I had an interesting meeting with Leonora and two Wirral Council officers in Birkenhead about the proposed changes to parking at the back of Birkenhead Market as a result of a traffic regulation order that’s being consulted on. I will start by pointing out that my wife Leonora regularly parks in the Birkenhead Market Service Road and has a Blue Badge. I did ask for my concerns to be fed into the car parking review which is now happening as a task and finish group chaired by Councillor Paul Doughty.

One of my issues was to do with the fact that if they went ahead with this traffic regulation order it would prevent users with a Blue Badge parking in the Birkenhead Market Service Road. We started our survey of parking outside the One Stop Shop in Conway Street. The short 15 minute bays there were permanently in use. Each time someone moved another car came in within a few minutes. Interestingly G4S was also parked in the short stay bay there and had gone in to the One Stop Shop (G4S were the company the people were protesting about outside the Mayor of Liverpool’s house as reported in the Liverpool Echo recently).

We crossed the busy road and went past the Birkenhead Bus Station.

The blue badge bays in the car park next to Birkenhead Bus Station were (no surprise there) all in use. We then walked around the first half of the Birkenhead Market Service Roas talking on the way. The officers said that the Pyramids/Birkenhead Market were paying the costs of the traffic regulation order because of problems they had with antisocial parking blocking deliveries.

There were a number of cars and a van parked on that stretch of the Service Road but no loading or unloading was observed during the time we were there (late afternoon). What is interesting though is that the Pyramids (one of two bodies we were told would be paying for the traffic regulation order) currently charge people for parking in their multi-storey car park (apart from on a Sunday).

Leonora raised the issues she had about being (if the Traffic Regulation Order came into force at some future date) that she would be forced to park elsewhere. One of the market stall holders (who runs the flower stall) came over when he heard us talking. He was confused by what the Traffic Regulation Order was about as guess what no consultation had happened with the individual stall holders! He asked if it would it affect his customers picking up flowers? The Wirral Council officers assured him that it wouldn’t and explained it was aimed at blue badge users parking on the Birkenhead Market Service Road.

Technically if they’re only picking up prepaid flowers they were right, however if his customers were parking (rather than loading/unloading) with a blue badge it will affect them.

Wirral Council officers admitted to me that they had not consulted the individual market stall holders. Consultation problems seem to be a recurring theme with Wirral Council recently. Officers felt that consulting with the company that runs the market was enough as they so them as a representative body (even though there seemed to have been no clear communication or consultation with individualmstall holders).

What I did surprise them with though was a paper copy of Birkenhead Market Lease & sublease (which in a rather twisted irony in all this is with Wirral Council) which I received last Friday as part of the 2013/14 audit.

What’s interesting (and the detail of this was seemingly unknown to those Wirral Council officers who started asking me where I’d got the lease and sublease from the answer being Wirral Council itself) is that there is then a sublease with the market stall holders. Here are some quotes from it (which mention the Grange too):

“1.1 Right to use half width of access road

The full and free right for the owners and occupiers of the adjoining property known as the Grange Shopping Centre (“the Adjoining Land”) (in common with the Council and all persons deriving title under the Council and all others entitled to a like right) at all times to pass and repass over and along that part of the access road situate on the Premises and shown coloured brown on the Plan with or without vehicles for the purpose of gaining access to or egress from the Adjoining Land but so that such right shall extend only to moving traffic whether pedestrian or vehicular PROVIDED that such right shall be exercised in one direction only such direction to be from the point marked X on the Plan to the point marked Y thereon or such other direction as shall be agreed from time to time between the Council the Tenant and the owner of the Adjoining Land and SUBJECT to the obligations of the Council but with the BENEFIT of the obligations of the owner of the Adjoining Land contained in paragraph (5) of the Part ii of the First Schedule to the Transfer dated 1st October 1992 and made between The Council (1) and Legal & General Assurance Society Limited (2) (“the Transfer”)

