Subject: protected disclosure (Public Interest Disclosure Act 1998)ED 18th February 2016: Although I originally thought I fell within the definition of worker in this legislation it seems I do not.

Dear all,

I am making this protected disclosure to Merseytravel, the Liverpool City Region Combined Authority and Knowsley Metropolitan Borough Council and KPMG.

Basically I am blowing the whistle and as I have little confidence in these matters being taken seriously by the public sector or addressed in a satisfactory manner I am also taking the step of publishing these concerns.

Obviously there are other routes I can go down other than this, but I hope this will resolve matters.

From this part onwards I will number the sections for ease of reference in replies to this communication.

1.
Introduction

I am a member of the press called Mr. John Brace. Part of my job is covering public meetings of the Liverpool City Region Combined Authority. For clarity I am both a member of the broadcast media (as I film such meetings) and new media as I write online about these meetings. I write online at http://johnbrace.com/ , which last month (December 2015) had an audience of around 3,345 readers. I publish the video I record on the Youtube channel at https://www.youtube.com/user/level80 which in December 2015 was viewed for a total of ~87 hours.

Openness of Local Government Bodies Regulations 2014

On the 6th August 2014 a piece of legislation called the Openness of Local Government Bodies Regulations 2014 came into effect. These can be read at http://www.legislation.gov.uk/uksi/2014/2095/contents/made and I will briefly summarise some of the main changes it made relevant to this protected disclosure:

a) it changed the existing legislation to place a positive duty on certain public bodies that now had to allow filming at their public meetings (regulation 4(5)),

b) it changed the existing legislation to make it clear that such recordings of public meetings could be published (explicitly mentioning the internet) (regulation 4(5)),

and

c) Please note in order to allay any confusion in what I am about to quote, I will point out that s.100J of the Local Government Act 1972 (which defines various terms used in Part VA means that “principal council” includes a combined authority.

This is a quote from regulation 4(5) which modifies the Local Government Act 1972.

“A person attending a meeting of a principal council in England for the purpose of reporting on the meeting must, so far as practicable, be afforded reasonable facilities for doing so.”

3. 26th January 2016
On the morning of the 26th January 2016 I attended the Merseytravel Offices which are at No 1 Mann Island, Liverpool, L3 1BP. For the purposes of brevity I will refer to this location as Merseytravel HQ.

This was to attend and report on a public meeting of the Liverpool City Region Combined Authority Audit Committee which was scheduled to start at 10.30am. I was there with my wife and colleague Leonora Brace.

There was also at least one other member of the public present during the meeting called Ian Warwick, who works for the external auditors KPMG to the Liverpool City Region Combined Authority.

4. What happened

We arrived at the ground floor of Merseytravel at approximately 10 am.

The meeting was to be held on the first floor of Merseytravel HQ (in a room called the Authority Room).

We were told by the receptionist (I have a recording of this conversation on tape which can be supplied) that we would not be permitted to go through the barrier to this meeting (which started at 10.30am), until 10.45am.

Obviously had we taken her assertion at face value (and it causes a certain degree of work place stress to have to continually fact check what a public sector employee states to us) this would have been a breach of our rights to attend the public meeting and report on the public meeting.

There have been times in the past at Merseytravel HQ when we have arrived in plenty of time before a meeting has been to start.

However to give an example of what happened once, we had been kept waiting and not permitted to go to the room where the meeting is held until well after the meeting had started (by the time we were allowed to attend it was from memory had started thirty minutes before). It then causes us embarrassment to arrive late to a meeting when we had indeed on that occasion arrived in plenty of time. It made it impossible then for example to report on agenda items that had already happened.

Public meetings start at different times. For example these are the start times of public meetings held at Merseytravel HQ this month (I include the cancelled Combined Authority meeting scheduled for the 22nd January 2016 too):

11.00am, 11.15am, 10.30am, 2.00pm, 2.00pm, 2.00pm.

There are other public meetings held in Merseytravel HQ too such as the Merseyside Waste Disposal Authority (also known as the Merseyside Recycling and Waste Authority) which start at 1.00pm.

Invariably due to the confusion caused by the receptionist stating that we wouldn’t be able to go into the meeting until 10.45, I had to double-check the time of the meeting using the guest wi-fi.

I found out that the meeting was supposed to start at 10.30am. The receptionist was therefore wrong in her assertion that we should not be allowed in until 10.45am.

I also took the opportunity to read the Combined Authority’s policy on filming.

