The above quote is very suitable for another tale of bureaucracy gone wrong involving Wirral Council.

The below exchange shows a tale of Wirral Council that is sadly familiar, blaming the disabled, making them pay more, making sure officer’s plans can get approved by preventing those pesky members of the public objecting! In the “changed” Wirral Council I hope my intervention will lead to change. We shall see. I suppose in this case they just have the bad luck that these proposals affect this blogger’s wife (which in the interests of openness and transparency/ethics I’m declaring at the start of this piece). Dear Carl Amos (and others),

Thank you for your email of 4th August 2014 (your CRM reference 825834) in reference to a proposed traffic regulation order for Birkenhead Market Service Road, Birkenhead.

I appreciate the apology you give in paragraph two. The public notice (which stated was published by Surjit Tour) for this proposed traffic regulation order was published in the Wirral Globe on Wednesday 9th July 2014 and stated “A copy of the Order, map and a statement of the Council’s reasons for proposing to make the Order, may be seen at all reasonable hours at The One Stop Shop, Town Hall, Seacombe, CH44 8ED”.

My wife and I attended the Seacombe One Stop Shop on the afternoon of the 9th July. The staff at the One Stop Shop informed us that they had not been given a copy of the Order, map and statement of the Council’s reasons. Therefore we were unable to view them at this point and make any objections to the proposed TRO. What was the point of publishing the notice in the paper directing people to the One Stop Shop to view this when they did not have it?

Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996, SI 1996/2489 states in Regulation 7(3) “The order making authority shall comply with the requirements of Schedule 2 as to the making of deposited documents available for public inspection” and Schedule 2 states in relation to the documents that they are to “be made available for inspection at the principal offices of the authority during normal office hours”.

This clearly didn’t happen. It is of course unknown how many (if any) other people would have made an objection as they couldn’t inspect or view the documents relating to this proposed TRO. I would therefore suggest that if you wish to proceed with the next stages of this TRO that you re advertise it in the press, this time making sure that you supply copies of the documents for public inspection to the One Stop Shop prior to having the notice published! Otherwise, it casts legal uncertainty as to the legality of any TRO that results as the regulations regarding consultation weren’t followed.

My comments on the proposed TRO are below (which it would be useful to feed into councillors doing the car parking review therefore I would appreciate it if someone would forward this to them):

I’ve been asked by my wife to respond on her behalf (but I am also commenting in my own capacity) to the proposed traffic regulation order as she is one of the people that will be affected by it if it goes ahead.

I will deal with the points raised first in your email. Parking is already prohibited for blue badge users along most of the Birkenhead Market Service Road as the majority of it is currently either loading bays or is double yellow lines with kerb blips (where those with blue badges can’t park).

Therefore parking in a way that’s obstructing loading bays is already something that a driver doing so could receive a ticket for. The proposed TRO won’t change the parking restrictions in the area around the loading bays so without greater enforcement any existing problem of obstructive parking is likely to continue even if the TRO is agreed.

In relation to displaced Blue Badge users. You refer to free car parking in the Grange and the Pyramids multi storey car park for blue badge users. However free parking in these car parks is only on a Sunday (for all users). Monday to Saturday there is a charge of £2 to park in either the Grange or Pyramids car parks which applies to all users (irrespective of whether they have a Blue Badge or not). Therefore it is misleading to refer to the Grange and Pyramids as “free disabled parking facilities” without mentioning that these are only free on a Sunday. Any concerns raised by the Pyramids/Grange Shopping Centre have to be viewed in light of a commercial interest in increasing patronage of their car parks by reducing parking for blue badge users on the Birkenhead Market Service Road.

There are 14 blue badge parking spaces in the Europa Square car park and 6 in Oliver Street (according to your website). I have no idea exactly how many disabled parking bays are available on Conway Street, but from memory it is not many.

The issue however is not the number of alternative free spaces (referred to in your email) but the fact that at the times when the shops are open it is often impossible for blue badge users to find one of the alternative parking spaces you refer to as available. My wife requires extra space around the space she parks in in order to safely get in and out of her vehicle. She uses a walking stick and has mobility problems due to a disability she has had from birth.