1.2 Rights over Market Loading Bays

The full and free right for the owners or occupiers of the Adjoining Land (in common with the Council and all persons deriving title under the Council and all others entitled to a like right) to use at all times those parts of the Premises shown hatched red on the Plan for the purpose of parking motor vehicles loading or off-loading or waiting to load or off-load goods into and from the Adjoining Land or any part thereof and for no other purpose whatsoever PROVIDED that (save as mentioned in paragraph (6) of Part ii of the First Schedule to the Transfer)(except in case of emergency) no motor vehicle shall be so parked for a period in excess of one hour at any one time nor in a manner as shall obstruct traffic on the said access road coloured brown and green on the Plan SUBJECT to the obligations of the Council but with the BENEFIT of the obligations of the owner of the Adjoining Land contained in paragraph (6) of Part ii of the First Schedule to the Transfer”

I presume as it mentions the side run by the Pyramid/Grange that there is something similar in their lease too. In other words what’s the point of a Traffic Regulation Order as Wirral Council is currently because of the contract they signed with the tenants (at least on the market side) supposed to be managing effectively the traffic in the Birkenhead Market Service Road through this clause in the contract already?

The fact that the two officers involved with the Traffic Regulation Order didn’t know about the clauses in the Birkenhead Market sublease until I brought it up is worrying in itself as surely the Asset Management side of Wirral Council has a copy of the lease and subleases for day to day management?

One of the two officers rather amusingly asked me “Do you know the budgetary pressures the Council is under?” (or words to that effect). I have a rather short reply to that as the press I was and tried not to smile too much at the question.

The point is, if someone is parked where they shouldn’t be and caused a nuisance or blocked that road it’s a police/traffic warden issue to deal with.

Much of the road can’t be currently parked in by blue badge holders as it’s even loading bays or double yellows with kerb blips.

The issue to do with traffic flow is also a civil matter too to do with how you enforce the lease. The fact the traffic side at Wirral Council doesn’t know what the asset side at Wirral Council is doing (and seemingly don’t talk to each other) is perhaps a rather worrying sign of a “silo mentality”.

The fact that the costs of the Traffic Regulation Order are being paid for by a company that will benefit from people paying an extra £2 at the expense of the disabled who will be prevented from parking for free here is again another worrying example of Wirral Council seemingly being on the side of commercial interests.

Officers did suggest as a compromise that if we dropped our objections to the proposed traffic regulation order that they would monitor the parking situation in a year’s time. This was not accepted. I also asked for these issues to be fed into the current car parking review and promised to email the relevant sections of the Birkenhead Market lease to them.

Sadly this is another tale where there has been lack of consultation with the individual market stallholders on an issue that will affect their trade. Wirral Council seem to take the “Beware of the Leopard” mentality of saying that they don’t have to consult with them and the plans were available and that it’s not their fault if people didn’t go and look at them.

Anyway the consultation on this proposed Traffic Regulation Order runs to Friday 26th September. If there are any unresolved objections after that it goes to the Highways and Traffic Representation Panel. The Highways and Traffic Representation Panel can then make recommendations to their parent committee.

However that’s just democracy for you. It seems however that Wirral Council once again are rubbing disabled people up the wrong way and who’s Wirral Council supposed to represent anyway, the people or “commercial interests”?

According to Wirral Council officers today (who aren’t going to just drop the plans because of these objections) the commercial interests of the people paying for the Traffic Regulation Order seem to (at the moment) carry more weight than the concerns of the people this will affect. Leonora did have a few things to say about the culture at Wirral Council, but I gather producing the lease & sublease (which came as a total surprise to them), shows there are existing contract obligations which as that covers most of the people using this road duplicates the purpose behind the Traffic Regulation Order.