The Monitoring Officer for the Combined Authority is Angela Sanderson. She does not work for Merseytravel, but for St Helens Borough Council.

The agreed filming policy for the Combined Authority meetings (which presumably covers meetings of its Audit Committee) is based on that originally adopted by Knowsley Metropolitan Borough Council. It was agreed on the 22nd September 2014.

In that policy the phone number of 0151 443 3536 (the press office of Knowsley Metropolitan Borough Council) is given for enquiries.

However Knowsley Metropolitan Borough Council have (as far as I know) no part in the public meeting of the Liverpool City Combined Authority Audit Committee of the 26th January 2016.

The papers for the meeting are published on Merseytravel’s website, see http://moderngov.merseytravel.uk.net/ieListDocuments.aspx?CId=336&MId=1343 and the minutes are taken by a Merseytravel employee.

Here is a transcript of part of my conversation I had with the receptionist (who seems a textbook example of the doctrine of “superior orders”) to the extent below:

John Brace: This is the filming policy they use here, it’s the Knowsley Council one they use because they’re the ones that administer the Combined Authority and it says,

“Anyone wishing to do so is asked to inform them in advance to ensure any necessary arrangements can be made.”

So does that mean you need to ring the press office here or Knowsley?

Denise (who has a phone on her desk) (Merseytravel employee): No, they’ve given me instructions not to let any members of the public in there.

John Brace: No what I’m saying is your filming policy …

Denise (who has a phone on her desk) (Merseytravel employee): up until 15 minutes before until someone else is in that room.

John Brace: Sorry this is something different. Your filming policy says you request to be informed in advance of the meeting, so that’s what I’m doing.

Denise (who has a phone on her desk) (Merseytravel employee): Yeah, yeah.

John Brace: So what I’m saying is, it says media enquiries to be conducted to the Communications Team, does that mean

Denise (who has a phone on her desk) (Merseytravel employee): There you go, there’s Louise.

5. The conversation with Louise Outram

Before the public meeting started, myself and Leonora Brace had a conversation with Louise Outram (who as far as I know is the Monitoring Officer for Merseytravel) about these matters.

I will point out at this stage that this is not the first conversation I have had with Louise Outram about these issues.

Louise Outram: OK, Mr & Mrs Brace, can I take over here please?

Louise Outram: What’s the problem this morning?

John Brace: Well, the filming policy does say you require advance notice, so I was just asking whether that goes, because the policy was Knowsley’s policy so I’m not sure whether that phone number is Knowsley’s press office or your press office?

Louise Outram: Err, that looks like Knowsley’s number.

John Brace: Ahh, OK.

Louise Outram: Well I think it’s been accepted that you will film. We don’t have a problem with that. We can’t gain access to the building until there’s a committee officer within that room.

Leonora Brace: Yeah, but surely we can go upstairs and sit outside?

Louise Outram: No, you can’t. It’s a public, this is the public area and the meeting is a public meeting and we will afford you the reasonable facility to film.

Fifteen minutes before the meeting gives you sufficient time to set up your camera and at fifteen minutes before the meeting there’ll be a democratic services officer in that room.

We cannot allow the public unrestricted access to this building. We’ve got private tenants and public offices.

John Brace: Well we’ve seen plenty of members of the public go through when we’ve just been here in this short period for instance there’s one of your auditors from KPMG that doesn’t actually work for Merseytravel has gone through. You know other people have gone through into what you term as a non-public area. So,

Louise Outram: They, those officers have a legitimate meeting in this building. You have a right to the public meeting. The public meeting doesn’t start until 10.30, it’s only 10 o’clock now.

John Brace: You said 10.30, is that

Louise Outram: Yes.

John Brace: correct? I’ll just check on that, because I thought the time was different on the website,
Louise Outram and Leonora Brace: No, it’s 10.30.

John Brace: If you look here I’ll just show you, oh yes it says 10.30. Sorry I’m thinking of another one that starts at 11.15,

Louise Outram: They’re all different times unfortunately, so it is important to check the time.

(a number of people speak at once)
Louise Outram:
Yes, as soon as a Committee Officer, a Democratic Services Officer is in that room, they’ll advise Denise and Denise will allow you access up to that room to set up your camera, in the place that you normally set it up.

John Brace: The only other thing is that Leonora was saying is she’s a ********. The problem with sitting here opening and closing a lot it does get quite cold and draughty down here.

