseyside refuse to answer politicians’ questions about the government’s side of what’s happening, this looks like an interesting opportunity to hear about what’s happening from another perspective.

Tomorrow starting at 9.25am, the Public Bill Committee will discuss the Housing and Planning Bill. At the same time (starting at 9.30am) the Education Select Committee will discuss Holocaust Education and in the afternoon starting at 3.00pm the Treasury Select Committee will ask questions of the Chancellor on the Comprehensive Spending Review (which is only partly related to local government). In the House of Lords a Select Committee will be discussing the built environment starting at 10 am.

On Wednesday morning starting at 8.55am the Second Delegated Legislation Committee will discuss the Draft Police and Criminal Evidence Act 1984 (Codes of Practice) (Revision of Code E) Order 2015. For those not familiar with police procedure Code E relates to the audio recording of interviews with suspects. Starting at 9.30am the Work and Pensions Select Committee will discuss the local welfare safety net, also at 9.30am the Education Select Committee will discuss regional school commissioners, the Treasury Select Committee will continue debating the Comprehensive Spending Review starting at 2.15pm and the Public Accounts Committee will discuss reform of the rail franchising programme.

Thursday sees more discussion of the Housing and Planning Bill by the Public Bill Committee in two sessions starting at 11.30am and 2.00pm. The House of Lords Select Committee will continue to discuss the built environment and hear from a former Chief Executive of the Planning Inspectorate.

Hello, I’m John Brace and this is the second part of my videos about local politics on Merseyside and on the Wirral.

One thing I’ll be talking about today is the Bam Nuttall contract. You may not have heard of Bam Nuttall, but they replaced Colas. If I went into the whole Colas saga and the senior officers that were suspended and paid oodles of money because Wirral Council didn’t quite get it right, well I’d probably use up all the tape on this camera.

But anyway going back to Bam Nuttall, in must have been 2014, Wirral Council signed up to a contract with them and the contract called, let’s see the Highway Services Contract. So for instance stuff to do with road works. Anything I think over a certain amount to do with traffic lights is someone else’s responsibility but I’ve scanned in the first bit of the contract which is here, see that’s the bit I’ve scanned in, but it’s an absolutely massive contract.

This is the next bit, bit not the rest of it! Then there’s this. That makes up the contract.

I have asked Wirral Council not to give me things on paper and to save the planet, not cut down so many trees and give them to me on a CD, but Wirral Council always seem to prefer paper.

Anyway the other thing I’ll be writing about in the near future is, this is some of the invoices I got during the audit for various things. For instance, this one is an invoice for £7,389.50 for the Moscow Ballet doing Giselle at the Floral Pavilion.

Now you may well say well what’s the point in getting an invoice for that? Well, the taxpayer actually subsidises the Floral Pavilion to a large amount of money.

So whereas for example Wirral Council sees closing down Lyndale School as a priority because they say they don’t have the money, they do have the money to be subsidising the tickets of rich people going to see the ballet at the Floral Pavilion. OK, I could look up the amount later.

The other thing I was going to talk about is Liverpool City Region Combined Authority. Now of course this was only set up in the recent past and has mired itself in all kinds of controversy over the devolution deal, price, prize, all that and elected Member stuff.

Anyway, what I did notice and this came as news to me, even though I report on the Liverpool City Region Combined Authority is that Knowsley Council has set up a website for the Liverpool City Region Combined Authority and they’re currently running a consultation on the things that make up the devolution deal.

Now, firstly before the Liverpool City Region Combined Authority was set up politicians quite categorically said, I’m not going to name the politician here but I’m sure people can find this out, I’ll probably find this out when I write this up on my blog.

They said the Liverpool City Region Combined Authority won’t cost any more money than the existing arrangements. Now registering a website, having a website hosted, dealing with all the stuff to do with a website does cost money! OK, the politicians will probably turn round and say, well this is from existing budgets or something, but it costs money that can’t be spent on something else.

So anyway, when I write this up on the blog, in the transcript I’ll include a link because to be honest it was news to me, it hasn’t been in a report that was submitted to the Combined Authority and as far as I’m concerned the only mention online about it is from Knowsley, whereas the Liverpool City Region Combined Authority is all the councils on Merseyside plus I think Halton and really speaking you shouldn’t just consult with the people of Knowsley, you should be consulting everybody.