Are they really going to go to the costs of possibly renegotiating the subleases with all market stall holders over this? Why do I ask that? Yes market traders have a specific badge on their car, but some of them will have Blue Badges and will park in the service road, which if the new Traffic Regulation Order comes into effect will mean they’d get (if a traffic warden was around) a ticket as market stall holders are limited to an hour maximum. Why can’t Wirral Council just deal with this as another other landlord/tenant issue? Words do fail me on this one really, but I could go on for a further thousand words on the thorny issue of parking and Wirral Council and still just be scratching the surface.

One of the new items added to Wirral Council’s Forward Plan (which will be decided by Wirral Council’s Cabinet in June) is The Wirral Borough Council (Grange Road, Birkenhead) Compulsory Purchase Order 2008 which relates to an outstanding compensation claim.

Although the Forward Plan doesn’t mention it, Cabinet will be asked to accept a recommendation from officers to settle a claim made by B&M Retail Limited arising from the The Wirral Borough Council (Grange Road, Birkenhead) Compulsory Purchase Order 2008.

B & M Retail Limited objected to Wirral Council’s use of compulsory purchase orders to build an Asda in Birkenhead Town Centre which resulted in a planning inquiry. The twenty-four page report of the Planning Inspector Christina Downes into Wirral Council’s use of their compulsory purchase order powers can be read by following that link.

Two of the people at Wirral Council named on the equality impact assessment for the recommendation to June’s Cabinet to settle the compensation claim of B&M Retail Limited will be familiar to those who have read the media coverage about the court case involving the tenants of Fernbank Farm back in January. They are EIA Lead Officer Tony Simpson (line manager for David Dickenson) and Chief Officer David Armstrong. Head of Section Jeannette Royle is also named on the Equality Impact Assessment.

How much the compensation claim of B&M Retail Limited is for is not known, however it is likely to be for a large amount. It is listed as a key decision on the Forward Plan, which means it is either for £500,000+ or is for ten percent or more of the agreed budget for this area. The Cabinet Member for this area is Councillor Adrian Jones (Cabinet Member for Central and Support Services).

Councillors on Wirral Council’s Licensing Act 2003 Committee yesterday listened to a brief talk from a Mark Latham of Wirral Street Pastors about what Wirral Street Pastors do on a Friday evening and Saturday morning in Birkenhead. Mr. Latham said that he would give a quick overview of what Wirral Street Pastors do and what they are and hoped from that that the councillors would glean valuable information.

He said that his role as coordinator was to try to develop a better relationship between local government, Wirral Council and the police. So far he had had meetings with the Police and Crime Commissioner for Merseyside (Jane Kennedy), Rt Hon Frank Field MP, Rt Hon Esther McVey MP, Cllr Ian Lewis and Emma Degg (a couple of times). Mr Latham said that these meetings were to bridge the gap between what the Wirral Street Pastors do and what they see.

He explained that street pastors started ten years ago when they saw a need that people in the night-time economy were drinking, being drunk and that there were lots of problems relating to those things such as fighting, antisocial behaviour, violence and crime in general. Mr Latham said that Wirral Street Pastors did the same as what other street pastors across the country did and that they were out on Friday night around Birkenhead patrolling the streets, making sure people were safe and making sure particularly vulnerable individuals got home safely.

The example of a young girl on her own was given and he said that one of his team (which were made up of female and male individuals) would stay with them and either ring their parent or a friend or get them into a taxi to make sure they get home safely. Wirral Street Pastors also gave out free flip-flops to ensure that women who had taken their shoes off don’t stand on broken glass or the general filth that’s on the streets.

In addition to free flip-flops Wirral Street Pastors also give out bottles of water and space blankets to the homeless and people who’d had one too many to drink. The aim of this was to hydrate them so that the taxis would take them. He said that some people were so drunk that taxi drivers refused them rides as the taxi drivers were concerned that these people would throw up in the back of their taxi.