Louise Outram: Well I’m afraid we can’t do anything about that. The door has to open and close. I mean all I would suggest is that you arrive at 10.15 or fifteen minutes before whatever meeting time is scheduled and in doing that you will then be afforded the facility to come through.

John Brace: Well today for instance, as you know there’s bad weather and disruption to the transport network so it’s only advisable to leave a bit of extra time.

Louise Outram: Well I can’t allow you into the room until there’s a democratic services officer. Denise will advise you when that is. So if you’d like to sit, you’re more than welcome to sit here.

If you’d like to walk around the block, you’re more than welcome to do, but they’ll allow you in fifteen minutes before the meeting starts. OK, alright? I’ll notify Democratic Services that you’re filming again today. We do generally take it as read that you are afforded facilities to do that, so, we’ll, that’s not a problem, ok?

John Brace: Well another question I want to ask is, it states err “reasonable facilities” in the regulations, but it doesn’t actually state what they are so, is there some kind of understanding between us as to what they are or what?

Louise Outram: You come in, you are there are seats available, you generally set your tripod up, you generally move it around as in the camera around, so

John Brace: Sorry receipts?

Louise Outram: There are seats available for the public and you generally.

John Brace: Sorry I thought you said receipts.

Louise Outram: No,

(laughter)

John Brace: It’s the echoes in here isn’t it?

Louise Outram: No, you generally sit yourself in a particular position which affords you a good view of the, I mean I’ve seen your films, you know it affords you a good view of the Chamber and people are reminded to use their microphones, so we do try and ensure you get a good video of the meeting.

So I think we afford you reasonable if not very good facilities!

(laughter)

Louise Outram: The legislation unfortunately doesn’t describe anything formal but, and it doesn’t give any guidance as well, so I would say we (unclear)

I think so, I think you’re getting yourself a good spec.

Leonora Brace: It’s nearly ten past now!

Louise Outram: Well the Democratic Services officer will notify Denise and she’ll allow you access through.

John Brace: But it’s not Denise’s decision?

Louise Outram: She’s acting on instructions from ourselves.

John Brace: Oh I was trying to explain to Leonora, that she was getting instructions from above, it’s not her decision to make.

Louise Outram: It’s not Denise! (laughter)

John Brace: Does that help at all or not?

Leonora Brace: No.

6. Conclusion

There are many issues this raises.

For example the public sector equality duty (which was ironically raised by Cllr Pam Thomas at the meeting we were at). .

For example the area Louise Outram insists we wait in has no access to water or toilets.

This discriminates against two people with protected characteristics as Merseytravel is fully aware why we would require greater access to these than others.

To give one example, the pollution found in Liverpool City Centre, where Merseytravel HQ is based makes me thirsty because I’m an asthmatic.

Merseytravel is fully aware of the disability I have and the nature and extent of those disabilites as a District Judge at Birkenhead County Court found in the past that Merseytravel had discriminated against me three times (but accepted Merseytravel’s defence that on each occasion it was a proportionate means of achieving a legitimate aim).

One could regard denying me access to water in such circumstances as degrading treatment contrary to Article 3.

Are we expected to bring our own water to such meetings?

Article 2 deals with freedom of movement which is again restricted.

It is unlawful for a public authority to act in a way this is incompatible with a Convention Right (s. 6(1) of the Human Rights Act 1998).

Merseytravel states that it prides itself on good industrial relations with its workforce. We both work in Merseytravel HQ, yet not for Merseytravel. Yet Merseytravel management unilaterally imposed this new policy upon us without formally consulting us first.

I hope I will receive a satisfactory response to the issues raised. Not just for my benefit, but for that of Leonora, other members of the media who attend public meetings at Merseytravel HQ and indeed the wider public who may wish to do so.

Long drawn out legal cases are neither beneficial to either Merseytravel or myself, adverse press criticism is about the only tool I have to bring about change.

Merseytravel is part of the public sector and should be able to resolve this issues well before they get to this stage.

I would hope that after having read the above that matters will change.

However realising how difficult cultural attitudes are to change in an organisation, I am not hopeful of a quick resolution to these matters.

P.S. Last year I heard Mayor Anderson (now Chair of the Combined Authority) state at a public meeting how hurt he was when decisions affecting his employment with Chesterfield School were made without prior consultation and about his political beliefs as a trade unionist.

If Merseytravel have behaved in the way I describe above (which I have the tape to prove), then management is not acting in accordance with the political belief of the Chair of the Combined Authority who is answerable to the public for its functioning.