So that’s a few things that I’ll be doing, let’s see today’s weather is cold, hence the jumper. When I was looking into market research as to what people want from a blog, one of the things that came up was weather forecasts. Now you’ll be glad to know that unless there’s a big demand I’m not going to start up with a map behind me and little symbols of clouds and sunshine, wind and all that because I really don’t fancy being a weather forecaster probably because people would love turning round and saying, “Well you said it would be sunny today John and now it’s raining!”.

But anyway if you really do want weather forecasts, there’s the Met Office website for that.

So that’s a summary of where I’m up to, this week there are hardly any public meetings because of the half term holidays and of course there’s Halloween at the weekend. One of the things that’s coming up of course is Bonfire Night and the Merseyside Fire and Rescue Service, ok I’m sure people are probably sick of me talking about Merseyside Fire and Rescue Service.

Merseyside Fire and Rescue Service are running, in I think conjunction with Wirral Council, trying to clear up the, say for instance the bits of wood and stuff like that people put together for bonfires because Merseyside Fire and Rescue Service probably really don’t want to be going round putting out a lot of small fires on Bonfire Night.

I mean they’re not being killjoys or anything, there are Council organised fireworks displays and things like that so people can go along. I’m sure there’ll be one in Birkenhead Park this year, people can make the usual jokes about taxpayer’s money going up in smoke, that kind of thing.

But anyway, that’s what I’ll be doing today, I’ve decided to keep it short because typing up these transcripts takes a while, but if there’s anything you want to leave a comment on or you think I should write about then please get in touch.

Below is a copy of my statutory objection to the approval of the accounts of the Merseyside Pension Fund (a £6.9 billion pension fund that form part of Wirral Council’s accounts) which go to Wirral Council and its auditors Grant Thornton.

It’s rather dull and technical, but in the interests of openness and transparency I am publishing it below. It relates to yesterday’s meeting of the Pensions Committee that can be viewed below. I was so cheesed off I made two spelling mistakes in the email (a corrected version is below).

Dear all,

I am a local government elector in the Wirral Metropolitan Borough Council area and make this statutory objection to the Pensions Committee approval of the the Merseyside Pension Fund Accounts for 2014/15 (see Audit Commission Act 1998, s.16).

For the purposes of clarity to the auditor this is a statutory objection to a matter not in relation to a matter covered by Audit Commission Act 1998, s.17-18 but Audit Commission Act 1998, s.8.

As required I am sending a copy of this objection to the auditor, those I have contact details for on Wirral Council’s Pensions Committee (I do not have an email address for Cllr Treena Johnson), Wirral Council’s Audit and Risk Management Committee and those tasked with corporate governance at Wirral Council such as the Monitoring Officer Mr. Tour, the Head of Pensions Peter Wallach, the Strategic Director for Transformation and Resources Joe Blott and Tom Sault the Acting 151 Officer as well as other relevant people.

I do not have contact details for some on the Pensions Committee. I am sending this to the officer who took the minutes of the Pensions Committee meeting on the 14th September 2015 in the hope that it can be forwarded to those I do not have contact details for (the non-councillor members and Cllr Treena Johnson).

As this is a rather technical objection, I provide below a summary of the key points.

However I first need to declare an interest. I have a close family relative who is currently paid a pension by Merseyside Pension Fund, therefore a close interest in the corporate governance of the Fund being done properly.

On the 14th September 2015, I and three other members of the public (two of whom were employed by Grant Thornton and are Wirral Council’s auditors) attended a public meeting of Wirral Council’s Pensions Committee.

One of the functions of the Pensions Committee as detailed in Wirral Council’s constitution is to approve the statement of accounts and financial statements of the Merseyside Pension Fund and recommend these to the Audit and Risk Management Committee.

This is because the Merseyside Pension Fund forms part of Wirral Council’s accounts. There is a statutory deadline to approve the statement of accounts for the 2014/15 financial year by the 30th September 2015.

As mentioned at the Pensions Committee itself by one of the councillors this Fund is valued at ~£6.9 billion.

Item 4 and 5 on the agenda of that meeting were the pension fund accounts 2014/15 and draft annual report.

