Last week there was a debate at a public meeting of all Wirral Council councillors about whether the decision to close Girtrell Court should be made at a public meeting or behind closed doors.

I thought it would be useful (as there was uncertainty as to whether it would be discussed at all) to start a transcript of what was said during that debate.

Cllr Chris Blakeley Thank you Mr. Mayor.

Mr Mayor, I think tonight I’ll just ask a question of the Leader of the Council this evening, he can see the approach that we have on this subject, the people in the public gallery, who have repeatedly attended in the public gallery at meeting after meeting to make their views known.

Mr Mayor, I’m saddened that I have to bring such a notice of motion, in an effort to underpin the democratic rights of both elected Members and of course the public we are here to serve.

Mr Mayor on this particular issue which revolves around Girtrell Court, this matter goes further than that. It goes to the very heart of why we are here and why we are empowered by the electorate to make decisions in an open and transparent way and in the public arena. In committees, in cabinets and most importantly in this Council Chamber.

Last week Mr Mayor, the Labour Members in this Chamber voted to a person to allow a budgetary decision that can only be made by Council, a decision that will have a massive impact on the most vulnerable people in our care, to be made behind closed doors without any means of challenge by this Council or the people it affects.

Mr Mayor, I’ve scoured the constitution and I’ve got a number of pages here with regards to budget procedures and I simply cannot find anywhere where it says budgetary decisions that can only be made by Council can be delegated to a portfolio holder and an officer to be made at a future date in secret behind closed doors.

Mr Mayor, if this is allowed in this case where will it end?

Mr Mayor, I refer to the Council’s constitution and the constitution is divided into sixteen articles which sets out the basic rules governing the Council’s business and it talks of the principles of decision-making which includes references to respect for human rights and a presumption in favour of openness. Article 1 of the constitution states, “The Council will exercise all of its powers and duties, in accordance with the law and this constitution.”

At (ii) in that it says it will, “support the active involvement of citizens in the process of local authority decision-making;”

and

section (v) states, “create a powerful and effective means of holding decision-makers to [public] account;”.

Mr Mayor, how can making a decision behind closed doors actively involve citizens and hold them to account?

Mr Mayor, section 2.3 states at (e), “All Councillors will be involved in decision making.”

Well Mr Mayor, if that’s the case, then why is that statement not being adhered to?

Article 4 deals with Council’s budget framework and states at the outset that, “the full Council will decide the Council’s budget and policy framework” . Section 4.2 states, “Only the Council will exercise the following functions:

[(i)] adopting and changing the Articles of the Constitution;

[(ii)] approving or adopting the policy framework, the budget and any application to the Secretary of State in respect of any Council land.”

Mr Mayor, again nowhere does it state that decisions on the Council’s budget can be delegated to individual portfolio holders, even in conjunction or not in conjunction with an officer.

Mr Mayor, I’ve looked at Phil [Davies]’ amendment and I have to say at the risk of destroying my street cred I agree with parts of the first paragraph. Yes, this is about people and it is about choice and Mr Mayor the people have made their choice. That choice Mr Mayor is Girtrell Court.

Mr Mayor, it seems people can have a choice as long as they don’t choose Girtrell Court but Mr Mayor that’s not a choice!

The second paragraph tries to justify why a decision has to made behind closed doors. Mr Mayor, this is too important a matter and there is no justification for not making a decision in the public arena.

I’ve looked at the Lib Dem amendment, I have to say it is meaningless. It simply reinforces making the decision behind closed doors and then challenging it. It’s quite clear you know that we can’t really support that.

Mr Mayor, the proposal to close Girtrell Court has caught the attention of the public and in particular the users and loved ones, not just here but around the world Mr Mayor. People have signed the petition from Australia, America, Canada, all over Europe and Mr Mayor while it is one of the smaller savings, this is the issue that is the most devoted and has courted the most publicity in the public budget.

Mr Mayor, if this delegated decision is allowed to take place, then it fully means the Labour Group has changed the constitution without the authority of the Council.

Mr Mayor, the proposal to close Girtrell Court is ill thought out and ill-conceived. However, the very least the hundred and thirty-three families and the forty-five staff can expect is that any decision is made in the public arena and not in secret behind closed doors.

Mr Mayor, it’s not too late for the Leader of the Council and his Group to listen to the people, to listen to the ten thousand people who’ve signed petitions, to listen to the hundred and eighty-nine people who had their say on the consultation and to give them that choice, the choice they want Girtrell Court.

Mr Mayor, I urge the Council to support this motion.

So, let’s be very clear at the outset, this issue is about giving disabled people and their carers greater choice in their respite care.

The fundamental issue that we’re facing up to and I believe we have faced up to as the new structure is that our entire budget for respite care, it’s £1.5 million is tied up in twenty beds in a single building.

Now we know that, I’ve seen the evidence that many of our service users and their families do not want a traditional residential type facility for their respite care.

However, because all of the budget for respite care is tied up in this one

unable to meet the needs of and the demands I think of all our

So I believe Mr Mayor that reproviding this care, which meets people’s needs more effectively, I think is the right way forward.