You can view what was said at a public meeting earlier this week on the subject of devolution for Merseyside above. It’s openly admitted however that the communications/engagement/public relations side of this has been pretty poor.

I will disagree with something that’s been said throughout this process since it doesn’t make sense (although from press reports Cllr Phil Davies has done a U-turn in favour of a Merseyside Mayor).

It’s been stated (in the video above by Ged Fitzgerald, Liverpool City Council Chief Executive and Mayor Joe Anderson before) and again and again that the price of devolution is a Merseyside Mayor. This whole process based on the Cities and Local Government Devolution Bill which is wending its way through parliament.

I realise legislation does get amended, but as it’s on its 8th parliamentary stage out of ten it’s going to be eventually (especially as it’s a government bill) mainly in the form it’s now in.

Here’s the section on an elected Mayor.

It modifies the Local Democracy, Economic Development and Construction Act 2009 to state:

107A 15 Power to provide for election of mayor

(1) The Secretary of State may by order provide for there to be a mayor for the area of a combined authority.
(2) An order under subsection (1) shall not be used as a condition for agreeing to the transfer of local authority or public authority functions.”

In other words what is repeatedly repeated (and perhaps why they’re so bad at communications) doesn’t make sense. The government can’t say we’ll give you this if you have an elected Mayor and the price/prize thing is a load of rubbish. The government can’t do that as the legislation that will underpin this (which has to come into force to trigger the next stage which would result in devolution) makes that unlawful.

With me so far?

The government knows this is going on and I’m sure that it doesn’t make them look favourably on Liverpool when these sorts of political shenanigans to make them look bad, are being played out amongst Merseyside’s more ambitious Labour politicians.

So why would this have got started?

My best educated guess (as trying to make sense about what’s going on with the Liverpool City Region Combined Authority with its poor public relations is like wading through treacle) is a certain Labour politician wants (again) to blame something unpopular in some quarters on a Tory government (even if it isn’t entirely true).

Add to this the ambition in some quarters to actually be Merseyside’s Mayor (because once it’s a done deal all they’ll need is the Labour nomination) gives a motive.

So that’s my opinion. The whole price/prize thing is a politician’s way of deflecting the blame knowing that generally the media won’t inquire too deeply and I think readers of this blog can make a jolly good guess as to who wants to be Merseyside’s Mayor.

Once again Labour are blaming something they want (a Merseyside Mayor) on the government, stating an untruth (that it’s a condition of the devolution deal which it’s not because the legislation would make that unlawful) and hoping everyone will believe it?

Well who do you believe? I’ve outlined above the consistent line that they’re trying to spoon feed the Merseyside public and the press whilst deflecting any attempt at scrutiny by politicians by openly refusing to state how the negotiations are going?

There will be an extraordinary public meeting of all Wirral Council councillors (as well as public meetings of councillors in the other areas of Merseyside and Halton) to discuss the devolution deal. Wirral’s will be held on the 19th November starting at 6.00pm in the Council Chamber at Wallasey Town Hall.

Isn’t it about time the public were told the truth?

John Brace on local Wirral and Merseyside politics (part 1)


JOHN BRACE: Hello, I hope you can hear me clearly. I’m John Brace and I’m going to be filming a series of videos as due to the half term holidays next week, there’s a shortage of public meetings.

So, I thought I’d start off by looking at one of the bigger stories on my blog this week.

That was about what I said at a meeting of the Merseyside Fire and Rescue Authority to the Chair Cllr Dave Hanratty and his response about councillors’ expenses.

I suppose I’d better briefly explain what the situation is regarding councillors’ expenses and allowances.

Councillors on the Merseyside Fire and Rescue Authority are entitled to claim expenses for instance for travel to public meetings and each year they’re supposed to publish a table detailing each councillors’ name and how much has been spent over the year in expenses for that particular councillor in various categories.

In fact that’s a legal requirement, a very basic level of transparency.

However unfortunately what Merseyside Fire and Rescue Service was doing was, where they received invoices directly rather than councillors claiming back expenses they’d incurred themselves, where trips were booked through Capita, train travel that kind of thing, Merseyside Fire and Rescue Service were invoiced directly but this wasn’t appearing on the actual annual lists so that about £6,000 or so of expenses were being left off. So I have been pointing this out over the past few months.

There’s also the issue that councillors get paid allowances and on this National Insurance and presumably things like income tax were paid. Now those amounts weren’t included in the annually published lists either.