Mr Latham said that the average cost to the National Health Service of a drink related incident was £4,000. He said every pair of flip-flops that they gave out meant that that person wasn’t standing on broken glass requiring an X-ray which would cost the taxpayer money. For every fight that the Wirral Street Pastors had broken up, every antisocial behaviour incident that was simmered down put less of a strain on police resources.

He said that they had a standard operating procedure with the police that allowed Wirral Street Pastors to engage with people allowing the police to concentrate on what they needed to do. Mr Latham said the Wirral Street Pastors dealt with the homeless who they gave space blankets too as well as signposting them to the Wirral Churches Ark Project, ARCH Initiatives and other agencies.

Mark Latham gave an example of somebody having their head stamped on a fortnight ago was given, Wirral Street Pastors stayed with him until the ambulance turned up and that he was fortunate that Wirral Street Pastors had been with him “because he would have been dead within about half an hour” because he was losing consciousness.

He told councillors about another person who was “roaming round”, who was “suffering from mental illness” that the Wirral Street Pastors “got back on his medication” and dealt with his needs. Mr Latham said that most of the time that the Wirral Street Pastors were just there to make sure people are safe and to be a listening ear. He referred to Cllr Ian Lewis coming out with the Wirral Street Pastors recently and that Cllr Ian Lewis could relate his experiences of that to the other councillors on the Licensing Act 2003 Committee. Mr Latham said that the Wirral Street Pastors were engaging with the community, the neighbourhood and the people who were out in the night-time economy. He said that there was much more to it than he had outlined, but he was happy to take questions from councillors.

The first question was from Cllr Harry Smith asking if the Wirral Street Pastors were connected to a church and whether they wore any special gear when they were out at night. Mark Latham replied that they had a uniform that they had to wear which was a DayGlo duotone blue jacket. He said that it was a condition of their insurance that they had to wear these uniforms but also so that they were identifiable and that the police knew who they were. He said that the Wirral Street Pastors are a Christian organisation. He said there were various inter denominational churches across the Wirral that were involved.

Mr Latham said that the Wirral Street Pastors were the only recognised ministry by the police and that the reason why it was recognised was because it wasn’t proclamation, that the Wirral Street Pastors didn’t go out preaching but they were just there to help people. He added that the Wirral Street Pastors were a highly trained group of individuals that had “police training”.

Cllr John Salter asked who the Wirral Street Pastors got funding from? Mark Latham answered that they don’t and that all volunteers paid £300 each to do it. Although it was supported by the Home Office, their standard operating procedures were “signed off by Scotland Yard and the Home Office” that that was the entirety of their involvement. He said that the national statistics were fed back regularly to David Cameron, but that the only funding they got was what they received from individuals as well as grants from Christian organisations.

Cllr Andrew Hodson asked how many Wirral Street Pastors there were in total and how many were out on the streets? Mark Latham answered that there were fifteen. He said that they went out every Friday night in teams of four (two men and two women) starting at half past ten at Charing Cross and finish at four.

Merseyside Police’s Sergeant Barrigan addressed councillors on Wirral Council’s Licensing Act 2003 Committee calling for a change to their licensing policy. He told councillors about concerns raised about alcohol related antisocial behaviour in the Charing Cross area of Birkenhead and showed those present maps of street drinking reported to Merseyside Police between the 1st April 2012 and the 1st March 2013. These reports were clustered around the Charing Cross area of Birkenhead.

He also showed a map of crimes reported between November 2012 and October 2013 in this area and said that 52% had taken place on licensed premises and referring to areas of Liverpool which already had four areas covered special cumulative impact policies.

Sgt Barrigan quoted statistics on how alcohol was a reason in a high proportion of the theft offences in that area. Street drinkers were a problem in the area with people drinking on the streets for reasons such as an inability to afford heating or to avoid being evicted. The street drinking was connected to a high number of off-licences in the area. In answer to a councillor’s question he said that the boundaries of the area he wanted covered by the special cumulative impact policy would cover both sides of the road on the boundary. He asked if councillors had any questions?

