Yesterday saw councillors discuss freedom of information requests and how Wirral Council handles them in response to this Lib Dem motion. As a number of the ICO decision notices are in response to my requests, I will declare an interest before writing any further.

Interestingly, the day before the Transformation and Resources Policy and Performance Committee met, Surjit Tour had written an eight page "briefing note" which was referred to by councillors during the debate.

The Conservative amendment to the motion was withdrawn and the Labour amendment to have a task and finish group of councillors meeting to discuss FOI behind closed doors (again) on the subject (in the spirit of openness and transparency of course!) was agreed.

However what will probably make more interesting reading is the briefing note itself which I reproduce below (it’s not published with the papers for the committee or indeed anywhere else). It’s a bit hard to summarise eight pages, but it’s basically eight pages of justification by officers that they’re doing their best they can on FOI (with the promise of improvements) and that it isn’t as bad as the bleak picture as painted by Lib Dem politicians. If the thumbnails are hard to read, they should each link to a more high resolution version of each page.

Below is a copy of my statutory objection to the approval of the accounts of the Merseyside Pension Fund (a £6.9 billion pension fund that form part of Wirral Council’s accounts) which go to Wirral Council and its auditors Grant Thornton.

It’s rather dull and technical, but in the interests of openness and transparency I am publishing it below. It relates to yesterday’s meeting of the Pensions Committee that can be viewed below. I was so cheesed off I made two spelling mistakes in the email (a corrected version is below).

Dear all,

I am a local government elector in the Wirral Metropolitan Borough Council area and make this statutory objection to the Pensions Committee approval of the the Merseyside Pension Fund Accounts for 2014/15 (see Audit Commission Act 1998, s.16).

For the purposes of clarity to the auditor this is a statutory objection to a matter not in relation to a matter covered by Audit Commission Act 1998, s.17-18 but Audit Commission Act 1998, s.8.

As required I am sending a copy of this objection to the auditor, those I have contact details for on Wirral Council’s Pensions Committee (I do not have an email address for Cllr Treena Johnson), Wirral Council’s Audit and Risk Management Committee and those tasked with corporate governance at Wirral Council such as the Monitoring Officer Mr. Tour, the Head of Pensions Peter Wallach, the Strategic Director for Transformation and Resources Joe Blott and Tom Sault the Acting 151 Officer as well as other relevant people.

I do not have contact details for some on the Pensions Committee. I am sending this to the officer who took the minutes of the Pensions Committee meeting on the 14th September 2015 in the hope that it can be forwarded to those I do not have contact details for (the non-councillor members and Cllr Treena Johnson).

As this is a rather technical objection, I provide below a summary of the key points.

However I first need to declare an interest. I have a close family relative who is currently paid a pension by Merseyside Pension Fund, therefore a close interest in the corporate governance of the Fund being done properly.

On the 14th September 2015, I and three other members of the public (two of whom were employed by Grant Thornton and are Wirral Council’s auditors) attended a public meeting of Wirral Council’s Pensions Committee.

One of the functions of the Pensions Committee as detailed in Wirral Council’s constitution is to approve the statement of accounts and financial statements of the Merseyside Pension Fund and recommend these to the Audit and Risk Management Committee.

This is because the Merseyside Pension Fund forms part of Wirral Council’s accounts. There is a statutory deadline to approve the statement of accounts for the 2014/15 financial year by the 30th September 2015.

As mentioned at the Pensions Committee itself by one of the councillors this Fund is valued at ~£6.9 billion.

Item 4 and 5 on the agenda of that meeting were the pension fund accounts 2014/15 and draft annual report.

As the Pensions Committee is a public meeting of a local authority, legislation that governs public meetings applies to it. The statement of accounts formed part of a document known as the “Report & Accounts 2014/15” which was given to those on the Pensions Committee present on the afternoon of the meeting itself.

Please note the reference below to principal council, by virtue of Local Government Act 1972, s.100E also apply to committees and sub-committees of a principal council. The Pensions Committee is a committee of a principal council.

Local Government Act 1972, s.100B(4), is quite clear on the procedure that should be followed in the case of agenda items that are not open to inspection by members of the public five clear days before the meeting.

(4) An item of business may not be considered at a meeting of a principal council unless either—

(a) a copy of the agenda including the item (or a copy of the item) is open to inspection by members of the public in pursuance of subsection (1) above for at least [five clear days] before the meeting or, where the meeting is convened at shorter notice, from the time the meeting is convened; or

(b) by reason of special circumstances, which shall be specified in the minutes, the chairman of the meeting is of the opinion that the item should be considered at the meeting as a matter of urgency.