I did ask Councillor Hanratty earlier, I think it was the day before yesterday whether these amounts would be included in future, didn’t get an answer.

Asked a question about this at the Birkenhead Constituency Committee, told it was a matter for Merseyside Fire and Rescue Service/Merseyside Fire and Rescue Authority.

I think they don’t want to give me answers on this, I think they hope I’ll just stop writing about it and move on to other things. After all I think there are far less councillors getting a taxi from home to the public meetings now since I started publishing what these expenses were for.

Anyway, another news story that’s seems to be popular on the blog is that Merseytravel’s Chief Executive David Brown is leaving. I think he’s leaving from some time next month to become Chief Executive of Transport for the North. Obviously that’ll be news for people that work at Merseytravel and I suppose you’re wondering what Transport for the North is!

Well it’s a new kind of regional body that’s been set up regarding transport matters and eventually it’ll become like Merseytravel is and the Combined Authority a statutory body. So I wish him luck in his new job and I think the Deputy Chief Executive Frank Rogers will be Acting Chief Executive until councillors decide on who the permanent Chief Executive should be, which should come to a future meeting in the future.

Anyway, another thing I’ve written about on the blog recently is to do with the whole Lyndale School closure matter. Now for those who have been following this story this is probably going to repeat what you already know, but Wirral Council officers said the reason the school had to close was that from 2016/17 which is the next academic year, that funding that they’d get for education from the government would be based on pupil numbers rather than place numbers.

Now at the moment I think there are about forty places at Lyndale School and about must be a dozen or so pupils. So basically they were saying that from next year, there would be a shortfall in Lyndale School’s budget.

But this hasn’t happened!

The Cabinet still decided to close the School, but the funding changes haven’t happened, Wirral Council will get the same funding as they did the previous year.

However despite them getting the same funding, they have actually made cuts from the SEN budget because there is flexibility at Wirral Council in that they can move money around within the education budget. They’ve still got to spend it on education, but they can move money around from say that allocated for teaching assistants for special educational needs to something else within that education budget and one of the things that’s been causing pressures on the budget is that they have a massive contract, I think it’s about half way through thirty years or something.

I’ve read through the contract and it’d take too long to go into here, but it’s a contract with Wirral Schools Services Limited for basically to rebuild a number of schools, but as well as the payments that relate to that there are also payments of millions a year I think that the schools have to pay this private company for services to do with the schools. For instance I think school meals is part of it, possibly cleaning and maintenance.

So the situation had been that Wirral Council was getting a grant from the government for some of this, but the contract meant that the costs were rising each year for PFI.

What was happening was, this money was being funded outside the education budget by Wirral Council. But then a political decision was made [by Wirral Council councillors] not to do this, which meant that a few million had to be cut out of the education budget elsewhere.

Hence why special educational needs got a cut, but again one of the other interesting twists and turns that came out in the Lyndale School saga is that the whole issue of whether the School should be closed or not seemed to arise around the time there was a revaluation of the land and buildings.

Off the top of my head I think the valuation was about £2.4 million [it was actually £2.6 million]. I’d better make it clear at this stage this is a what they call a technical, what’s it called, depreciated replacement cost value. It’s not a they send in an estate agent and they say how much would would we get for this and how much would we get for the school playing fields and so on?

No, it’s more they have to have on their asset list, a list of how much their assets are because obviously as a Council they have liabilities, they have to offset that with their assets.

But it’s a great shame what happened regarding Lyndale School, it’s not closed yet, it’ll close at the end of the academic year, but I think it could’ve been handled a lot better.

Obviously there’ve been recent revelations come out that the person that chaired the consultation meetings on the Lyndale School closure wasn’t in fact a Wirral Council employee, but is a what do you call it, a temp, a temporary worker because they couldn’t recruit somebody to the post [for £775+VAT/day].

He’s called Phil Ward and the problem was that, there was quite a bit of criticism levelled at him for the way he chaired the consultation meetings. Now obviously you can criticise anybody for chairing high profile consultation meetings. I’m sure there were criticisms of how Merseyside Fire and Rescue Authority did their consultation meetings.

But moving back to Merseyside Fire and Rescue Authority, the Saughall Massie issue, it was agreed by councillors on the Fire Authority to go ahead, they’ve agreed the four or so million pounds in the capital budget and a planning application has been submitted.

Now I’ve checked on Wirral Council’s website and I can’t see a planning application there yet but obviously they have to scan it in and put it on the website for consultation so people can make their comments and so on.