I’ll just give you a few examples of alternative respite care…

Cllr Louise Reece-Jones Mr Mayor, as a deaf Member of the Council, it is very difficult to keep up with the conversation and I’m to make an informed decision on how I would vote on this.

I have two sign language interpreters that find it very difficult to listen to both the Leader of the Council and also to give me the conversation that’s happening on the balcony which everybody else is privy to and I’m not as a deaf Member. So I would ask the Council please so I can take part in this full debate as an elected Member that we have a little bit of respect.

Councillors at yesterday evening’s meeting of Wirral Council debated a notice of motion on Girtrell Court proposed by Conservative Cllr Chris Blakeley. He asked councillors to agree that the decision on the future of Girtrell Court should be taken during a public meeting rather than behind closed doors.

The Labour councillors (in an amendment proposed by Cllr Phil Davies) disagreed with this and instead restated their previous position. Their view was that a decision on the future of Girtrell Court should be made behind closed doors by the Cabinet Member Cllr Chris Jones and the Director of Adult Social Services Graham Hodkinson.

The Lib Dem councillors (in an amendment proposed by Cllr Phil Gilchrist) agreed with the original motion, but called for all the background and supporting material to be published when Cllr Chris Jones makes her decision.

The Lib Dem amendment didn’t receive enough votes to be agreed as it was only supported by the four Lib Dem councillors. Labour’s amendment received 36 votes for, 24 votes against with one abstention.

It was also announced during the debate that bookings for Girtrell Court will be extended to the end of August 2016.

The following was agreed yesterday evening by councillors:

Girtrell Court

Council believes that it is important to offer service users and their families a choice of respite care provision. People want the ability to choose the type of care and support which is right for them. At present they are unable to do this. This is not about a building or provider, it’s about the person.

Council notes that the Leader of the Council has previously stated that he wants his Administration to be open, transparent and fair with the people of Wirral. Council welcomes this approach.

Council notes that a detailed debate on Girtrell Court took place at Budget Council on the 3rd March and a clear way forward was agreed. This involves statutory consultation with service users and their families followed by a clear new service offer and events for carers and cared for people to meet potential new providers. Services will be commissioned to meet all of the identified needs at that stage. Authority will be delegated to the Director, in conjunction with the Cabinet Member, to make decisions in order to avoid undue delays which would prolong uncertainty. We are not imposing deadlines on when this process will be complete and, in the meantime, Girtrell Court will remain open.

Council further believes that the families of those using Girtrell Court, the staff, trade unions and residents and users must be given every opportunity to influence the future of Girtrell Court through a clear and transparent decision-making process.

To very little fanfare, Wirral Council have published the 12 page peer review conducted by the Local Government Association last year. This was accompanied by a press release which glosses over some of the criticism in the peer review.

Here are some quotes from the peer review (followed by my comments in italics):

Financial Strategies

In past years the council has been overspending in some directorate revenue budgets and using its reserves to balance the revenue budget. This issue was reflected in the previous peer challenge in 2012 and the council needs to develop the 2016/17 budget and not divert from it. It is currently anticipating a £9.2m slippage on this year’s savings target of £38m.

Political leadership

The Leader’s role as Chair of the Merseyside City Region is seen as recognition of the important role that the Wirral is playing in the development of the city region.”

 

Well shortly after this peer review, Cllr Phil Davies resigned as Chair and Mayor Anderson is now Chair of the Liverpool City Region Combined Authority.

“However, the Senior Leadership Team is not currently giving adequate corporate leadership and this needs to be much stronger if the Plan is to be delivered effectively. More connected leadership is needed from the top to the bottom of the organisation. The council must have the senior officer leadership resource to create capacity to deliver change. The peer team also had a concern at the current high use of consultants and interims who are providing temporary specialist support. This is not a concern about consultants/interims per se, but an observation about their number and duration. The council should continue to ‘invest to save’ – efficiently and effectively – using the right external help for specific time-limited purposes, but look to reduce the overall number of longer-term interims in key roles. The council needs to move quickly to a new organisational shape to support the Chief Executive, including providing the right kind of strategic level capacity.”
 

If I hadn’t written Why has Wirral Council spent £6,003,273.07 on temporary staff over the past 10 months? around a year ago, would this have even been mentioned in the peer review?

Relationship with residents

The council and its partner agencies recognise that they want to form a different relationship with residents in the future. There is general recognition that relationships with local communities has been negatively impacted by the past challenges the council has had to deal with. The new relationship will be based on a clearer Wirral narrative, a greater ability to listen to resident’s issues, making better use of the data and intelligence the council gathers across the Wirral and greater use of channels use as digital and social media.”

 

Ahh, listening to residents’ issues such as over 6,000 signing a petition against closure of Girtrell Court but you go ahead and decide to delegate closure to the Cabinet Member anyway? Or is this all part of listening to residents then doing the opposite of what they want?

The Council’s approach to partnership working

There is evidence of community involvement in the council’s budget processes, although more limited evidence that this has influenced decision-making.”

 

So, this seems to imply that when Wirral Council have a budget consultation, the consultation has a limited effect on the decision after the consultation?