A few councillors asked questions, then others spoke in support of a special cumulative impact policy in the Charing Cross area and it was agreed that a special cumulative impact policy would be consulted on. Cllr Jean Stapleton welcomed this decision.

Cllr Tony Norbury said he was concerned that it might move the problem to outside the area covered by the special cumulative impact policy. A Council officer said that they would consult on the new policy and if the committee then agreed to amend the guidance then it would be kept under review.

A special cumulative impact policy (if agreed following consultation) in the Charing Cross Area of Birkenhead would mean that there would be a special policy of rebuttal regarding licence applications in this area. This would mean that applications in that area that were likely to add to the existing problems would be refused or subject to limitations (but only if relevant representations had been made).

Jim McGinley asked the first question in the public question time at the Birkenhead Constituency Committee. His question was, “Why can’t the Council be persuaded to do what twenty-one other councils have done and insisted that the provisions of the 1985 Housing Act in relation to room size do apply to implementation of the bedroom tax?”

Paul Haywood asked two questions. The first one was “How this group is tying into the main Council and how we and the other areas are tied back to the main Council?” and his second question was about the information supplied for agenda item eight (update on data collection).

A member of the public at the back asked, “Can we start having things like workshops so we can understand?”

Lynn Evans, Chair of Devonshire Park Residents Association and Devonshire Park Neighbourhood Planning Forum asked, “A very genuine question, which is that this was introduced as a very exciting development and very new. I would really like to understand what is really exciting and what is new about this committee?

The things that we’ve heard talked about are absolutely vital, setting priorities, how public spending is controlled, making sure we get quality from contracts, looking at the huge need that we know we have in Birkenhead, but I understood that this group was about strategy and surely when we’re talking about strategy, we can’t be talking about how we can not deal with the day to day allocation of resources to address those problems but how we actually address the problems strategically? How we look at a regeneration plan for the area? How we lift ourselves up out of poverty, not looking at what is uniquely bad about Birkenhead, but looking at what our unique character is and what our unique assets are and how we can really lever those to attract investment into the area to lift ourselves out of this mentality of being a deprived area?

My view is that what we really fail our people in Birkenhead is not in terms of opportunity but in terms of aspiration and that really as a group should be setting the agenda for that and having the highest aspiration for Birkenhead. We talk about NEETs, young people who aren’t in education or training or employment but the missing link in that is entrepreneurialism. How will this group engage with the business community? How much will you give these young people something to aspire to that they can do as individuals to lift themselves and at the same time … out of the trap that we seem to feel we are in? Thank you.”

Philip asked, “Cllr Davies mentioned at the start the ambition to prepare a Neighbourhood Plan but Devonshire Park already has one. They didn’t need this committee to prepare a Neighbourhood Plan, they got on and did it. That’s what we need to do, that’s something we could do. All you need is twenty-one people, surely you can find twenty-one people across all the wards represented here and you could start working on those strategic issues? Hopefully with the help and … council officers, so you don’t need a lot of money to start working if you wanted to do …”

Pauline Cocker asked, “I’d just make suggestions to make all this more meaningful, as to me this is like an Area Forum gone mad. That somebody you know on an A4 sheet or two puts a plan together for the January meeting for what we need to look at for the budget for 2014/15 because we’re nearly at the end of this year. We’ve got to spend this money but what perhaps the priority should be that we start looking at you know in January, somebody comes up with some kind of plan we can all sit here and say ‘Yes, no, we don’t like it’ get something out.

That kind of back into the community and for it comes back at the end of March when it’s been out to the community properly so that the community feels that they’ve actually had a say in what’s going on and just another suggestion for how to spend the money, perhaps you could spend it on engaging with the children and youth who are responsible for antisocial behaviour and a lot of people will notice a difference in their area and a meaningful engagement with youth not just a one-off that keeps them busy for two weeks and then they’re back.”