The other issue is there was a vote recently on whether Wirral Council should give the land or they may get something for it I don’t know, maybe they’ll give it to them, should give this land to Merseyside Fire and Rescue Authority for this new fire station in Saughall Massie.

Now, that was a five for, five against vote with one abstention so it got deferred to another meeting.

Now obviously it would be better if Wirral Council could make a decision reasonably quickly but I understand the point that councillors made at the meeting, that they felt they were only hearing one side of the argument and that they hadn’t got the information in front of them regarding the emails that had been released under Freedom of Information Act requests, they hadn’t heard the Fire and Rescue Service’s point of view because nobody had been invited along from the Merseyside Fire and Rescue Service and basically better decisions are made by politicians when they have the facts in front of them and they don’t like making decisions if they’re going to be made fools of later when it turns out there’s something they should’ve known or was in the public domain.

An example of that New Brighton car parking Fort Perch Rock fiasco. Now that went out to budget consultation, was agreed by Cabinet, was agreed by Council but what wasn’t known at the time was that Wirral Council had a lease for the Marine Point complex and that lease said that if Wirral Council introduced car parking charges at Fort Perch Rock, that they could be introduced in the car parking elsewhere there and Liverpool Echo journalist I think it was Liam Murphy got in touch with the company that runs the Marine Point complex and they said yes they’d have to introduce charges because obviously if Wirral Council had introduced charges at Fort Perch Rock car park then it would’ve displaced some parking to the free parking elsewhere, so then they’d feel they’d have to introduce charges themselves, but once these matters came out then there was a U-turn done on it and they decided they’ll make up the budget shortfall somewhere else.

But that goes back to my point about politicians having the information in front of them so they can make reasonably informed decisions. Now the reports that go before officers, sorry politicians whether that’s at Wirral Council, Liverpool City Council, Merseyside Fire and Rescue Service, Merseytravel and so on are written by officers. That is employees of the particular public body that the politicians are politicians for.

But there’s a question of, officers can have a particular point of view and make a recommendation and therefore ask the councillors to approve it, but officers aren’t actually going to know everything, but where do the public fit in all this?

Because of course in an ideal world, like for instance the Planning Committee yesterday where the public gets to speak for five minutes if they’ve got a qualifying petition. In an ideal world, if you were making a decision, say a major decision about a fire station being built, well that’s two decisions really, it’s a planning decision and whether Wirral Council give them the land. When you’re making a major decision like that, then not only should you have some sort of consultation with the public and by consultation I don’t mean publishing the papers for the meeting a week before, although that does give some advance warning so people can lobby the decision makers.

I’m talking about that people who are affected by the decision should have their say at a public meeting and I know there’ve been consultation meetings, that the Merseyside Fire and Rescue Service have run and that’s fine. But what I’m saying is the ball’s now in Wirral Council’s court, there has to be the usual consultation on planning applications, but it’s a very emotive issue.

And I think basically if I can sum up the positions, Merseyside Fire and Rescue Service have received a grant for some of the cost of this fire station and of course with the West Kirby and Upton fire stations being closed, they’ll receive something for the sale of those but basically they want to build it now in Saughall Massie because the site in Greasby has been withdrawn.

But the problem is that this is greenbelt land and there’s a lot of resistance from the residents regarding a fire station there.

Now in the not too distant past Merseyside Fire and Rescue Service did put in a planning application for a temporary fire station in Oxton while Birkenhead Fire Station was being rebuilt. I know that was later withdrawn but that caused a similar level of fuss and outrage and politicians saying they were against it and so on.

But the problem was that was only a temporary ~12 month arrangement, eventually they found some way round finding somewhere else. But the same issues that were brought up then, have been brought up regarding this Saughall Massie issue, you know the issues regarding sirens, traffic and so on but I think the elephant in the room really for Merseyside Fire and Rescue Service is that a number of the fire stations they’ve got are part of the PFI scheme, so they can’t close those without massive penalties.

I mean I think Birkenhead Fire Station is one example of one of the fire stations they’ve got under this PFI scheme.

So there are fire stations they can’t shut, so that leaves if they want to make any budget savings, for instance through cutting jobs and merging fire stations, they’ve only got the ones that aren’t the PFI fire stations that they can choose from.

And that’s part of the reason why Upton and West Kirby got chosen.