As the Pensions Committee is a public meeting of a local authority, legislation that governs public meetings applies to it. The statement of accounts formed part of a document known as the “Report & Accounts 2014/15” which was given to those on the Pensions Committee present on the afternoon of the meeting itself.

Please note the reference below to principal council, by virtue of Local Government Act 1972, s.100E also apply to committees and sub-committees of a principal council. The Pensions Committee is a committee of a principal council.

Local Government Act 1972, s.100B(4), is quite clear on the procedure that should be followed in the case of agenda items that are not open to inspection by members of the public five clear days before the meeting.

(4) An item of business may not be considered at a meeting of a principal council unless either—

(a) a copy of the agenda including the item (or a copy of the item) is open to inspection by members of the public in pursuance of subsection (1) above for at least [five clear days] before the meeting or, where the meeting is convened at shorter notice, from the time the meeting is convened; or

(b) by reason of special circumstances, which shall be specified in the minutes, the chairman of the meeting is of the opinion that the item should be considered at the meeting as a matter of urgency.

It is clear that the Report & Accounts 2014/15 for the Merseyside Pension Fund did not fall under the description in s. 100B (4)(a) and therefore the procedure in 100B(4)(b) applies. The Chairman of the Pensions Committee Cllr Paul Doughty did not specify at the meeting itself his opinion that the item should be considered as a matter of urgency, nor would the reasons for this be specified in the minutes.

This is an important corporate governance safeguard written into legislation.

Firstly, if the documents are not made available to the public five clear days before the meeting, the public and press cannot scrutinise them. Secondly (as was mentioned at the meeting itself) at least one councillor expressed the view that half an hour was insufficient to scrutinise a highly technical 46 page document.

This is not a one off occurrence. Officers in previous years have frankly played these games of brinkmanship with accounts routinely handed to those tasked with corporate governance to approve on the evening of the meeting itself. The safeguard above in s.100(4)(b) above, details a procedure to be followed if the matter is urgent.

Therefore my objection is that because of what I have detailed above, the Pensions Committee did not approve the statement of accounts for the Merseyside Pension Fund because:

(a) the report was late and
(b) it is clear from the legislation that a procedural step was missed making the decision ultra vires.

I am however not an unreasonable person and suggest the following course of corrective action. If this is followed I will happily withdraw my objection.

i) That the Pensions Committee holds a further meeting between now and 30th September 2015.
ii) The Audit and Risk Management Committee recommendation is altered (agenda item 12 meeting of the 22nd September 2015) to be conditional on the meeting outlined in i) and the same for any Cabinet meeting that has to approve the same item
iii) That at this special meeting it considers the items referred to in this objection in a way that is not open to legal challenge or perceived to be ultra vires and that the information for this meeting is published on Wirral Council’s website five clear days before the meeting.

As Wirral Council’s auditors Grant Thornton will no doubt make clear, the matter that forms this objections needs to be resolved before the accounts are signed off. I look forward to reading and hearing responses to this objection.

However as this is a perceived serious corporate governance failing, I am making this objection public.

At the end of this piece are 49 pages of invoices paid directly by Merseyside Fire and Rescue Authority. If a councillor pays for a meal or a taxi fare but claims the money back, it’s included in the annual totals for each councillor. You can view the table of annual totals for each councillor that was on Merseyside Fire and Rescue Authority on the Merseyside Fire and Rescue Authority website.

The pages of expenses below that cover stays in hotels, train fares and meals (which would usually be in the travel and subsistence or overnight categories of expenditure of that table) aren’t included. Below is what Regulation 15(3) of the Local Authorities (Members’ Allowances) (England) Regulations 2003 states what should be included. Recipient refers to a recipient of a payment under the allowances scheme.

15. Records of Allowances
….
(3) As soon as reasonably practicable after the end of a year to which the scheme relates, an authority shall make arrangements for the publication within the authority’s area of the total sum paid by it in the year under the scheme to each recipient in respect of each of the following—

(a) basic allowance;
(b) special responsibility allowance;
(c) dependants’ carers’ allowance;
(d) travelling and subsistence allowance; and
(e) co-optees’ allowance.

 

The blog post Which Wirral councillor claimed £50 on taxis to and from a public meeting? includes a letter explaining why Merseyside Fire and Rescue Authority doesn’t do this.