It is clear looking at the numbers of disabled spaces in the car parks in Birkenhead (compared to the overall numbers) and the numbers of blue badges issued by Wirral Council that there is under provision of spaces for blue badge users. I don’t believe that the proposed TRO will achieve its stated aim of road safety and Wirral Council has to be very careful (from the way your reasons are phrased) as it appears you are trying to make disabled people scapegoats.

There are a whole range of legal duties Wirral Council has, such as the public sector equality duty and due to what I’ve written above the impacts that this proposed TRO would have on blue badge users has not been fully thought through. For example those with mobility problems would be forced to park further away from where they’re shopping. This might not be a problem for the able bodied, but for those for whom the extra distance will cause additional pain and suffering is morally (and probably also legally) wrong.

I realise Wirral Council has had a chequered history with regards to how it has treated minorities (including the disabled) in the recent past. I hope the culture however has changed and I will receive a positive response to this letter and assurances that actions will be taken to prevent this happening in the future. Due to the serious corporate governance failings it highlights I am also publishing this letter. Please class it as a complaint/objection to the proposed TRO/to be fed into the car parking review.

Above is a photo of a carnival you will probably never get to see in a newspaper as it shows two disabled people in wheelchairs participating in the parade. So why am I showing you this and what relevance does it have?

For years, Wirral Council has got itself into trouble on disability issues. I’ll briefly recap, Martin Morton and the way Adult Social Services treated disabled adults, the proposed closure of Moreton Day Centre and now the proposed closure of Lyndale School.

The thread running through all of those is an extremely dangerous one to tell society. It’s one of withdrawing services for those with a disability or in the case of Martin Morton’s whistleblowing shamefully taking advantage of adults with disabilities as some of them due to the nature of their disability can’t stand up to organisations like Wirral Council without outside help.

So what sort of message does this give out? It’s one of jealousy of the vital services people require because of their disability. It’s one that fuels an increase in disability hate crime (much of which goes unreported). It’s one (that in the case of Lyndale School) thousands signed a petition against it going any further.

Disabled people are a part of society. I was brought up in the 80s and we were taught to be accepting and tolerant. When I was a teenager I went to school with a lad who had epilepsy, he used to routinely have fits and the school called an ambulance due to him knocking himself out. We didn’t treat him any differently though because of his epilepsy! We treated him as a friend.

In adult life I sat on a university committee of staff and students (I was there to represent the views of ~17,000 students). In what to some will seem an extremely ironic twist, the law library wasn’t accessible to wheelchair users as it was on the first floor. Despite our pleas, despite this being unlawful, the Chair of the committee was told that the university wanted to spend the small amount of money for adapting the building on other things. Disabled students weren’t a priority you see, not to senior management who came from a bygone age when people with disabilities didn’t go to university.

However, politicians have to be extremely careful when dealing with sensitive issues involving minorities. There’s a sensational over reporting of benefit fraud cases in the media. Officially more is lost to administrative errors than benefit fraud and the rates of benefit fraud are extremely low. Due to the press coverage this isn’t what some of the public think. Telling the public such boring facts sadly doesn’t tie in with the political line of some irresponsible tabloid sensational journalism.

So going back to Lyndale School. My views on it are well known and on public record. I don’t have any personal connection to the place other than having known its Chair of Governors Tom Harney for many years. The problem for Wirral Council is this though, it has a very chequered history involving disability issues that the public know about through the press. Such issues weren’t caused by one or two people being prejudiced but a culture at Wirral Council that allowed this to operate.

Now I know there are plenty of politicians at Wirral Council that know what happened in the past was wrong and despite what some people may think about politicians I know that many have a highly developed sense of right and wrong and know in their hearts when they’re asked to vote for something they don’t believe in. Yes, I’m being reasonable to politicians for a change.*

*A rare occasion I know.

The change has to start with them though, the rhetoric has got to change, the demonising of the disabled and minorities in society that they know can’t speak back has got to stop. For that they’ve got to look into their hearts. They’ve got to realise the damage their actions, that their words are doing to society at large, they’ve got to have some understanding of the consequences.

The people involved in the Lyndale School campaign are wonderful, pleasant people. Just because I wrote about what was happening I got sent a thank you card! I’ve never received a thank you card for a story I’ve written on this blog before (or since).