But I think one of the things that has currently got the public going, is that after there was pressure put regarding the Greasby site, that the offer of Greasby where there’s a library and community centre there was withdrawn and people are asking why Wirral Council isn’t doing the same thing with Saughall Massie?

Well basically these are decisions yet to be determined, it’s a party political matter because three political parties involved in the last decision on this voted three different ways, but I can see a problem because firstly Merseyside Fire and Rescue Service can’t keep Upton and West Kirby open. They just don’t have the budget for the amount of firefighters that would take.

Now one alternative is, just keep Upton open, now the downside to this according to the Chief Fire Officer is that this would increase response times to the Hoylake and West Kirby area, so that’s why they want somewhere roughly in between the two stations.

However then people raised the issue of Upton’s close to Arrowe Park Hospital, so it’ll take longer to get to there so wherever you have a fire station there’ll be people that have a quick response time and people that have a slow response time.

But the fire engines aren’t always at the fire station all the time, I mean about half the time they’ll be called out on a job, well maybe a bit more than that, they’ll be out somewhere else and that can’t really be predicted where they’d be at, whether they’d be fitting a smoke alarm or something like that.

So there are a lot of issues to do with the Saughall Massie fire station and basically I’ll be reporting on it, but at the same time I think it’s interesting seeing both the Merseyside Fire and Rescue Authority meetings and the Wirral Council meetings and how this issue has been dealt with at both of them.

Of course if the government hadn’t offered Merseyside Fire and Rescue Service a large grant to build a new fire station there, then I doubt this would’ve gone ahead, admittedly they could’ve borrowed the money or found the money from somewhere but I think that what’s interesting is I did make a FOI for the grant application that they made to DCLG, was told that this information would be published in the future so I couldn’t have it now and I’d have to wait till after the consultations were finished and by that they didn’t just mean the Upton and West Kirby consultations but they meant the other consultations because this grant is not just for a fire station at Saughall Massie, there are similar consultations and mergers and closures happening elsewhere across Merseyside.

So hopefully that will sum up things and I’ll point out that tonight at the Wallasey Constituency Committee, I won’t be there but I noticed because I read through the reports and the agenda, that the Motability, they have a little place in Birkenhead that hires out wheelchairs and things like that are looking to set up a place in New Brighton, so people can hire wheelchairs and that kind of thing.

So that’s a possibly positive move for New Brighton, because I know there’s been a lot of criticism at New Brighton and a large petition over the dropped car parking plans.

Earlier this month I filmed the first meeting of Merseyside Fire and Rescue Authority’s Police and Fire Collaboration Committee and blogged about its first meeting.

Around the time of that meeting, there had been talk of Merseyside Fire and Rescue Authority possibly being abolished and transferred to the Liverpool City Region Combined Authority if Merseyside had an elected Mayor which would happen at the earliest in May 2017. This formed part of the Liverpool City Region Combined Authority’s proposals to central government for greater devolution (as reported on this blog).

Since then the government has started a consultation (which finishes on the 23rd October 2015) called the Emergency Services Collaboration Consultation which proposes abolishing all fire and rescue authorities in England and transferring their powers to the Police and Crime Commissioner (on the left of the photo above).

This article in the Guardian about the consultation on the proposals has the opening two sentences which sum things up, "What do you do if you’re part of a government that believes in decimating the fire and rescue service as a means to making "efficiency savings", only to find yourself regularly thwarted by elected councillors who sit on the local fire and rescue authority? Answer: abolish the fire and rescue authority."

For those opposed to the proposed Saughall Massie fire station, the concept of such savings being thwarted by councillors on the Merseyside Fire and Rescue Authority will sound strange. The opposition to the plans for a fire station at Saughall Massie are coming from the local Conservative councillors for Moreton West and Saughall Massie and local residents compared to the councillors on the Merseyside Fire and Rescue Authority who are unanimously in favour of closing Upton and West Kirby fire stations and a replacement fire station at Saughall Massie.

It 2012 the Merseyside Police Authority (made up half of local councillors and half of independents) was scrapped and replaced with a Merseyside Police and Crime Commissioner. It would seem the Conservative government wants to do something similar to what the Coalition government did to the police authorities in 2012, but this time to the fire and rescue authorities in England.

What happened to the police authorities and their replacement with police and crime commissioners plus police and crime panels was part of the Coalition agreement:

"We will introduce measures to make the police more accountable through oversight by a directly elected individual, who will be subject to strict checks and balances by locally elected representatives."
 