“There is also an opportunity for a more coordinated and cost-effective approach to community engagement amongst the Wirral Partnership members. This might extend to a more joined up approach to communications and campaign activities.”
 

Despite reading this a few times, I’m a little unsure what this means? Anyone care to hazard a guess? I thought the constituency committees were supposed to do community engagement?

New Models for Service Delivery

Delivering significant change must take account of some instances of low staff morale generated by the perception of indiscriminate universal cuts in service provision in recent years.”

In other words Labour councillors constantly going on about government cuts nearly every public meeting is damaging staff morale at Wirral Council.

“The move to new ways of working will need to be driven by a much more powerful Senior Leadership Team to collectively own and drive transformation.”
 

In other words, there’s going to be a senior management restructure and some managers are going to be leaving.

Yesterday Wirral Council responded to my FOI request for the more recent invoices from Eye Cab Limited for taxi journeys by councillors.

These don’t include taxi journeys where councillors have paid for the taxi themselves and then claimed back the cost.

Sadly, due to a lot of missing pages (curiously always the ones with councillors’ names on them), plus a number of pages scanned at such low quality making them very difficult to read, I’ve requested an internal review.

There was an £85 taxi journey listed on page 5. By the price list published on my blog here it comes to a taxi journey of around 67 and a half miles.

Sadly the second page of the invoice that invoice from May 2015 that would state who undertook this unusually long journey is not supplied. The invoice itself is of such low quality it’s hard to read how far this journey was. However if you’re going on a journey that far why not take the train instead?

In fact if the journey was by a councillor then Wirral Council’s constitution states (members means councillors):

8. Travel and Subsistence

Travel Costs

8.1 Travel costs incurred by members in performing “approved duties” as specified in Schedule 2 to this Scheme shall be reimbursed at the prevailing public transport rates, provided that the use of taxis or members’ private motor vehicles may be permitted where public transport is either not available, or the journey by public transport would be likely to result in unreasonable delay.”

Sadly as Wirral Council didn’t respond properly to this FOI request it’s impossible to tell whether a councillor took this journey or not!

However over the 6 months of invoices where names were supplied, here are how many taxi journeys were undertaken by each councillor at the taxpayers’ expense. For shared journeys I’ve counted it as one journey for each councillor sharing the taxi:

Councillors on the Merseytravel Committee met on Thursday afternoon to decide on a recommendation on Mersey Tunnel tolls for 2016/17. Their recommendation was accepted at a meeting of the Liverpool City Region Combined Authority that met the following day on Friday morning.

The decision made was that cash tolls would be kept the same for 2016/17 as they were in 2015/16. The cash toll levels decided for 2016/17 are shown below.

There were also other changes agreed for 2016/17. Tunnel tolls will be waived for all classes of traffic between 10 pm on Christmas Eve (24th December 2016) to 6 am on Boxing Day (26th December 2016). All designated emergency vehicles will no longer have to pay tolls in 2016/17.

These were the votes on the Mersey Tunnel tolls decision at the Liverpool City Region Combined Authority meeting.

Reacting to the decision, John McGoldrick representing the Mersey Tunnels Users Association stated that “the [Liverpool City Region Combined] Authority would still be making a massive profit from the Tunnels and that most users of the Tunnels would not be seeing the reductions in tolls promised last year.”;

During the meeting of the Liverpool City Region Combined Authority Cllr Phil Davies (pictured below) said,

“Yeah, I’d just like to say a few things about this. I welcome the recommendations of Merseytravel yesterday and the recommendations in this report.

Errm, I think I just need to record the fact that I’ve been involved in the errm the Task Group that’s been looking at this so, this issue errm, but I clearly wanted to, to hear what the outcome of the meeting is today was and I do endorse the approach.

I mean from each err, errm, we did make a commitment in the devolution deal that we gain control of the finances of the Mersey, Mersey Tunnels, errm and certainly you know, wearing my Wirral hat, I think this is definitely a big move forward, errm.

You know, the id.., the fact that the errm the cash toll has been frozen for a further year is great news but even more importantly the Fast Tag, which is effectively a local discount, is being reduced by 20p. So that would mean that errm, there’ll be a 50%, 50p discount per a journey, using the Fast Tag which if you’re travelling, if you’re travelling each day, it could be a saving of £5 a week.

So I think this is err, you know if I can use the expression, I think this is the kind of devolution dividend deal if you like, the deal that was signed with government, I think it will help local people who use the Fast Tag and local businesses. Errm and I really think this is a good demonstration of the value we’re getting already from the devolution deal but finally Chair I’d like to say I’m hoping in future err years we can go even further.

I think we need to do err more work, err more, I know there are more discussions errm err going on with government about us gaining even greater control over the finances of the Tunnels. Certainly from a personal point of view, I’d like to see us continue to drive down the costs of the err tunnel tolls for residents particularly local users, but I do welcome the recommendations in the report. Thanks Chair.”

 

Just for clarity, the discount for Fast Tag users (compared to cash tolls) for 2016/17 is not 50% as stated by Cllr Phil Davies. It’s (to the nearest percent) 29% for class 1, 29% for class 2, 29% for class 3 and 29% for class 4.