It is clear that the Report & Accounts 2014/15 for the Merseyside Pension Fund did not fall under the description in s. 100B (4)(a) and therefore the procedure in 100B(4)(b) applies. The Chairman of the Pensions Committee Cllr Paul Doughty did not specify at the meeting itself his opinion that the item should be considered as a matter of urgency, nor would the reasons for this be specified in the minutes.

This is an important corporate governance safeguard written into legislation.

Firstly, if the documents are not made available to the public five clear days before the meeting, the public and press cannot scrutinise them. Secondly (as was mentioned at the meeting itself) at least one councillor expressed the view that half an hour was insufficient to scrutinise a highly technical 46 page document.

This is not a one off occurrence. Officers in previous years have frankly played these games of brinkmanship with accounts routinely handed to those tasked with corporate governance to approve on the evening of the meeting itself. The safeguard above in s.100(4)(b) above, details a procedure to be followed if the matter is urgent.

Therefore my objection is that because of what I have detailed above, the Pensions Committee did not approve the statement of accounts for the Merseyside Pension Fund because:

(a) the report was late and
(b) it is clear from the legislation that a procedural step was missed making the decision ultra vires.

I am however not an unreasonable person and suggest the following course of corrective action. If this is followed I will happily withdraw my objection.

i) That the Pensions Committee holds a further meeting between now and 30th September 2015.
ii) The Audit and Risk Management Committee recommendation is altered (agenda item 12 meeting of the 22nd September 2015) to be conditional on the meeting outlined in i) and the same for any Cabinet meeting that has to approve the same item
iii) That at this special meeting it considers the items referred to in this objection in a way that is not open to legal challenge or perceived to be ultra vires and that the information for this meeting is published on Wirral Council’s website five clear days before the meeting.

As Wirral Council’s auditors Grant Thornton will no doubt make clear, the matter that forms this objections needs to be resolved before the accounts are signed off. I look forward to reading and hearing responses to this objection.

However as this is a perceived serious corporate governance failing, I am making this objection public.

Annual Meeting of Wirral Council (Part 1) 18th May 2015

It was a return to the traditional venue of the Civic Hall at Wallasey Town Hall for the annual meeting of Wirral Council to elect a Mayor.

Outgoing Mayor Cllr Steve Foulkes started his last speech as Mayor by thanking many people who had helped him during his time as Mayor. Over £32,000 had been raised in support of the charities chosen by him (Stick ‘N’ Step, Clatterbridge Cancer Centre and Wirral Foodbank). He also made an appeal for councillors and employees of Wirral Council to enter the Mayor’s lottery.

Matthew Lewis (the Mayoral cadet) was then awarded a certificate by the Mayor (as pictured above).

Mayor Steve Foulkes continued by paying tribute to the Deputy Mayor and Deputy Mayoress. He said that meetings of all councillors had gone well this year as people had been polite to each other and respected each other. Together with the Deputy Mayor they had been to six hundred different engagements. He went on to say “and finally it’s the first time in my life I’ve been genuinely liked as a politician”. Highlights of his year included the Open Golf Championship and WWI commemorations and he referred to Wallasey Town Hall’s history during WWI as a hospital.

Here are two of the jokes he told:

“It’s only recently I heard the tale that we were mentioned in the Arthurian tale Sir Gawain and the Green Knight. You may remember that?

We’re described, the Wirral’s described as a mysterious, forested place inhabited by man and beast that God cannot love. It’s good to see the Wirral PR team still in action in the thirteenth century!”

followed by

“This story is about the river streets. A guy coming home, anyone know the river streets in the north end of Birkenhead? Yeah? A guy’s coming home, he’s a little bit tiddly, he finds a dead body of all things in the street.

So in the old days when we had phone boxes, he goes to the phone box and he rings up. ‘Yes sir, what’s the incident?’ He said, ‘I’ve found a dead body’ ‘Give me your name sir’ ‘Yes I’ll give you my name’ ‘Now we need to know exactly where the dead body is, where is it sir?’ He says ‘I found the dead body in Buccleuch Street’ ‘Well sir, I’m afraid you’re going to have to spell that for us, can you spell Buccleuch Street?’

Phone goes dead, two minutes later the guy comes back puffing and panting. ‘It’s alright la, I’ve dragged the body into Avon Street.'”

Cllr Jeff Green (Conservative Leader) proposed Cllr Les Rowlands as Mayor and gave people a few insights into Cllr Les Rowland’s childhood and career. He said the charities that Cllr Les Rowlands had picked for fundraising during his Mayoral year would be the Clatterbridge Hospitals League of Friends, North West Air Ambulance and the Alzheimer’s Society.

Cllr Phil Gilchrist (Lib Dem Leader) seconded Cllr Green’s nomination of Cllr Les Rowlands as Mayor.

As there were no other nominations Cllr Steve Foulkes declared Cllr Les Rowlands elected as Mayor. The meeting was then adjourned so that Cllr Les Rowlands could put on the Mayoral robes and return.