In that letter Janet Henshaw (Monitoring Officer for Merseyside Fire and Rescue Service) writing on behalf of the Wirral councillors wrote:

“It was not possible to show travel & event bookings made directly by MFRA [Merseyside Fire and Rescue Authority] (as opposed to members paying and then claiming back their allowances) due to the fact that this Authority uses an electronic software system to make each booking at the cheapest possible price for both members and officers. We were invoiced monthly in the last year for both Officers and Members without differentiation. Thus it would have been a wholly unreasonable use of scare resources to break this down each month between the two groups and then each and every individual.”
 

CFO on one of the receipts refers to the Chief Fire Officer Dan Stephens. DCFO refers to the Deputy Chief Fire Officer Phil Garrigan. As some of the names of the councillors below will be unfamiliar to readers I include a key below. The key has the name of the councillor, political party, which local authority they represent (or represented as Cllr Ted Grannell and Cllr Tony Newman are no longer on the Fire Authority) and whether they hold the position of Chair or Vice-Chair on Merseyside Fire and Rescue Authority.

I’ll start by declaring an interest in this piece as I write for and run this blog. Earlier this week I got an email from a well-known journalist about a consultation the BBC is running. More information on this is on the BBC’s website.

Personally I’m not sure what to make of it. I don’t have the benefit of working for a media organisation like the BBC that is funded by taxes so gets a guaranteed income. Tomorrow I’ll be filming a public meeting of the Liverpool City Region Combined Authority.

At the previous meeting (19th June 2015) there were three filming the meeting itself:

a) myself
b) Knowsley Metropolitan Borough Council and
c) the BBC for the Sunday Politics show.

However out of those three the footage I took was available to the public first. However I am getting off the point a little. The BBC just used clips of the meeting with a voice over during its Sunday Politics show.

Below is my footage on Youtube (which can be viewed in resolutions to 1080p HD). It has at the time of writing 19 views.

In comparison here is the footage on Youtube filmed by Knowsley Metropolitan Borough Council (at the start of each meeting the Chair generally announces they’re filming and the meeting can be watched on their Youtube channel). It can be watched in resolutions up to 480p. As you can see when they uploaded it to Youtube it’s resulted in a blank black area right, left and top. Generally my view is that if there’s a natural source of light in the room you should try to film with the light behind the camera (this was what the BBC cameraman was trying to do at the start too). Some of the time they film pointing at the windows. However at the time of writing they have 28 views.

Now I’m definitely biased but I think my footage is better (but not as good as the BBC’s (unfortunately I don’t have a link of their video footage to hand to show)).

It’s very hard for me to fairly compete though with Knowsley, who have a Twitter account with 8,842 followers compared to my Twitter account with 970 followers.

I do see competition in the media as a good thing though. If people want to watch footage of this public meeting they have a choice.

That’s why I don’t fully understand what the BBC is proposing. We’re all competing with each other, which means over time we learn from each other and get better. Providing people with a choice is good. It’s how the marketplace and media works.

Collaboration between competing bodies could work to reduce that choice in the long-term if two or more previous competitors collaborate.

Links from the BBC’s website to a hyperlocal blog (through this proposed external linking system) would cause a spike in traffic to the hyperlocal blog as links from the BBC’s website carry a lot of weight.

However hyperlocal blogs who weren’t collaborating with the BBC would lose out on this source of visitors.

What’s really needed is not what the BBC propose. A lot of hyperlocal blogs have filled a media void once occupied by the newspapers. Newspapers get a guaranteed income from the taxpayer through things like public notices as the legislation specifically refers to public notices being published in local newspapers.

Considering the community benefit of hyperlocal blogs what’s really needed is a decent discussion about their long-term sustainability and how essentially their community benefit is priceless. They’re doing media work that otherwise wouldn’t happen. Hyperlocal blogs (including this one) have written stories that lead to front page news stories in newspapers, have highlighted extremely important issues and contributed to greater scrutiny of public bodies.

Apart from the first of these issues, the two latter have a “community benefit” can’t be easily measured or quantified. Anyway going back to the BBC consultation I was asked a further few questions so I thought I’d do a poll here (or you can leave a comment).