The Conservative 2015 manifesto stated "We will enable fire and police services to work more closely together and develop the role of our elected and accountable Police and Crime Commissioners." but didn’t go as far as stating the fire and rescue authorities would be abolished and their functions transferred to the police and crime commissioners.

This government consultation on abolishing with fire and rescue authorities for England, shows a national political will for less oversight by local councillors of the fire services in England and goes against the grain of the localism agenda.

At a meeting of the Liverpool City Region Combined Authority, councillors, the Mayor of Liverpool and co-opted members agreed a revised set of recommendations. The revised recommendations appeared only minutes before the meeting started.

The revised recommendations approve a request to the Conservative government to devolve powers to the city region as part of a devolution deal.

Here are the original recommendations (with the crossed out parts deleted by the revised recommendations):

It is recommended that the Liverpool City Region Combined Authority:-

(a) comments upon, and endorses the devolution themes that will form the basis of the Liverpool City Region’s input to the Comprehensive Spending Review on the 4 September 2015 (NB: this detail will form the basis of a follow-on report for members’ consideration); and

(b) notes that the devolution process will remain an iterative process and that further information will be presented to future meetings of the Authority, for members’ consideration."

Here are the revised recommendations agreed today:

1.1 Liverpool City Region Combined Authority is recommended to:

  1. Approve the initial scope of the proposals as outlined in the supplementary report and the presentation made to the Combined Authority as the Liverpool City Region’s formal submission to the Government’s Comprehensive Spending Review, subject to a delegation to the Head of Paid Service in consultation with the Chair of the Combined Authority and the Lead Officer: Economic Development to make any drafting amendments to the final document;
  2. Continue negotiations with Government over the Autumn period in advance of the publication of the outcome of the Comprehensive Spending Review to secure a bespoke devolution ‘deal’ for Liverpool City Region which will:
  1. Drive economic growth and increase productivity;
  2. Reduce costs and improve outcomes across the whole of the public sector;
    and
  3. Improve social outcomes and better health and wellbeing for local residents.
  1. Note that any actual agreement with Government would require the approval of constituent Councils with appropriate consultation put in place;
  2. Note that devolution negotiations are an iterative process and that further information will be presented to future meetings of the Combined Authority, for Member’s consideration and approval; and
  3. Note that any Agreement will only be signed by both the Constituent Councils and Government when both parties are fully satisfied with the final details of the Devolution Deal.

So what are the proposals that the Liverpool City Region Combined Authority are asking the government for?

The proposals are in this supplementary report and include the points below (plus other asks):

  • Abolishing Merseyside Fire and Rescue Authority and transferring its functions to an elected Liverpool City Region Mayor
  • Abolishing the Office of the Police and Crime Commissioner for Merseyside and transferring its functions to an elected Liverpool City Region Mayor
  • Asking for a legislation change so that any surplus Mersey Tunnel tolls can be used for economic development
  • “the repayment of historic Mersey Tunnels debts by government”
  • Development Corporation Status for the Liverpool City Region
  • Creation of a Land Commission
  • “Designation of catapult Centres in the City Region for Manufacturing Technology Centre focused on marine and renewable energy and a Centre of Excellence for Infectious Diseases”
  • “A Free Trade Zone designation for the Liverpool Wirral Port system that includes provision for Global Zone-to-Zone Transfers, No Duty on Value Added and Enhanced Customs Warehousing”
  • “We want government to give us a long-term Special Rail Grant (SRG) to help
    secure a new fleet of Merseyrail trains.”
  • “the development of a generation system of regional significance, for example, an offshore tidal lagoon”
  • Also requested are “asks” under the headings of “cultural partnership and creative dock”, “community safety, enforcement, licensing and regulatory services”, “education”, “children’s services” and “health, wellbeing and social care”

Certainly the Liverpool City Region Combined Authority is asking for many changes from the government, which if agreed in principle will be subject to consultation.

Here are what some of the people on the Liverpool City Region Combined Authority had to say at today’s public meeting that agreed the proposals:

Mayor Joe Anderson (Mayor of Liverpool, Liverpool City Region Combined Authority) said, "There will be opportunities, there also will be more negotiations of more substance with businesses, with other political parties, with other interested groups like health, the voluntary sector, the trade unions and others to engage and involve themselves in the process."

Cllr Phil Davies (Chair, Liverpool City Region Combined Authority) asked, "In the near future presumably we’ll be drawing up a consultation programme if you like as the negotiations roll out?"