No, don’t be silly I’m never expecting a thank you card for writing about politicians but I’m trying to get across that the people involved with Lyndale School are very different to the political class. Unlike how certain politicians are being portrayed I don’t think many of the people involved in Lyndale School have even one ruthless bone in their entire body.

Yet this has been a struggle for them, they have families to care for and children with very complex and life limiting conditions. Many of them should be rewarded, applauded for the unsung work they do every day, unthanked by some politicians who now propose pulling the rug out from under their feet. The work of unpaid carers doing hard work in difficult circumstances saves the taxpayer billions each year.

The issues involving disability, culture, prejudice and stereotyping are extremely complex. They won’t be solved overnight. The law has changed, such legal battles have been won but society itself needs to catch up. My plea to politicians is to show leadership, to realise the sensitivities of these issues and to realise there are times when the politically right thing is to show compassion, humility and be flexible enough to have an open mind on such issues. The days of prejudice and stereotyping by politicians should be confined to the history books as they no longer have a part to play in 21st century society.

Continuing from yesterday’s publication of the appendices to the Anna Klonowski Associates report the next Adult Protection Strategy Meeting at pages 336-337 has one of the most chilling lines I’ve ever read in minutes of a meeting which is “The money that the service users have left over is given to (name blacked out), for the service users to have a nice grave when they pass away.” This is from August 2005, but it shows a shocking attitude of one of the people present who seems to almost go as far as wishing people with a learning difficulty dead!

The new accounts have been opened for the residents they will receive the interest on there accounts. CSCI feel this is good practice on the service users behalf.

3. It was felt to prevent any suspicions being raised by (name blacked out), Halifax will open the accounts. The accounts will be carefully monitored.

Accounts have now been open; Halifax will monitor and inform Adult Protection if an incident occurs.

Update:

Police – Satisfied that this is not criminal and that (name blacked out) has done this for the right reasons not the wrong reason.

Social Services – Better practises need to be put in place in managing finances for people with learning difficulties.

Birkenhead North railway station steps (problems with disabled access)

Last Thursday at its Annual Meeting, Merseytravel agreed £3.38 million of investment in improved disabled access at Birkenhead North train station. Merseytravel received £1 million towards the project from Network Rail’s “Access for All” fund, £1.2 million from Network Rail’s Enhancement Fund and a further £300,000 from Network Rail. The work is planned to be completed by March 2014.

Wirral councillors welcomed the news. Cllr Steve Foulkes told those present at the meeting that it was his local station and that completing the link to the car park would have a beneficial effect on residential parking at Birkenhead Park. Cllr John Salter thanked officers for coming forward with the proposals and referred to the regeneration going on in the area, such as Peel’s plans for an International Trade Centre.

John Brace, pictured in the photo who started campaigning for improved disabled access at Birkenhead North railway station in 2008 said, “The news surrounding the planned work to improve disabled access at Birkenhead North railway station by next year is welcome. Neil Scales, the former Chief Executive of Merseytravel stated in a letter to myself in 2008 that “Merseytravel’s … aim is to provide step free access at all stations on Merseyside.”

“There is a footbridge at Bidston and stepped ramps at both Upton and Birkenhead Park railway station, so there is still a long way to go before stations in the local area are accessible. A legal case in the Court of Appeal in 2004, Roads v Central Trains Ltd [2004] EWCA Civ 1541, was brought by a wheelchair user against their local train company because of an inaccessible train station. Mr. Roads was paid £1,097 in compensation (and his legal costs) because of disability discrimination and Central Trains limited was forced (despite an estimated cost of £750,000) to improve disabled access at the train station.”

“People who certain disabilities are entitled to a free public transport pass, yet it is wrong that many disabled people have a pass that they can’t use at their local train station due to access problems. Improving disabled access also makes life easier for cyclists and people pushing pushchairs. I hope that Merseytravel and Merseyrail will take its legal responsibilities seriously not to discriminate against disabled people and improve the other inaccessible stations in the near future. Three Lord Justices agreed that the cost of adapting the train stations is not a reason to discriminate against disabled travellers.”