Last year I wrote a piece on this blog headlined The day democracy and freedom of the press died at Wirral Council: 28th October 2014 and earlier this week published my email to councillors on the Standards and Constitutional Oversight Committee detailing my concerns about a proposed policy banning filming at public meetings of Wirral Council.

Last night councillors (as you can see from the video above) on Wirral Council’s Standards and Constitutional Oversight Committee agreed to bash the final nail in the coffin of press freedom to report on public meetings of Wirral Council and recommended to all councillors at the next Council meeting on the 16th of March that press freedom remain dead and buried (that is they recommended a draft policy on the reporting of all public meetings of Wirral Council).

Around the time a new law (the Openness of Local Government Bodies Regulations 2014) came into force last August, which prevented local councils stopping filming of their meetings, Eric Pickles was quoted as saying "How can we criticise Putin’s Russia for suppressing freedom of the press when, up and down the land, police are threatening to arrest people for reporting a council meeting with digital media?"

Labour councillors on the Standards and Constitutional Oversight Committee last night repeatedly prevented any discussion by opposition councillors on the controversial subjects of the closure of Lyndale School and library opening hours. If councillors from the ruling group can’t respect and listen to viewpoints they may not agree with, how can democracy actually function at all on Wirral Council?

Despite concerns I expressed at the meeting itself about the lack of consultation and concerns over whether the draft policy breached both section 6(1) of the Human Rights Act 1998 (in respect of Article 10 on freedom of expression) and Regulation 4 of the Openness of Local Government Bodies Regulations 2014, councillors agreed to recommend it to the next Council meeting.

The draft policy (if approved by Council) will mean that at the start of the meeting the Chair will ask anyone if they have any objections to the meeting being filmed. If someone does object the Chair will stop the meeting being filmed. However any legal powers Chairs may have had to stop filming of public meetings were repealed by the Openness of Local Government Bodies Regulations 2014 last year.

The policy goes much further and states a ban on editing filming, photography or recording of a meeting that could cause “reputational harm”.

Wirral Council seem to not recognise the importance of the independence of the press and councillors on the Standards and Constitutional Oversight Committee don’t seem to think there is anything wrong with this policy.

Cabinet – item 7 – Notice of Motion – The Corporate Plan’s Ideals in Practice

The mundanely titled motion The Corporate Plan’s Ideals in Practice was put forward for debate by two Lib Dem councillors at the Council meeting of the 8th December 2014. However no debate had happened then and it had instead been referred to Cabinet. The notice of motion was mostly about the closure of Lyndale School and how the decision had been made.

Cllr Gilchrist’s criticisms of how the decision had been made ranged from questions the parents had submitted in March 2014 which had not been answered, the way the consultation meetings had been chaired, how what was said at the consultation meetings had then been reported back to Cabinet, the imbalance between the financial resources of the Council compared to the financial resources of the parents to challenge the decision and the consultant’s report on the SEN Improvement Test (amongst other points he made).

Cllr Phil Davies responded that he had read that there might be a legal challenge so he asked Mr. Tour for advice. Surjit Tour said that they hadn’t received notification of a claim or a claim itself, but that a decision had been taken by Cabinet about the Lyndale School. He advised that councillors not to speculate in response to the specific points about the potential claim, bearing in mind that they were on notice that there may be a potential claim. Mr Tour asked them to stick to the Corporate Plan issues and engagement issues.

The Cabinet Member, Cllr Tony Smith thanked Mr Tour for his advice. He outlined the history of the decisions on Lyndale School, the consultation meetings and the visits councillors had made. The “significant amount of correspondence” on many issues about Lyndale School was also referred to by Cllr Smith, so was the consultant’s report and the equality impact assessment.

Cllr Phil Davies responded by saying “I do believe that we were faithful to our principles in listening to people. Phil can I just remind you that listening to what people say doesn’t always mean you have to agree with them?” He said he had read the report of the parents, visited Lyndale School, met with the parents and he repeated that he believed the Cabinet had listened but that they “came to a different conclusion than you did Phil but that doesn’t mean to say we didn’t listen.”

He said the decision was based on “sound evidence and thorough analysis” and that “we did understand what the community was saying to us”. Cllr Davies believed that they had been faithful to the principles in the Corporate Plan and that that was the Cabinet’s response.

Not unsurprisingly Cllr Gilchrist disagreed with whether the analysis had been thorough, he also pointed out that there had been issues about the creation of the funding formula and its application across various schools, but as the issue was “parked” he’d see what the outcome would be.

Cllr Phil Davies felt that they’d met the requirements, and whatever happened in the legal case they’d need to respond to that “in due course”. He thanked Cllr Phil Gilchrist for his attendance.
